  1. Hello My wife came into the country in May on the CR1. She waited for a while but we didnt get the green card, so she left for dubai to wrap everything up before coming back next month for good. I dont want to mail her the green card. Will she have any problem reentering the country without the green card? she has her SSN card on her. Any help will be much appreciated.

  2. He is studying in a univ in the states (he is here via student visa). My mother got a GC through me ( i sponsored her as i am an american citizen). We were told that once we submit the affidavit of support, his interview will come at the embassy, BUT since he is here, we would rather just do a adjustment of status...Let me know if you have any other questions.

    You didn't give enough information to know what the situation is. How is he legally in the US going to school? How did mother get a green card? If you mother came on a K1/K3 visa, then her child could be included and receive a K2/K4 visa and "follow to join" at a later time and would interview at the embassey. But since he's already in the US, a K visa that only lets you in the door doesn't sound right. He's already in the door.

    Some family members are admitted on a quota system. You have to wait until an immigrant visa number comes up for his category/country. It's like getting in line and waiting to get to the front. It can take years.

    Overview of Immigration Process

    A legal immigrant (or lawful permanent resident) is a foreign national who has been granted the privilege of living and working permanently in the United States. There is a three-step process for your child or son or daughter to become a legal immigrant.

    1. You must obtain USCIS approval of an immigrant visa petition that you file for your child, son or daughter.

    2. The State Department must then give your son or daughter an immigrant visa number, even if he or she is already in the United States. If you are a U.S. citizen and the child is both under 21 years of age and unmarried, a visa number is not required.

    3. If your child or son or daughter is outside the United States, he or she will be notified to go to the local U.S. consulate to complete the processing for an immigrant visa when one becomes available. If your child or son or daughter is legally in the U.S. when an immigrant visa number becomes available (or if one is not required), he or she may apply to adjust status to that of a lawful permanent resident using the Form I-485.

  3. Hello,

    My brother was sponsored by my mother when she got her GC. He is still under 21 (one month to go) and his case reached the embassy (The people at the embassy (they said that his age is now frozen and we have a yr to send the packet). He is also in the states – he is going to college. My mother is thinking of getting the case back to America and then just doing an Adjustment of Status. Is that possible? Usually how long would it take for the AOS to be completed? If he wanted to go out of the country for a few weeks or a month, would that be possible? I am new to AOS and I would appreciate any help provided.

    My son is turning 21 in June. I am a LPR. I was told today that the file was sent on May 5th to the embassy. Now if he turns 21, will the file be sent back to NVC and put in the other bucket? Also, if the interview happens before his b'day and they put him on AP, will that mean that once he turns 21, he will be put in the other section?

    I am totally confused and need help urgently.

    My wife has finally made it to America. Thank God for that.. It took a while before this day came along. The POE experience was good. She wasnt asked any unusual questions, but when i saw the visa, it stated CR 1 rather then IR 1. We have been married for 2 yrs (in March), and the visa was approved about 3 weeks after our 2 Yr anniv, so i dont understand why we have a conditional status? They gave a notice saying that in 2 yrs we need to file to remove the conditional status. What is the criteria for being in CR 1 and IR1?

    I am confused.

  6. so my wife went on Thursday. Reached the embassy at 1:30...was out by 2:30 with the VISA.....oh my God!!! After a year of this crappy process,it is finally over.. Thanks a lot to everyone on VJ. I wouldnt have gotten through this without all the advice and support.

    Then we bought her ticket and out of all the airlines, we chose AIR FRANCE....So we all know what happened with the whole Ashes and airport closures. So the utter happiness plummeted pretty fast. Her flight got cancelled but some good persistent hounding of the airport officials and she got put on a direct flight from dubai to Usa. I should be seeing her in the next 12 hrs. I will update you guys with her POE experience.

    So my wife submitted her passport on sunday. They gave her a slip stating to come pick it up on Thursday (which is tomorrow). I feel we are soo close now. I just hope we get the visa tomorrow and we are done with this super LONG process. I see a lot of you guys are getting updates, so hopefully soon enough, you will be getting the visa's issued. I will keep you guys updated. Just wanted to share my nervousness :)

    Thanks for your response. We applied for the CR 1 and its been 2 yrs since we have been married, so we dont need to remove any conditions. Usually the green card is mailed in a few weeks, but if she leaves before that, once i get the Green card in the mail. She can come in using that, correct? How long is th Temp visa valid for?

    Finally (fingers crossed), tomorrow my wife should get her visa (they have her passport and have called her tomorrow to collect it). Once she gets the visa, i am hoping that she will get here on saturday. Now i am confused as to what to do next?

    Once she comes here, she goes through customs etc and enters the country. Do we have to file for anything else, (not talking about ssn etc)once she is done with customs? Also, she might have to go to london for a few weeks. Does she have any restrictions traveling going forward?

    I would appreciate any help provided.

    We are pleased to inform you that processing of your application for immigration to the United States has reached the point where we request that you submit your passport(s) to prepare for visa issuance. You or another trusted person may bring your passports to the Embassy in *** any Sunday at 10 a.m., excluding holidays. In most cases, the visa will be ready for pick-up on the following Thursday at 2 p.m. Embassy staff will provide further details when you drop off your passport(s).

    Does this mean, she just has to submit the passport? What is the next step? I hope there is no more AP.
