  1. Hi Cino, I've been MIA for a while...please update my status. We were approved on May 28, I've received my welcome letter and my GC is on its way. Here are details of our interview in Irving, TX on May 28, 2009.

    Our interview was scheduled for 7:30am we arrived at 7:10am, checked in and we were given a buzzer that would go off when it was our turn. We waited for over an hour and finally it was our turn. The officer was and old guy and he didn't seem too friendly at first but later he opened up and laughed with us.

    He asked for my passport and and drivers licence(my husband is the USC) and he asked for only my husbands license. He went through my passport and commented that I was still legal. Then he confirmed everything on my application such as date of birth and my parents names. Then he asked if we live together and I said not completely because my job allows me to work on rotation 2wks on and 1wk off.So I go home during my days off. He seemed a bit put off but he understood. Then he asked for leases, joint accounts etc and then he said he would approve us! He told us that I could get a stamp on my passport so I can travel before I receive my gc in the mail! And we went to get the stamp! that was it!!! :dance:

  2. Welcome to the board.. I am in a similar situation but I can totally empathize with you. I didnt get my Biometrics appointment because my case lay forgotten on some incompetent clerk's desk. I made an infopass appointment on 3/30 to ask them what happened to my biometrics appointment, and I was told by the USCIS officer quite rudely to ".... wait your turn... these things take time and no where does it say that we have to process your paperwork within a certain time frame...". Three days later I got my biometrics appointment for 4/28 (Notice dated 3/30... coincidence, no?). So I am still waiting for my biometrics appointment and the wait is getting extremely frustrating. oh, and my case still does not show up online...

    I have read on other posts about people that went in early for their biometrics. You should probably give it a try since you got a little set back. :thumbs:

  3. Hello, I am currently on a F-1 visa (OPT), filing my I-485, I-130, 1-765 and I-131 all together.

    I read the checklist, and have a couple of questions...

    1. Would it be ok to file I-485, I-765 and I-131 together with one ACCO fastener? Or should I make a separate package for I-765? I thought I should prepare two packages (one for I-130, the other one for I-485, I-765 and I-131) using two ACCO fasteners, but I saw some people filed three packages.

    2. As my husband (US citizen) was a student until summer 2007, his income exceeded the poverty line for the first time last year. I see many people sending tax returns, W-2s, 1099s for the past 3 years, but in our case, I am not sure if we should send his 2006 and 2007 tax returns because he didn't make enough income back then. Would it better to send them anyway?

    3. Should I make a copy of all my I-20s (I have three I-20s issued by the same school), all visas I had (I used to have J-1) and all entry stamps on my passport? I am wondering if the latest one is enough.

    I am currently filing my I-485, I-130, 1-765 and I-131 all together. I have just one question.

    I am a F-1 student currently on OPT, so I have already received an EAD card before. On the I-765, do I say I am applying for a renewal EAD because I already have one or do I say I am filing for an intial EAD since this EAD will be based on my AOS?

    Initial... because you are applying for a new EAD based on "new" type of category

    That is very correct because its in a different category from your OPT card. Don't forget to include copies of your I-20 Goodluck! :dance:

    I probably won't be having an interview. Seems most of use who get the cases transfered don't have to suffer through the interview. I would imagine the next thing for me is my Permanent Resident Card in a couple months. I'm not so concerned as long as I have my EAD and can work. (I start working 8am on Monday morning) :D

  7. I still have not got my biometrics appointment :( I am super worried right now. Should I make an infopass appointment or wait some more?

    i'm not sure what you should do about that... have you tried calling your local cis office? maybe they can tell you if they sent it out and it got lost in the mail or if there is another problem?

    can someone who has had a bio appointment already tell me how long it took? thanks. :)

    It took a week after I received my NOA's to get the appointment letter.

  8. From what I have read, you can include a copy of your tax return that you filed with the IRS, (this is a photocopy). If you do this they also want copies of your W2 from employer(s) and copies of any form 1099.

    Your other option is to get a tax transcript from the IRS for the most recent tax return year or for the last 3 most recent tax years to be more thorough. If you get a tax transcript then the I-864 instructions state you do not need to include copies of W2 and 1099 forms.

    All of this info is contained in the I-864, that can be downloaded from the uscis website.

    Getting a tax transcript is pretty easy and takes about two weeks or so. Just go the the IRS website and search ordering a tax transcript form 4506-T. To make the process as fast possible, you can fax your transcript request to the IRS, and you will get a transcript in two weeks or so. It may take longer now, since its tax season.

  9. My Husband is a USC, he was born in the US but he moved back to nigeria with his parents when he was 5. He recently moved back to the states in 2006. Now, the I-864 wants him to attach an IRS transcript for the most recent tax year and attach w-2's for the last 3yrs but he has only filed taxes for 2006 and 2007. How can we go about doing this?

    Below is the excerpt from I-864 instruction:

    If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support. If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation. If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it. Residence outside of the United States does not exempt U.S. citizens or lawful permanent residents from filing a U.S. Federal income tax return. See "Filing Requirements" in the IRS Form 1040 Filing Instructions to determine whether you were required to file.

    So, the answer to your question depends on whether your husband had any worldwide income in 2005 (including Nigeria). If the reason he did not file 2005 tax return was because he did not have income, then he should attach a written explanation on that effect. If he DID have enough income, but did not file the 2005 federal tax return, he needs to file 2005 tax return before submitting I-864.

    If your husband paid tax in Nigeria, his income might be eligible for "Foreign Earned Income Exclusion" (http://www.irs.gov/businesses/article/0,,id=182017,00.html). Even in such a case he needs to file the tax return to claim this exclusion.

  10. If you're sending your application b4 end of 2008 then he only has to focus on tax returns for 2007...they want to see the "last Years " taxes but, sending the past 3 yrs is helpful (not NECESSARY)...

    Yeah but there's a part of the form #25 where it asks you to check a box that says "I have filed a Federal tax return for each of the three most recent tax years. I haveattached the required photocopy or transcript of my Federal tax return for only the most recent tax year" and then it asks to put in the years and the corresponding income.

  12. Hi guys, I'm currently on F-1 and about to start filling out forms. I noticed on the step-by-step guide on visajourney they said to include the i-693. Doesn't USCIS schedule you for that? or do you do it on your own before sending in the forms?

    Also on the I-765 what category do we fall under changing from f-1 and what box do I check on the top part for

    I am applying for: Permission to accept employment

    Replacement (of lost employment authorization document)

    Renewal of my permission to accept employment (attach previous employment authorization document).
