  1. We never received the EAD approval notice back, my wife has been waiting to find a job. We did get back the advanced parole and just today we got the CF1 acceptance/approval letter (saying her card should be in the mail in the next 3 weeks).

    Does she automatically have the right to work with the green card? Does she have to wait for the actual card or can you use the NOA for this?

    I got a second notice to take biometric/fingerprints again within 1 month.

    Do you know why ?

    Did you get an interview ? what did they say about ?

    We also got a second request saying the FBI could not read them. My wife has dry fingertips and the woman struggled a bit, but you would think with these computer systems it could tell you if it worked or not before they make you waste another half a day and wait 3-4 weeks before you can try again. I hope it works next time.

  3. Thanks for all the replies. I called the VA DMV and they said the 797C (in our case)...may work, aka give it a try. As we were practically tossed out of one DMV by a really rude guy we tried a different DMV. They were friendly and took our paperwork, the ID card should be in the mail, i'll let you know if we actually get it. They also said if my wife passes the written drivers test she can get a learners permit (i forget how long) until she comes back and takes the driving course test.

  4. If you have an AOS pending (IE, the NOA is in hand), your status is considered to be "applicant awaiting status change" or something similar to that. Your protected from ICE.

    Until you get the EAD/GC, most government agencies will not give you any paperwork, since your status is "pending". For example, Ohio only granted a license till the expiration of the I-94, then we had to use the GC to renew it.

    And that was only granted till the expiration of the GC.

    They can only go by your current immigration documents, and if it is expired, or will be expired, they will most likely not allow you to do anything "official"

    Wow, thats insane. Thanks. Now i wonder how long until we get the GC? So for people that can drive, they have to use a foreign license or something until they get their Green card?

  5. I have confusion about status between I-94 expiring and AOS pending...what is your visa status at this point?

    So far we can't seem to get an state issued ID card (not ready for drivers license quite yet). They won't issue the ID because they said the I94 is expiring within 30 days (the SSN office was also hassling us...even though we were waiting for 7 weeks for her card). He mentioned (btw i know it a suprise but the DMV people are still the rudest on the planet) something about the I797, we just got the I797C, but does that really mean anything? Who knows when we'll get the actual acceptance for her permanent residency, could takes months to years, do people really have to wait until then to get their ID/License?

    I don't really understand the visa status when your I-94 expires and before you get the green card...??

    (background, we are married and she arrived on a K1 visa).

    Required documents when applying for a marriage license:

    1. Proof of identity by presenting your driver’s license, passport or state/federal I.D.

    2. Proof of your residency.

    3. Your social security card or social security number.*

    4. A witness, 18 years of age or older.

    5. The $28 application fee.

    *Social security number is required by law for US citizens and will be kept confidential.

    For US Citizens it says...the K1 fiance is not a US Citizen.

    re: waiting 4 to 6 weeks.

    YIKES - this is wrong.

    This tells me the person that dealt with you, is a moron.

    You have to be 'found' in the SAVE database, then if the names match, is immediate approval, with 1 to 7 day turn around. A properly trained clerk with know that, and do that, in real time, with you at the window.

    Suggest you go back, get a supervisor at that office, have him check status of your case (face to face, not use telephone ) .

    Same happened to me...4 week wait..starting a few days ago. Even in the guide on this site it warns you not to go in within 2 weeks after arrival since you may not be in the system. We waited 3 and she was still not in the system :(

  8. Hmm.. I am not sure how Virginia's marriage license rules are but when we applied for our marriage license in MI, I had to use my maiden name because I was not married yet. I didn't need SSN, just passport and birth certificate to show my parents' names. Then the marriage license became my marriage certificate. On my marriage certificate, it does not indicate my new last name change. Just an indication that I married my husband.

    Then I took my marriage certificate and passport and other stuff to apply for my Social Security Card for the first time, 2 months after I entered the US, one week after our wedding. I filled out the form with my new last name, showed them my marriage certificate and that's it.

    As I mentioned above, my marriage license/certificate is in my maiden name. I applied for my AOS with my new married name. The USCIS people are able to figure out the names since you will have to send them a copy of your marriage license. So I believe you can go ahead and do whatever you plan to do.

    Thanks. I believe i'm "over thinking" this after the Virginia office told me I had to get the SSN to have her use my name. Unfortunately we just applied for the SSN in her maiden name thinking we had to get that done first. Now we'll have to wait for that one before we change it.

    I double checked the marriage license paperwork and i don't see anything about using my name other than having to apply for name change with SSN etc.

    I think we just carry on with...getting married, file AOS and then await the SSN and when we get it, go back again to change the name.

  9. Of course it just got worse. So... We applied for the marriage license we told them we were going to use my last name. Today we went to Social Security office, waited 1.5 hours and be processed the papers before telling us she is not in the system so we havE to wait 4 weeks for verification of her paperwork

    It's been about 3 weeks since she got here and she's not in the system.

    Now what do we do?

    Ge married with her maiden name? Does that cause AOS poblems?

    I Asked the Virginia four office and they said the marriagelicense only shows maiden name? I don't undestand what they need to know. Why did they ask if she is taking my last name and tell me about the SSN if their paperwork doesn't care?

    Now I'm really baffled. Is the 90 day visa issue only to get married? We waited 3 weeks if we haveto wait 4 or more to get the SSN then get married then file AOS paperwok I think we are screwed.

I'm from Virginia and in order to change my last name legally, I had to first get my driver's license changed with my new last name, and then had to show that as well as the marriage certificate as proof when going to the SS office. So for you, I would think you need to get the AOS package and Work authorization done (in order to show that to get a driver's license here.. VA is strict on what things can be used), then get a driver's license in VA if she doesn't already have one WITH her new last name, and then visit the SS office.

    This is so complicated. I need the SSN to get the marriage certificate that has her last name changed to my name. I can't submit the AOS package without the marriage certificate (obviously). I would much rather have all the AOS paperwork done with her name already changed.

    She does not even have a drivers license (apart from motorcycle) in her own country much less applied for one here. Does she need to apply for a VA ID card?

  11. K1 fiancee' Visa holders are allowed to get a SSN. We went to the local SSN office after 10-12 days after her arrival and got my fiancee' (now wife!) a SSN with no problems in her maiden name. We filed for a license at the county courthouse and then married after the 3 day waiting period. A few days later we went back to the SSN office and simply did a name change to her new married name. ALL SIMPLE, ALL FREE!

    I am glad we got her a SSN early on. Makes things so much easier. To add her to my bank, filing taxes, getting her state ID etc. People who wait until after AOS have delays and issues doing those things.

    You will need to start your AOS package if you want her to work soon. With this package file a I-765 Work authorization document. My wife just got hers, takes about 50-60 days.

    So just file the AOS package and the Work authorization (which i know is in there) will get processed and could be done prior to the rest of the approval?

  12. My fiance has been here for about 2 weeks. We just filed for our Marriage license in Virginia and in order for her to take my last name (which is what want and i believe is the best process going forward right?) you NEED a social security number.

    So...i guess she has to get the social security card in her maiden name?

    Do we have to go back again later and get that changed to her married name?

    Also, she has her I94 when we entered but in all the chaos of the "enhanced" security we did not ask for authorization for employment, i've read somewhere that the I94 itself might cover that (with a SSN)?

    I've studied the guides and we filled out the forms but the order of what to do when has been confusing...as far as getting work authorization, getting an SSN, getting married, filing AOS packet, .etc has been what i'm not sure about.

  13. I just got the NOA2 form in the mail and it says it is valid from 6/30 to 10/30. I just wanted to confirm this has nothing to do with how the dates of the actual visa (assuming we get that) and when she has to enter the US by, correct? From what i've read that is supposed to be 6 months from the date the visa is issued??

    My fiance's sister is getting married now later in the year (it was supposed to be soon) and may wait until then to enter the US.

  14. I've been staying with my fiance and her family for the past 5 months, in that case what am i supposed to show as proof of "ongoing relationship"? We have no phone records, no emails and no letters :|

    We did travel twice and i have flight/hotel information...and of course pictures.

    Is this trick question morning?

    You LIVE with your fiancee and have to ask how to prove it?

    I live with her family, i have nothing stating the fact that i live here with mine and her name on it (like a lease or anything), thanks for the constructive responses from other members, a family letter is a good idea.
