  1. Well, we knew going in that we were going to get a blue due to not completing the medical in time; my wife only managed the appointment because the were really booked up.

    So, this is what went down:

    She had an early appointment but didn't get called until well after lunch (they kick everybody out for an hour at noon). She got questioned for about twenty minutes, just everything. Then told to go wait, so she sat for twenty minutes. The CO must have gone to look over the pile of paperwork I sent. She was called up for another twenty-five minutes of questioning. My wife said she answered everything correctly.

    The CO shook his head when my wife told him she didn't know anybody else in America. #######? This is the truth. He said he didn't believe her.

    My wife is pretty shook up (again!) so I haven't gotten all the details. But the CO didn't ask to see any evidence. The whole time was just questions. And get this, they want another time line. Never mind the fact that there is a perfectly good notarized one in the pile that was sent to them from USCIS in Vermont.

    She will get me the blue notice and I'll see it for myself, but it's the same b.s that I've seen before on that generalized form. They gave us a month to turn in the medical report and additional evidence.

    Just so you know, we have all kinds of documentation and photos; I sent them a pile of stuff and then I was in the consulate to turn in more stuff a few months ago. It's like a murder trial. Why don't they just hook her up to a lie detector?

    I'm not mad, not sad, just the same. I lost faith in this process the first time around.

    Sure, we'll do the dance with the medical and additional "evidence" but I'll probably start to make plans for moving to Asia permanently.

    Sorry to hear that bro. Hope thing will be alright for you and your wife. Just send it the medical and see what happen. Do you know what nationality the CO who interview your wife? If you can later, can you post the question that the CO ask your wife? Do they ask the same question on the first interview? Dam I think the only way to bring your wife over is to have a bunch of kids and bring them to the interview with DNA tested. This will prove the CO wrong but it cost us years of torture and depression.

  2. First I would like to Thank You for all your advices on my last post.

    On my verification of Employment it stated for my job Title: Tech Contract Employee but on my tax return for job title I put Manufacturing Specialist. Manufacturing Specialist is my title at my work. So which one should my wife said when the CO ask for my Job Title?

    My second questions is, for Affidavit of Support which one should I use I-864 or I-864EZ. Did anyone use I-864EZ before? I heard I-864EZ is a short version of I-864.

  3. I guess I'm a little confused as to what you're trying to get an opinion on...

    Are you preparing a response to the denial? Or are you getting opinions from VJ members to help your wife overcome the questions she was asked in the first interview without being contradicting?

    Please clarify so that we can help you address your specific issue.

    I just want to get opinions from VJ members on how my wife should answer when the CO ask how long do I work at my current job. The employment verication letter I get from my my compnay stated that I started to work on Aug 18 2008 to current.If the CO ask how long do I work at my current job, do my wife answer them from August 18 2008 to now?? or do she include the years which I work for Intel before I got layoff?

    My questions if she said I work from Nov 2005 to now, my concern is if the CO look at my tax return on 05-07 intel wasn't on it, only Kelly Services is. Will this raise red flag to them? This was what the CO ask my wife on her first interview.

    CO: How long have he work for Intel?

    My wife: two years, but ther was a short time he got layoff.

    CO: Why he got layoff?

    My wife: Because the company was down.

    CO: Why the company was down?

    After that, the CO said on the white slip that my wife dont know about my work. I dont understand what went wrong there. Unless the CO look at my tax and don't see Intel on it. That's is what I think but not sure.

    What do you guy think??

    Sorry, She had her first interview on Feb 09 not 08.

  6. Here is my work history.

    Nov-2005 to Jan-2007 = Kelley Services hire me to work for Intel.

    Feb-2007 to June -2007 = Intel hire to work for them, in June economy down got layoff.

    Aug-2008 to Now = Intel hire me back.

    IF the CO ask my wife where do I work now and "how long", what should she answer? For how long, should she answer them only from Aug-2008 to now which is about 18 months? Or should she include the recent years from 2005 to now? I want to make sure she answer them right so the CO dont have an excuse to deny her again.

  7. Hey, we are on the same boat and I know exactly how u feel.I been there will u when both of our wife got denied by the CO.Just be prepare this time bro. My wife will have her interview a week after yur wife. Right now we just prepare for all of knuckle ball the CO will throw at my wife. Hope this time both of our wife will get pink. The sun will always shine after a big storm.

    Try call DOS like Scott said, I took his advice and called DOS. They let me know the interview date way befoe the consulate notify my wife. I am getting nervous right now, June 23 is the date we been waiting for 1 1/2 years. :unsure:

    We send our DS230 last month, now just waiting for the interview date. Hopefully this time my wife will get pink. I am planning to go back when she have her interview date. I heard something the CO will call the petitioner in for the interview too. This time I'll be ready for them :angry:

    As you all know, we got our pink off of a reaffirmed case. I have noticed recently that there are a number reaffirmed cases being processed. I'd like to list what we needed at the interview and what the experience was like. If anyone else has a reaffirmed case (pending or completed) , please let us hear your input.

    What we needed

    1. Affidavit of Support **Don't forget the Employer Letter

    2. Police record

    3. New medical Exam

    4. DS-230

    Tuyen's interview was short about 8-10 questions. The only thing they asked about from the previous interview was about friends. The other questions were about our house and my job.

    We did not have to submit a time line or a list of Tuyen's relatives in the US. We had them prepared just in case though.

    The overall experience this time was good. The CO was polite and complimented Tuyen on how well she did during the interview.

  10. My wife told me the same thing today. She went to the consulate to pass in the DS-230. There one guy ask her what she sending in, she told him ds-230. He tell her to go to the office arcoss of the street to check if she fill out the form correct. My wife said she dont need to but that guy keep telling her just go. She ignore him and walk away. Those scammers just want easy money.

    First I would like to thanks all Visa member for helping me through out the year. It's been a very though journey for me and my wife to get her VISA. Our journey is almost at the end. Hopefully this time she will get pink. :)

    My wife just get a letter from the consulate asking for DS-230 today. When she fill out the form, she run in one problem. Her parent only have the year of birth. When she try to fill out the date of birth for her parent, it wouldn't allow her to put only the year. Can she leave that blank and fill it out with a pen??

    Any one have bad experience mailing document to the consulate? Is the mailing system over there safe? I don't want my document get lost some where. My wife is planning to go to the consulate to hand in the DS-230 but it very far from where she live. Any sugguestion??

  12. they only use the HCM#..

    its common that they will ignore emails for extended periods of time. You can have your congressman ask the same questions you are trying to ask if it is urgent...

    Its not often that one can get an actual answer from an email to the consulate.. Its usually a cut and paste response...

    Did you call DoS and check on the case status?

    Hi Scott,

    I didn't call DOS yet because I was waiting for the reply from the consulate. I'll try to call them this week. I am a little confuse between NVC and DOS, who will know if your case is receive by the consulate NVC or DOS? I never contact DOS before this is new to me.

  13. Do you think this casefile had the same casefile # issued from NVC? If so, perhaps that's what the hangup is -

    yer giving them the VSC casefile number and not the NVC casefile number.

    Alternatively - If you are certain that the casefile was sent to HCMC, you can call DOS Hotline, Get a Human, and inquire for status using the NVC casenumber (not sure about using a VSC casefile # at DOS with a re-affirmed petition, sorry).

    If there is ANY status on the casefile - DOS will know.

    Hi Darnell, if my case get re-affirmed do I used the same case number NVC gave me in 2008? Through out the rebuttal process, VSC was the only one that contact me with our case. NVC didn't even contact me at all, so I don't know if the case number NVC gave me still valid. That why I use the EAC#.

    I just got an update on my case from USCIS. I think they will send me a letter for rebuttal but not sure. Any one have any idea. Thanks all

    Here is the update I received today.

    Post-Decision Activity

    On March 4, 2010, we mailed a notice to you reaffirming the approval of this case and returned the case to the Department of State for visa processing. For more information, please contact them directly.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

  16. It doesn't have to be notarized. The translated copy needs to be signed by the translator, along with a statement that they are fluent in both languages and competent to provide an accurate translation. USCIS will accept the translated document as long as it contains the signature and statement of the translator. You could translate it yourself, or use the translated document from VN. It's your choice.

    BTW, lots of people translate their own documents, and I've never heard of it being a problem.
