    i got mail from uscis and it took like week to get it :thumbs: are you already a citizen ?? if so something is wrong :unsure: i would advise be crazy fax /call to upgrade /send regualr mail they will reply to one ,forget about filing again or checking status of earlier upgrade ,when you call them just tell them you need to upgrade your case ,they take your details plus email then you get email to send certificate but since you already sent process kicks from there

  2. Hello everyone.

    Today I fired my attorney and would like to do this on my own (with the help of all of you, of course!!) Originally she filed an I-130 as a Resident (LPR) for my wife and stepson on 07/2008. I became a Citizen in 02/2009, supposably she upgraded to Citizen in February 2009 but to this day I have no notices from USCIS or any other agency stating it has been upgraded. I have called USCIS, NVC, and have also gone to an InfoPass with no luck. No one has info about my case except that the I-130 was filed in July 2008.

    My question is, if I file a new I-130 as a Citizen, do I have to cancel the old I-130? If I do have to, how do I go about doing this?

    It has been over a year since I applied as a resident and all I got was NOA 1. It has not been approved and I have no proof that it has been upgraded.

    I would like to file an I-130 for my wife and one for my stepson and take the CR-1 route.

    In September it will be one year without my wife and two kids.

    All help will be highly appreciated.

    i was in same boat as you,i never used lawyer filed as LPR and when i got my citizenship i sent copy of my certificate by fax /mail/and called in to upgrade -which ever worked i dont know,But i got upgrade request granted email and mail .and from there since i had all my wifes documents with me i was fighting to keep up with their speed.

    Fact no need for lawyer if you need your process smoth and fast ,

  3. my wife arrived on 07/25 in dallas it was her birthday she was delayed at airport from 3.45pm to 6.00pm but she says all immigrants were there total of five but two guys ahead of then could not speak english they had to get translator which took several hrs,outside i was uneasy but its worth the wait,Now just showing her around -all the best to those still waiting

  4. my wife just called and her interview approved :dance::dance: has blue slip -was told to pick passport on 08/04 but she told CO that she wanted to be here for her birthday 07/25 she was told to pick it up on 07/23 :thumbs::thumbs: .

    Got at embassy at 6.30am and at 7am they let them in immigrant visa people did not have to que she was fifth in line.they were interviewed in that order.one of guys ahead was lottery person and she had told he want travel asap and he was told to pick his visa 3.00pm i think they give this visas on how fast you need it basis .These were questions

    1.who is filing for you ? DUH

    2.when and where did you meet your spouse ?STRATHMORE COLLEGE

    3.when did you get married ?2004

    4.when did he win green card ?- :unsure: -she did not know the answer so she said i left in dec 2003

    5.is he citizen or green card holder ?CITIZEN

    6.How do you know he is citizen ?ans-he told me ==do you have copy of passport or certificate ?-NO :devil:

    BLUE SLIP-your non immigrant visa has been denied and your immigrant visa has been approved pick your passport on 08/04....she made request for expidite because of her birthday

  5. I have to ask ... is there really NO ONE that can speak on my questions I asked the other day??? Really?? You guys respond to EVERYTHING on here and I ask a couple questions and it's almost like my post isn't even posted. Yet, I see that it's been read quite a few times. Hmmmmmm?!

    I thought this was a place to seek help ... can anyone help with my questions?

    How much is the fee that has to be paid for the I864 and is it for the Affidavit of Support or for Biometrics or what?

    Will I get the opportunity to give my husbands mailing address BEFORE they try to mail him anything?which address are you talking about ? On the application it only said "physical address" they did not have a specific place for "if mailing address is different". I am a little worried about it and want to make sure that we have it all correct before they try to send him something.

    If ANYONE can help or offer some assistance or advice regarding this I would truly appreciate it.

    i864 fee is $70 the petitioner pays this to review your i864 also there is another $400 you pay after that ..probably you know this,As for the address if you have email address its much faster since they email all the stuff from you honestly me and my spouse we didnt get any paper via snail mail even interview letter came via email.

    These from current visa bulletin so his category is F2A since LPR from india even if your i130 petion was approved its going to be forwarded to nvc where it will sit waiting for interview date .at the moment they are processing petitions received prior to 22 dec 2004-I can promises it will be years >i was in same boat the only thing that will speed up your petition is became citizen then upgrade

    These from current visa bulletin so his category is F2A since LPR from mexico from you timeline -his case still current if priority date is before 22jun02 its does not matter when it got approved ----if he gets citizenship just need upgrade and remove the quota and availability limit .

  8. for green card holder takes years over 5 then depends on the country and quota system .If he think he cant get citizenship because he never registered for selective servise ,they will ask for reson why you did not.i never registered they asked for reason i gave it they approved and after that my spouce petion seems quicker.If he cant remember if he registered have him go to www.sss.gov check .

  9. he is ok :thumbs: if he filed as LPR they are processing approvals with priority date of august 2004 last time i checked.Other question why hasnt he filed for citizenship which speeds up the process?I know probably he has his own resons but was just wondering.I was in same situation filed in jan 13 2006 and case did not move an inch till i became citizen.Advise call uscis and nvc see who help but honestly file for citizenship and get your wife here in less than 6 months :dance:
