  1. My fiancee would like to have her father and brother bring down her household goods when they come down for the wedding. We are still trying to decide whether or not to use a moving company or ask her family to help. What would her father and brother need to rent a truck and move her stuff for her? We Need Help deciding... lol

  2. I went thru the Vancouver Consulate to bring my daughter to the U.S. to live (she was a K-2, followed-to-join me). I needed a letter from my daughter's Dad giving his permission for her to come to the U.S. to live with me. But that was because her Dad and I had "joint" custody.

If you have "sole" custody, the letter is not necessary. You will need to provide the documents at your child's interview that states that you have sole custody, though.

    A few questions:

    1. Is proof of sole custody always sufficient for the child of a fincee to get the K-2 visa?

    2. If proof of sole cusody is presented, do they ever require an additional statement from the other parent for permission to immigrate to the US?

    3. Is it always the case that permission or sole custody is required? (In other words...do they ever grant the K-2 without any custody or permission documentation? I have looked at the US Immigration site and have a difficult time finding anything on what is required regarding child custody and/or parental permission. Specifically, I'm wondering if the requirements may be less in Manila or Australia versus other locations? In theory...seems like it should be the same everywhere, but I do hear stories of different Embassies processing the same identical issue differently.

I will send you a PM to tell you this in case you don't get back to reading this post. It's an old post, and I'm not sure that people will see your new question. Best to post a new thread, and perhaps identifying the country? I have also heard of different procedures about this issue from different countries Embassies or Consulates.

I think I joined a little to late. My fiancee has an ex that is not around and it looks like we need to get a consent letter. She is sending a certified letter to him that she is moving to his dad's place which is the last know address and another one to his dad. She has Final custody in the wording. I am the USC and have found out that is what sole custody but I could be wrong. Does anyone have the wording that is needed on the consent form? Kinda in a bad spot right now. Any help is greatly appreciated.

  3. I was headed to court cause my ex didn't want to sign a consent letter.

Its kinda like mediations now since Jan 2008 thats when the law change with custody and stuff, at least that what my lawyer told me. Anyways you need to to turn in alot of papers concerning your move if you have a Job lined up its a bonus the Judges like to see that. Again just stuff my lawyer told me.

You also dig up all the dirt you can on your ex everything from the last phone call/visit to what they do to support themself to in my case my ex did'nt once call the kids saw them only at christmas only cause his mom made him and we lived in the same town, no child support cause he makes less the 5k a year so even if i wanted too i could'nt go after him for it.

Anyways this all gets done up you put together 3 packages and one the court files after you serve the ex his copy so he can put in his say. They book a 2 dates to meet with the Judge, if the judge needs more time you go to the second meeting if not your done in one meeting.

I got lucky after my ex got served he called me to sign the consent, my lawyer wrote one up for me to have in case he would sign. I had it witness by 2 ppl then took it back to my lawyer who then that day had a judge sign off on it so I then got a court order. My laywer didn't trust my ex or the ppl at the border with just a consent letter.

Thats my experience anyways since you can't just make simple ammenments anymore from what i'm told anyways.

  4. They cashed your check so they have your money... I am sure you are fine... You may want to print out a copy of the cashed check...

Uhh I have no idea why I would have done this, but I made my check out to USCIS (not abbreviated). But I just realized on the instructions it says to make it out to Homeland Security or something. However, they DID cash my check. Does this mean it is ok, or am I going to get an RFE or something??
  5. The VJ US Embassy / Consulate Info says that we need to fill out the DS 156 form... The Info pack said we need to fill out the DS 160 online. The Consulate web site also said they were implementing the DS 160 online. Just wanted to make sure it was the DS 160 online form to fill out before I chaged the info on VJ. Also they sent the following Checklist, DS-230, DS-156K, I-134 and instructions.. I just want to make sure what to send back. I know the checklist needs to be sent back but what else?

  6. If I have 2006 and 2007 Tax returns will this be enough?

Since the deadline to file taxes is April 15th, you can show your 2007 tax transcripts or tax returns with corresponding W2s along with the I-134. If it's after the 15th, you need to either include these documents for 2008 or a copy of the extension you get from the IRS to file taxes at a later time during the year.

  7. Hello All,

We have submitted our I-129 and we have received our NOA1. Since we are waiting on our NOA2 should we work on our Packet 3 information to send back to the consulate? If so what will be in the Packet 3? Also my fiancée lives in Toronto and we were wondering what consulate she would be going to?
