  1. no... you must file with a USCIS service center located in the states unless you qualify for filing directly with the consulate... If you have been legally residing in Canada for 6 mos. or more then you might just qualify... It is typically a far quicker process than anything stateside.

    In addition, some people fail if they have not maintained US domicile... (ie.. filing taxes, bank accounts, residence, etc...)

    I've been a legal resident for over 3 years. I've maintain my tax filing as well as a few financial accounts. So I should be ok then. BUt you recommend processing with the consolate in person versus mailing it to the states? I can't even find an address to send it to if you're not residing in the US, but I'm sure there must be one.

    I am a US citizen residing in Canada with my Canadian husband and dual citizen (US and Canadian) son. I am looking into starting to immigrate my family to MN. I am starting to fill out the I-130 and G-525A forms. In reading a guide in the past, I believe I read that in order to complete our immigration, I actually have to be residing in the US as well? This didn't make much sense, but can anyone confirm if this is true?

    Any info would be appreciated.
