  1. My marriage is pretty much over. We got married almost 5 years ago. We have a19 month old.

    Unfortunately my husband became verbally abusive shortly after my son was born, and its just getting worse. he is getting verbally abusive not only towards me but son too. He has never get physically abusive, However I don't want my son to grew up in an environment like that.

    Over the weekend, we had an argument and I ask him to go to his mom house for a few days and he refused, so I said I was going to leave with our 19 month old( who I still nurse and wakes up several times at night). He got all upset and threatened me with calling USCIS and said that our marriage was fraud and do anything in his power to have USCIS revoke my citizenship( I became an US Citizen on April) so I can get deported back to Mexico and he will have full custody of our son, If I dared to leave or file for divorce.

    I told him "Good Luck with that, I know I didn't commit any immigration fraud, I married you because I was in love with you". then he proceeded to threatened with calling USCIS and report my parents. My parents are currently out of status. I petitioned my mom back in June, and He signed the affidavit of support for her as Head of Household. We are waiting for an interview, so my moms faith will be decided soon regardless of his treats to call immigration on her. I will be filing for divorce so I was wondering if he actually call USCIS how this will affect my moms petition, since he signed the affidavit.. He knew since the first day we met that I was out status as well as my parents were. I never hid that from him. I didn't force him to sign anything, he even volunteered to sign the affidavit for my mom.

    He openly said that he is willing to lie or do anything to take my son away from me. so I know if will be a nasty divorce and custody battle, he refuses to go the marriage counseling and anger management classes/program.

    I'm not the perfect wife by any means but he keeps rubbing in my face that he is the bread winner so I should shut up and do what he says. Nothing I do is enough. if I have the house spotless he thinks he should not at least recognize it because that what I should do, its my job since I stay home with our son. I was working full time unfortunately I couldn't bring my son with me to the school I was working at, so I looked for another school and he would have to pick him up and he refused because all my income would have been use to paid for my sons other school, and he didn't want to waste an hour of his time driving to pick up my son. The whole time I worked I was the one paying the sitter. He was upset because most of my income was toward the sitter.. In my last effort to save my marriage I quit my job.It was the worse decision, now he treats me like he can control me and I have no saying just because he is the only one bring in income.. He also doesn't want me to teach/talk in Spanish to my son just to mention a few things that changed since I stopped working.

    I was in denial and waiting for him to change since his dad passed away in August and I thought he was just depressed but I just don't see any hope for change at all. Its just getting worse.

    The delivery will be covered as Emergency Medicaid... At least in Texas will be! You will have to apply got CHIP Perinatal to cover the last weeks of her pregnancy care, or when she deliveres social workers will help her apply for Emergency Medicaid, she will not be eligible for Medicaid, and nothing but the delivery will be covered, your son will receive Medicaid for the first year and then CHIP or Medicaid or nothing depending in your income... If I were you I will have her deliver here than in Mexico!!! Good Luck with whatever choice you guys make!

Something else that just came to my mind, is that when we had a interview with the lawyer that is handling my mom's AOS with a overstayed visa, was that he asked if when we applied for the B2 visa back in 2001, if we had any relative living in the US back then, and we lied or not about it... He said that if you have immiediate relatives living in the US chances of getting a B2 visa are really low to none, since USCIS doesnt want you to immigrate with a non immigrate visa..., and hiding/lying about are grounds for inadmisibility and triggers pretty much lifetime ban, since and there is no waiver that sons can file for parents. And only spouses of US citizens can file for a waiver based on hardship to the US Citizen which in this case I don't think will work since they are not already married.. I'm not saying the OP mom lied or anything, but there is so many aspects to consider and thinking of the worst case scenario.. I have learn that not everything is as easy as in seems when it comes down to USCIS.. Probably the safest route would be to apply for your mom in her country to avoid any possible denials

  4. Correct me if I'm wrong but isn't there a possibility that USCIS can denied her mom AOS based on intent to immigrate/immigration fraud? Or at least make give them a headache? The OP posted that her mom I-94 expires on Dec,25,2012, which means that her mom should have entered the contry just a week ago, and she is already talking about filing for AOS, and her mom gettin marry this week.. I'm not immgration expert at all, but when I applied for AOS our lawyer asked us the time frame period between my entry, my marriage, and AOS.. to rule out immigration fraud base on intent to marriage with a non immigrating visa...

    Passport Application update!

    So, I applied for my US after my passport yesterday afternoon after my oath (in the morning). I scheduled for a 2pm appointment at the Dallas Passport Agency located downtown Dallas, at Earle Cabell Federal Building. I got there at about 2.05pm give or take, checked-in at the appointment window then I was given a number and asked to sit down until it is called. I had my application filled out online then just printed it out. By the way, I took my passport photos at CVS (instant photos took me like 5 minutes) where I was charged like $8 coz for signing up for a CVS discount card! I was like sweet! The cost is normally $10

    I had my letter from my employer stating that I needed my passport ASAP for work and also a copy of my international travel dates for this weekend for work as well. I had my original CoN and driver's license and copies of each. I was called to another window where the lady went through my paperwork and asked me when I would be traveling and I said this weekend and that took her by surprise! Hehe… Anyways, she told me to come pick it up tomorrow (which is today) and so I did! :dance:

    To sum it all, I got my passport in less than 24hrs and I didn't have to part with my CoN :D so that was good. It all cost me a total of $195 ($135+$60 expedite fee) cr

    So now I am officially done with USCIS/passport journey as far as I am concerned! :D:dance:

    So jealous!!! Lol. I don't have any trips scheduled anytime soon. My passport appoiment is next month then I have to wait 4-6 weeks:(... Congrats!!!!

    Your mom has accrued more than one year of unlawful presence. This make her inadmissible. Her adjustment will be denied. There is zero chance of approval since she has been unlawfully present in the US since 2003.

    There is no waiver that you can file for her after the denial. A parent is not an Immediate Relative that you can file a waiver for. (The spouse of a US citizen does qualify for a waiver, so that is how you ended up with a green card.)

    Once your mother decided to violate US immigration laws, she cannot expect the same benefits as a person who does not break the law.

    Are you talking about the I-601 waiver??

    We never filed for it in my case,(unless there is another unspoken/automatic waiver. No that's not how I ended up with a green card)... I never had to leave the country and then re-entry during my AOS.

    I read somewhere that as long she didnt enter the country illegally and had a qualifying relative I could apply for her without any problem..but I'm not a immigration expert..

    I'm not expecting she gets the same treatment as someone who hasn't overstayed... if there is a possibility that she can adjust great, if not, well its what it is....

  7. I want to petition my mom. However, I didn't work last year or in 2010. I was pregnant and then I stayed home with my infant son. So I have no income at all, my husband and i have filed taxes " married jointly", now the other thing is that my mom has overstayed since 2003, she will be adjusting her "out of status" status..

    what are the odds that she will be approved?

  8. I called to make an appointment to apply for my passport and the next available date in my local post office is June 29th!! Grr.. I called the one day office and I need to bring a copy of my airplane tickets showing that I'm really traveling within 2 weeks.. Sigh! I'm just hoping I don't need to go out of the country within the next 2 months... I had not idea it took so long :( to get a passport.

  9. Changing the colour of my name!

    Ceremony was nice and not overly long. Spent time waiting in the wrong line, since the IO who stapled my GC to my letter wrote the wrong table number on it. :bonk: Still, it was only the line next to me, so they let me go next when the person at the other line was finished which was nice. I thought I was going to have to go to the back of the line again.

    After I got my Naturalization certificate, I took a picture, signed it and kissed it goodbye after waiting half an hour in a line to apply for my passport. So while I am FINALLY finished with my Visa Journey :dance:, I am still waiting :rofl:. I guess that is just the story of my life.

    Congratulations to everyone who has had interviews today. For those who are waiting for interviews, I hope that you get your letter very soon in the mail. So nice to be over and done with.

    So glad you applied for your passport... I need to do that soon... I felt like I'm trap since I cant leave the country without a passport now... lol

  10. he started to ask me...the simplest one....state your complete name....then i stated my name and before i finish stating my name middle name he told me that thats not my name and have to do all over again....so he repeated the question..what is your complete name? and I said the same thing..and like the first one i havent done saying my middle name and he said its not my name...and i was like well… in my head....im pretty sure i know my name and thats my name....lol....so he asked me whats my name when i was still single...so i stated that and he said thats correct and then asked me again of that stupid complete name...and of course i said my name whatever im using now..and still told me wrong..i thought he will send me out and deny my application...so i said...thats the name i use since i got married and in all of my application in USCIS or any government office and work..so how come its not my name? and he said unless i have a court document that i change my name to that thats the only time he will accept that....then i told him i use the philippine code for married name... thats why it was that way...he said...were you married in the philippines? i said no..and he said then the philippine code is not valid..and then told me to state my complete name....lol....so i have to say it whatever US code nameing is and he noticed that it was a little hard for me to say it right and i apologized and told him that im not use to saying it coz its not my name and its not what i use...he said its okay because almost all women he interviewed from the philippines had the same issue...

    to clarify the Philippine name code:

    maiden name: anna nicole smith

    hubby name: charles andrew wales

    my married name now will be: anna smith wales

    my last name before will become my middle name and my hubbys last name will be my last name….so that's what im using from the start….and he said that the USCIS shouldn't accepted that from the start because its wrong…and even told me that USCIS don't care….wait a minute..is he not from the USCIS? Lol..oh well… so we proceed with the interview…

    I'm in the same situation as you are regarding married name... My maiden last name is now my middle name and my husband last name is my last name... when I started to apply for AOS my lawyer told us it was ok to use it... I never went to a court or anything... never any IO told me it wasn't legal or unacceptable for USCIS or to use it for any other ID... Every single ID, SS card has my name, middle(maiden last name)name, last name... The marriage license was enough.. When my IO asked if I was changing my name I said "NO", and they printed as my married name since that's was my legal name...

    Congratulation on your interview!!! ... 8 hrs??? that is a long, long drive... they should definitely do Oath Ceremonies for people who drive that long!!...

    I really hope they don't make you drive that long for your ceremony... you are almost done yay!!

    How old is your little one? I was actually sad hahahah when we picked up he didn't want me to hold me. He only wanted his dad to hold him. For about 3 mins he pretty much ignore me! It was his way of letting me know he wasnt happy that I let him for so long... I told my husband "I really need to nurse him right now and he doesn't want me :("...... "If he does this now, what is going to when he is older?" lol

  13. Sorry for the super delayed update..

    I will try to post for the 3rd time!! lol

    I didn't have access to Internet. I couldn't get any bars at the USCIS office or maybe it was my iphone, AT&T sucks haha..

    Here is how my interview went..

    After getting lost in traffic thanks to my very bad navigation skills(according to my husband), Google maps and my lovely husband that forgot how to get there we got there .

    We finally got there at 9:10 am, my appointment was at 9:30 am, there were a lot of people waiting for security check. After waiting like forever (about 10 min) but seriously it felt like an hours hehehe

    we finally got through security . There was a Oath Ceremony in process when we got there so I thought "oh well I may not get to do the oath today ".

    Blessed and Favored you may get the 9:00am or 1:00pm slot. We waited in the lobby for about 30 min. I was called I think around 9:55am.

    While I was waiting it was nice to see applicants coming out all happy almost jumping and dancing. Hehehe my IO didn't look friendly at all.

    I was like "oh, sh!t I hope she doesn't eat me alive " hahaha. She was so seriuos until she did swore me in, after I sat down she switched to really friendly mode and told me to relax (I guess it was pretty obvious that Ii was nervous)

    because it was going to take a few minutes to get everything together. She asked me a few questions about my husband and told "Happy Biirthday"(my birthday was yesterday) while going throughout my personal information then asked me to show her any ID passports and SS card, after that she asked the civic questions.

    The questions were:

    Who wrote the constitution?

    What is the political party of the president?

    Name tree of the original Colonies

    Name one state that borders with Mexico

    What are two political parties?

    Who is the commander in chief of the military.

    She said that it was the easiest test ever, that only one guy had failed today but he would have failed anything. I just smiled and didn't ask for more details about the poor guy.

    For the reading part was "who elects congress"

    Writing: "the people elect congress"

    She asked me to look at my sentence and see if I could find an error. I misspell "people"!!! I couldn't believe it!! I wrote "peope" I corrected it and she said "Congratulation your passed your civic test"

    She went on to ask the yes or not questions with a twist since she was alternating them.

    She asked me if i had any pictures with me. I said "yes" and I asked her if she knew what had happened to the ones I submitted with my application. She look in my very thick file and found them, she let me chose which ones I wanted for my naturalization certificate. She told me that she was glad I was naturalizing because my file was really big. After signing the pictures and signing some documents she got out a seal with red ink (I almost froze, with AOS it was green so I was expecting green ink again) it was the APPROVE seal and she said "congratulations you passed your interview. Would you like to do your Oath Ceremony today?" I said "Yes!!"

    She told me to wait while she took my file to the next place and came back printed my Oath letter and I was out by 10:10am

    We went to eat breaskfast, to get a few items at a store nearby and headed back to the USCIS at 12:00, thank god because we got lost again!! I hate you ATT!!! The google maps took forever to update our location and by the time it did we were not longer even close to that location... we got back there at 12:30pm

    OATH CEREMONY

    Around 12:50.. Only applicants were called in... we got sat down and slowing went to give up our Green cards and get assigned seats... Around 1:30 family and friends were let in. The Ceremony didn't actually started until around 1:45.. We were 73 persons from 24 countries... I sat next to a lady from Kenya and a guy from India. At 1:57pm I became a US Citizen.... I guess we were bunch of softies because about 80% of us were either about to cry or crying after the supervisor said "Congratulation you are now US Citizens" and they put a video ... It took a while for it to be over, since they asked not to leave until everybody had their certificates and had verified all he information, otherwise get ready to pay $400. if you found any mistake later... We left the building around 2:15 I was desperate to leave because I breastfeed my 11 month old, and if you are a woman and have/had breastfed you know why I was in a rush to leave hahahha

    I was asked to register to vote, but I had to pass...

  14. Thank You Blessed and Favored.... I didn't think about the original return... I'm a mess hahaha I found the originals for the last 4 years expect 2010... oh well I have the transcripts for that year.. I hope that's enough for them....

    I'm ready to go!! and its only 6:25 am.... 3 hrs from the interview time... I guess you can tell that I cant wait for it to over!! lol

    I will keep you posted... I don't think there is more Dallas Office applicants here, is it???

    I'm really hoping to get same day Oath but I'm not getting to excited about it...

  15. Questions for those who already had your interviews??

    Were you asked to show your original Tax Return Transcripts?? I went over all the documents I'm bringing to my interview tomorrow... and I cant find the tax return transcript for 2009.... I send the copies or maybe the originals.. I cant remember.... sigh... I requested a copy of the 2008 tax a year ago and IRS never ever sent me another copy.. ;( I'm just crossing my fingers the IO doesnt ask for it...
