  1. My husband has just entered the U.S. with his K-3 visa and we are on to the next step... adjustment of status. I am unsure about a question on the I-485.

    It is in Part 2 of the application and asks:

    I am applying for an adjustment to permanent status because:

    ... I am unsure how to answer, if it is answer...

    a.) An immigrant petition giving me an immediately available immigrant visa number that has been approved. Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)

    ...or if the answer should be...

    h.) Other basis of eligibility.

    As I stated before, he has come here with a K-3 visa and I do not know if the filing of that and attaching the approval for his I-129f would give him immediate availability of an immigrant visa number if he is approved for adjustment of status or not. Therefore, I am unsure how to answer. Would someone please assist me in this matter. I am also wondering what kind of medical exam is required for the I-485 since he just had one with the K-3. I believe he only needs a vaccination supplement, but want to make sure. Thank you so much for your time.

  2. My husband and I are wondering what we will need to do if his K-3 visa is refused. He has had his interviews and we are waiting for them to contact us with an answer, but want to be prepared in case the worst happens. I have tried searching online, but since I don't know the actual "name" of the paper we will need to file for an appeal, I am unable to find anything. I don't know how long we have to wait to re-file, papers needed, costs or anything. How long does the appeal process take. Is it general for all or does it vary by country? Can someone please help us so we can try and be prepared. Thank you.

  3. My husband had his first interview on April 2nd, at which time they kept our correspondence and photos. The consulate did not get back to him until April 21st. They asked him to return for a second interview. I flew there to be with him and to go to his second interview which was on April 27th. They also interviewed me at this time. After the interview, she said that we could go and that they would contact us at a later time. My husband asked if they were refusing us at this time, she said no. He asked if she could tell us when they would contact us and she said no. The only thing she would say was that we were still under review. We are STILL waiting for them to contact us with an answer 15 days later. Can anyone help us and let us know if they have any experience with this sort of thing and what we might expect? As you can understand, we are "on the edge of our seats" awaiting our verdict. :wacko:

    What kind of question did they asked you? I heard that they normally don't allow the foreign spouse to attend. Did he have to go across the street at the cafe to come and get you or did they request for you to be in the interview when they scheduled your husbands second interview?

    No, they would not let me enter with him at first. He told her that I had made a special trip to be there for his interview and was waiting outside. She interviewed him and then asked him to bring me in as well. She asked me the basic questions that she had asked him before about our relationship.

    I had my interview in april 2,2009 .. they gave me a paper that said we regret to inform you that this office is unable to issue you a visa because you have been found ineligible for the following reason...(other)we will review the correspondence you have provided and contact you again. What does this mean?! They said they would contact me in about one week. but now it s two weeks and I still don t hear anything from them .. so what I need to do ?

    Sorry to hear this. Look like AP, wait till they contact you, gather more info about relationship etc.

  13. Doesnt sound like a denial at all.

    Agreed with the others, it looks like they just want more time to review the proof you provided. Use this time to prepare more proof if you have it, just in case. If you have more communication proof, get it.

    I would also follow up with an email in a week to ask if there is anything in particular that they wish to see.

    You may want to post in the MENA forum if you already havent. There are alot of people with experience going through Morocco and may know if this is standard or not.

  15. I am in the same boat. My I-129F for K3 was approved, then VSC send the petition to NVC. The Case # was generated but when I call the NVC AVR, it says there is no record of the case number. Thats pretty weird.

    Anyone has a clue on what is going on?

    his happened to another vj'er, but the other way around..the 129f is at nvc, but the 130 is MIA

    to the op,

    we got a letter(well, actually 4) within a week and a half that our case was received at nvc and being sent to the embassy(it hasnt been yet) so, i guess it does depend on the workload and date it arrived, some say a week other a month

    we got an approval in janury 21, 2009 . On site they ask to call NVC after 2 weeks to know about if they recieve the I 129F... My question is how longer it take for the NVC to recieve the paper ? my wife she call evryday to know from them but always the some answer ! they don t recieve .. I have seen people that the NVC receive the paper with in less 3 days !!!! Can someone give me advice what can I do .Thanks

    It all depends on their workload. For my husband's case it took CSC a month to send papers to NVC. I myself have seen people's file transferred to NVC within days. I know it is frustrating but it gets faster at NVC. they are quick and accessible. good luck

  18. We just got the news in the mail today that both of our papers are approved. For some reason it has not been updated on the site and we have not received the email that we optioned for, but that does not matter now... WE ARE APPROVED! Now we will just wait our package and interview. Good luck to everyone else who is waiting and most likely you will not wait as long as we have... 10 months... so be happy :whistle: B) :thumbs:
