  1. Hi guys would really appreciate some advice on my situation:

    I just got a RFE in the mail regarding my wife's income evidence not being sufficient to prove we reach the poverty line for a 2 person household. As she is a recently graduated full time student we don't have an easily accessable paper trail of tax documentation but she does earn enough to support me. Instead of trying to pull together recent bank statements and such, would it possible to ask my mother and father from overseas to co-sponser me financially and submit evidence of their assets and a letter of agreement? Does this count as evidence in regards to application or will it be disregarded entirely?

    Please advise!

    If i remember correctly, the sponsor needs be a USC or LPR

    My wife is a USC but my parents are British: is it not possible to have a foreign co-sponsor if the other is an American?

  3. I married my wife in early February 2009. She was here on a tourist visa so we filed the I-130 and I-485 concurrently. The NOA was dated around the 26th of Feb or so. She had her biometrics appointment in NJ on the 24th of March. It's now April 13th and still no updates on the USCIS website for either of our case numbers (the I-130 or I-485).

    So my question is, what kinds of delays are people seeing these days? I read that often there are no updates until after you complete the biometrics, but that was 3 weeks ago and still nothing.

    If anyone is on roughly the same schedule I'd appreciate your comments.

    I'm in exactly the same timeline as you: except it was me on the tourist visa when I married my wife. We also have had no updates on the tracking website ('case not found') but my I-485 has been changed to 'request for additional information sent' today. My biometrics was done a month and a half ago and that's all the correspondence I've had since. It's no fun waiting I know.

  4. My online case tracking for my I-485 application has been changed to: 'request for additional information sent'. It's not yet arrived in the mail. Is this to do with my wife having filed her taxes now? It's got me really worried as I now they can take another 90 days to approve my EAD can't they? In our relationship I don't want to have her worry about paying rent and supporting me while this application is on-going. I seriously don't know if I can manage to be jobless for another 90 days.

    Any advice?

  5. My biometrics were done on Feb 28th and I'm awaiting further correspondence anxiously. I'm really concerned as neither my EAD; I-485 or I-130 applications show up online- it just comes up with 'your application cannot traced at this time...' message for all three.

    The numbers all begin with 'MSC'.

    Is this unusual? I know that the tracking system is flawed.

    (The individual who did my biometrics was thoroughly unprofessional and alarmingly aggressive with literally no provocation whatsoever and I'm worried he may have messed up part of my application process.)

    Just had my biometrics taken a week ago. I had a look at the case tracking system and it doesn't have my number (not the I-130 or I-485) on it: both the phoneline and the website. I notice my number has 'MSC' before it so it pretty much prevents me from dialling it in on my phone.

    Should I be worried about this? And how long after my biometrics should I expect some kind of notice?

    I've mailed my I-485 (also with EAD) and I-130 forms and am awaiting response. My concern is that I won't be able to work for a very long time whilst waiting for approval: I'm not entirely sure how I get the okay to seek employment.

    I'm married to a US citizen and entered on a visitor visa waiver (my intention on entry was NOT to marry).

    Anyone shed some light on working whilst the applications are being processed?

  8. Filing I-130 tomorrow with the I-485 after as soon as I have all my documentation ready. I'm confused about the medical exam however: does that need to be included with the I-485 application?

    Also if I am to get a medical examination what should I be asking for at the doctor's office? A blood test? General check-up?

    If anyone knows of a doctor who they went to in New York City for this I'd appreciate the recommendation.

  9. Hello all, would really appreciate some advice on my position:

    I fell in love with an American girl while overseas studying. That was 2 year ago and we have been in a long-distance relationship since: seeing each other when possible.

    I am currently in the US on a visa waiver- being as I am a British national. We have married in the state of New York and I wish to remain here permanently.

    As I did not enter on the on a K-1 or K-3 visa I am unsure of the method of applying for both adjustment of status and a green-card? I have looked over a lot of information but would appreciate someone making it plainer to me.

    My concern is overstaying my visa waiver (a maximum of 90 days of which I have already spent 30): what is the best way to stay with my wife and not commit any damaging illegalities? Is it worth hiring an atorney to help speed the process?

    Please advise!
