My husband (U.S citizen) recently filed the I-130 petition for me and we´ll be applying for the I-129 (K3 spousal visa) once we receive the NOA1.
The only issue is that I overstayed my I-94, in that case my K3 Visa could be denied and we´ll have to file for a "hardship waiver"... (I´m currently overseas btw)
From experience in other cases or in your own case, Can someone please give us advice on what are the factors that would qualify as hardship?
I know that by simply just missing your wife is not the answer they are looking for...
My husband is in the military, he just came back from a 7month deployment a few weeks ago... (maybe that would be the first one?)
