  1. eek. Husband has a trip bought and paid for the week they have scheduled this.

    What to do?

    I tried calling the numbers provided on the notice of action but got nowhere.... anyone?

    You had no idea when you made the plans for this trip that you had an AOS interview in your future? :blink:

    Reschedule the trip. What's more important in the long run?

    It's a no brainer to me, however hubby not so happy.

    He scheduled the trip before we filed.... we'll figure it out. I don't want to risk anything personally. :)

    well I doubt they would think that it is an emergency situation so I don't think rescheduling will even be an option in this case. :(

    "Emergent" is not the same as "emergency." It means arising unexpectedly. You didn't expect them to schedule the interview when your husband was going to be out of town; therefore, you have an emergent situation. I'd suggest making the appointment.

    can you tell me what happens if I make this appointment and more details? Kind of confused. thanks

  4. Thank you all for your comments.

    Being tied to an employer through a TN visa is horrible especially if you hate the employer/job. You have no option. I have the type of career that allows me to freelance work easily and I have been in my profession over 12 years so I'm not too worried about work, I just want to ensure that it's legal that I work for myself. Plus I feel as though I am being exploited in my current position due to the economy and my immigration status.

  5. Do we now file for AOS with the I-485 checklist of items?

    We married after knowing eachother 3 years, I am not American, he is. We married inside the US.

    I also wonder since I am on a TN Visa if I were to quit my job or be laid off after filing for AOS what would happen?

    any insight would be great

    Follow the steps by clicking the link below, you have to send both I-485 and I-130, check the guide for more info.

    Once you apply for AOS, you are free to quit your job and you won't be out of status because now instead of being a TN visa holder, your status will be of foreign spouse adjusting status and this status doesn't a work or work offer.

    So should I wait until they send me something back with approval of adjustment of status before I quit my job? I'm tied to this job because of the TN but really want to quit if possible. So not just sending in the papers but I should wait until I hear back correct?

  6. I'm not sure what to do. My TN-1 visa is still valid, however I have been out of the US more than 30 days AND I was layed off. My fiancee and I want to marry, we own a home together in the US. I do have a residence (parents) in Canada, however I want to be with my fiancee. I need to be working as well though. Any suggestions? Is the K1 the best route or ???

  7. I guess what I want to make sure of is if it is ok if we are filing all this paperwork while I am visiting in the US. And if the interviews will be held in the US as well. I just want to make sure we are doing things correctly. :)

    You can file the K1 while visiting the US. You must interview for your visa at the embassy in your home country. Also, while it is possible to visit the US while your visa is pending, please note the guides about this issue. It's always good to have proof of ties to your home country when visiting after the K1 is applied for. The CO can turn you away at the border.

    we were planning to wait until I was visiting in the US before we start filing the papers. We own a home together. I just wonder if it's true that it can take up to 6 months to process if i'm better off waiting in Canada :(
