  1. Hi,

    My girlfriend came here to the U.S. in January of this year to visit me. She traveled on a tourist visa. We decided we didn't want to continue flying back and forth visiting each other in Mexico City and St. Louis, and so we got married in here in St. Louis in April.

    My wife's Visitor's Visa expires the beginning of July. A couple of months ago, I filed everything with immigration, i.e., petition for alien relative, affidavit of support, biographical data, etc. I checked my online banking account this past weekend, and saw that the check was cashed last week.

    Does the fact that the government cashed the check mean that my wife can stay here in the U.S. beyond the expiration of her visa? Or do I need to file for an extension on her visa?

    If I need to file for an extension, please tell me which form I must file.

    Thank you so much! I had a feeling that perhaps I was reading a section of the instructions not-applicable to my wife. Thanks for your very helpful and detailed response. We both appreciate your taking time to explain this to us.

    Ok - you are reading the part of the instructions that apply to individuals who have overstayed their status in the US for more than 180 days.

  3. If my immigrant wife travels on a I-131 to visit her mother while her Adjustment of Status is still pending, does she have to file a "Waiver of Inadmissability" to continue the Adjustment process?

    I was just reading the instructions on the I-131 and it said: "Therefore if you resume an adjustment application that was pending before you left, you will need to apply for and receive a waiver of inadmissability before your adjustment application may be approved or your status continued."

    Does this mean that if my wife is away for 6 weeks, our entire application is put "on hold" for those six weeks?

    We were intending to send the I-131 along with her Adjustment of Status application, but we're worried that this might not be a good idea. :girlwerewolf2xn: Because maybe they will not even consider the Adjustment of Status if they see that she wants to travel.

    Please give us your thoughts and ideas on the I-131, the waiver of inadmissability, and the wisdom of sending all of these forms together? :unsure:

  5. Please forgive me if I am posting this in the wrong forum. I am trying my best to figure out how and where to post my questions. Please bear with me.

    I am struggling to fill out the Affidavit of Support. I do not earn enough money to meet the financial requirements. :blush: Therefore, my best friend said that he would be a co-sponsor. :dancing:

    What is the form the Co-Sponsor fills out? Is it the I-864A? Or is it another form? I looked at the I-864A and there are only check boxes for household members and other dependents. I've spoken to individuals who I believe are knowledgeable in this area, and they told me that anyone can be a sponsor . . . yet I cannot figure out which form this individual needs to fill out. :help:

    I sincerely appreciate any help or guidance you can provide me in this regard.

  6. I sponsored my ex-wife and her daughter (from another relationship) to immigrate to the United States. We divorced 3 years ago. I have met a lovely woman from Mexico and wish to marry her. However, I do not meet the limit for minimum income for the Affidavit of Support, since I now must factor in that I sponsored two other persons into the United States.

    My ex-wife and step-daughter are now U.S. Citizens. Someone on Yahoo Answers told me that I my financial responsibility (with regard to the Affadavit of Support) ended when they became U.S. Citizens. This person also told me I must obtain and sign a "Waiver".

    Please if you know about this "waiver", tell me where and how to obtain it, and to whom do I send it to?
