I know individuals who are filing and have a greencard it can take a while, but 4 years is a long time...Have you tried calling USCIS? did they say anything?
I upgraded my wifes petition last year December 08, no decision yet. Can i take them to court, I am getting impatient ... after 4 years of marriage my life is being destroyed by this process of waiting.http://www.visalaw.com/05feb3/2feb305.htmlthat will get you started.. and I have more too.. but I think you still need to wait a bit.. normally it takes 6-8 months.. waiting about twice that will net you a lawsuit complaint (also known as "writ of mandamus")..

Mash-allah, congratulations=) That's really exciting news. My wife's interview is next week and I'm hoping, Ins-allah, all goes well. I just don't know how long it will take them to return their passports? Please keep us posted! Thanks....and once again, congrats!

Thanks for the advice! I called NVC and they told me that they were unsure as to why they sent that to me. But they did say that my wife needs a new police certificate for the interview as sometimes police certificates expire-which i didn't know could happen....but thanks for your all of your help!

Hello Everybody,
I'm a little confused and am hoping somebody can shed some light on this....I called NVC last week and they said my case was complete, however they were unable to schedule an interview for this month, so it would probably be next month. I called them today and they told me that the interview date is June 10th, but then i just got an e-mail saying i'm missing my AOS and my wife's police clearance. I thought that they needed all this information prior to a case being complete or scheduling an interview... I guess my question is, do we resend everything again? Or is it possible that they have it and we don't need to resend it. Any advice or suggestions would be helpful...Thanks!

quick q, i finally got my NVC # today and how do i know when to send in my 3032? did you guys recieve an e-mail or will the AVR say that the my 3032 has been generated? and when you did e-mail your 3032 did you follow the e-mail format or send it via a pdf attachment?

I'm so excited that my I -130 has been approved! Even though the case status hasn't really changed in the website, I just got the letter in the mail! I didn't expect everything to happen so soon, i don't even know what's coming next-I'll be reading the guiedes this weekend. But thanks to all for their help and support!

i don't know where the thread is for jan filers, if you find out, let me know...but i filed my I-130 in jan too! i was looking at the timelines and it looks like they'll get to our application end of april/beginning may (hopefully)...until then, i guess we sit tight

I think the OP is asking if the 2 yr requirment is the same for K-3 as it is for K-1.....Yes, you need to meet in person atleast once if you are filling out the I-129F......and ofcorse if you are filling out for a K-3 you have to be married, and for that you will have been together in person. So basically, either way you have to meet
so in June 2009 when you go to New Zealand to meet her IRL....she will be elegible for I-129F and once your married elegible for the K-3
Married people must first file an I-130 petition and get a reciept before they are eligible to file an I-129F. Doing so is generally a bad idea under the current immigration procedures. K3 is really about 90% a "dead" visa category.

I-130 with or without 129f…does it really make a difference? According to the USCIS processing times (for California) it takes about 6 months for both I-130 and I-129f, what has everyone’s experience been?

Hello all,
I just want to say that its great to have a forum like this, it makes applying for a visa more manageable. I just got married less then 3 weeks ago and am now applying for a K-3 visa. I’m in the process of filling out a I-130 and had two questions. First, the instructions say that the applicant SHOULD provide evidence of an ongoing bonifide marriage. What has everyone’s experience been? Is this necessary? Second, in addition to submitting my birth certificate, I’ve copied the first two pages and the last two pages of my passport-is that all they want? Any suggestions? Any help would be greatly appreciated!
