  1. Thanks for the help.

    She did find her passport. Someone actually called us 2 days later that they found it which was a life saver.

    I tried showing her AOS notice letter but they said they can't accept it. Since she got her finger prints, I'm hoping it will be another month or two at most till she gets her card. My wife is really anxious to start driving since she is stuck at home alone and I tend to have to work late.

  2. My wife's K1 Visa and I-94 expired last month. We got married and filed timely and last week she went to get biometrics.

    My wife wants to start driving but when we went to the DMV they told me they cannot give the tests because of the expired visa/green card.

    The dmv officer told me that there must have been a temporary greencard or visa issued, otherwise she is in the US illegally.

    I never read or heard of this.

    Question is:

    1) Can I get a temp visa or update her I-94 somehow? How long does this take?

    2) Does this complicate her case or is she subject to removal?

    3) How can she get a valid ID to do stuff like open a bank account, apply for driver licesne etc?

  3. I filed a AOS for my wife who came to the states 6 months ago through a K1 Visa. Her appointment should be coming up in about 2 months or so and has already received her first NOA.

    BUT in the past 2 weeks we cannot seem to find her passport at all. I have photo copies of her passport but I know I will need the original. At this point I can only assume she lost her passport.

    What can we do? Will her case be rejected?

  4. Thanks for the kind words. This fourm is one of the friendliest and helpful experiences I've had on the internet.

    I do not have any assets and live we live in a small apartment (because of the financial strain of the house). I have a old car worth $2,000 but that's about it.

    The thing is I am well over the poverty level ($45k a year now, $55k before salary reduction) and will still be able to support her even with bankruptcy.

    Funny thing is, I've called a few bankruptcy lawyers and they can't give me a straight answer about green card application. All I can do is hope I can keep from financially collapsing until she gets her green card. :cry:

  5. I brought my wife to America under K1 Visa, got married on July and sent out her Adjustment of Status packet.

    A few weeks later, I learned that I'll be getting a substantial salary reduction which will make it impossible to pay my mortgage.

    I have a rental property that fell in value by over $100,000 and the tenant is not paying. I'm 3 months late on the mortgage for this reason and working on getting the tenant evicted.

    I don't have anyone else who can help me for affidavit of support either.

    Would a foreclosure cause my wife's application to be rejected? What about bankruptcy? I didn't qualify for loan modification because of technical bs and these seem to be the only two options.

    I'm working on getting a 2nd job to try to keep this from happening. If my wife gets her green card can it be revoked? How long do I need to keep things going to be safe?

  6. For adjustment of status, should I send a photocopy of the Certified Copy of Marriage Certificate or the orginal. I only have one certified copy.

    As is stated in the instructions: the USCIS does NOT routinely require "original" documents unless specifically requested. Regular photocopies are accetable... The marriage certificate is NOT on the list of specifically requested documents.

    The CS will have the required form

  7. Called yet again ... I spoke to a supervisor and she told me that it seems the NOA2 Approval letter was sent to National Visa Center but didn't get approved in our system (some one skrewed up and didn't enter it into the computer I guess).

    She said she will email NVC and see what happened. But the letter was sent to NVC but we never got the NOA2 approval letter.

    She said she thinks it would be fine if I write a letter explaining the situation and attach a copy of my appointment interview but and I quote "I'm not sure"

    I called the NVC and insist I call uscis (which I just did) ... I'm just making sure I can make the 90 filing period ...

    I'm more confused now than ever ...

  8. Okay this is strange ... I called USCIS and talked to the 3rd person and decided to pay the 300+ duplication fee because we are short on time (38 days left on visa)

    They then gave me a different answer when they took a closer look ... we are sorry we cannot send you a NOA2 approval letter because you are not approved within the system. This is why you never recieved your NOA2 approval letter.

    They told me to call the NVC and tell them but they said just send in your approval letter.

    I gave them my reciept number (WAC...) when they told me this.

  9. I've been filing out the Adjustment of Status forms for the past week and on tuesday I realized I needed an NOA2 approval letter which we did not receive at all!

    We never received the letter in the mail .... we didn't get it after our interview ... we didn't get it when she got her visa.

    I called several times and they are telling me that it's going to be $300+ for a duplicate which given the $1000 filing fee, vacination and medical exams ... we just cannot afford.

    I called a few more times trying to get someone samphatic but given the status of government funding.

    The online tracking hasn't been updated since they recieved the packet... what the hell am I paying these filing 300+ filing fees for.

    Is there anything I can do or do I have to pay the 300+ duplicate charge and wait weeks for it to arrive by mail. I'm already 39 days and here is my status:

    (1) we got married 2 weeks ago but still waiting on our certified marriage certificate ... cannot do AOS until then we recieve it I think

    (2) We didn't apply for a social security number (I didn't know we could do so before adjustment of status, my fault for assumptions)

    (3) Don't know my fiance/new wife''s A# .... I think its on the NOA2 approval letter

    (4) No NOA2 approval letter ... may have to wait weeks.

    Any help will be appreciated.

  10. Thanks for the quick reply. I'm filing out the 485 Form. It asks for a social security number ... can she get a social security number before adjustment of status?

    (1) I'm still waiting on my certified marriage certificate (another 2 weeks), so I'm wondering if she can get a social security number before applying for the 485 form will she get one before I have to send her packet.

    (2) For Non Immigrant Visa Number -- Do I enter the control number, her country's passport information or what? =/

    I'm lost, the guide is very helpful but I suck at filing forms.

  11. Nah it's not that.

    Because of the terrible war conditions in her country (Afghanistan) my lawyer decided it would be better to get all the information needed prior to the interview and send it from America. My lawyer told me that my fiance didn't need to sign any of the forms until she went to the embassy of Pakistan because she would need sign infront of an officer. I was actually surprised to here this.

    This packet is Packet 3.5 (K-1) which has her passport information and some forms.

  12. My lawyer gave me a packet and said I need to send it to US Embassy in Pakistan (this is for my K1 Visa) for my fiance to get an interview. This has her bio, passport copy etc.

    However she didn't know what would be the best way to send it. I don't think UPS can deliver there (a family member tried a few months back) I think the embassy doesn't accept it.

    I'm wondering if USPS or Fedex would do the job correctly. I cannot afford these papers to get lost as it has original documents and could delay my case for months.

    I've tried contacting the embassy but haven't been able to get through to anyone in 3 days. I've also sent emails and checked their website with no results.

  13. I decided to use an immigration lawyer for my K1 Fiance visa. Everything has been going great so far and I received an approval letter from the Visa Center and waiting on a packet from the embassy.

    But when I asked if I can get a copy of the packet so I can have the information available to me they told me they can't give out those documents (they aren't allowed). This doesn't make any sense to me, they filled out the paper work but it is my paperwork and information. (signed a power of attorney form to allow them to create the packet)

    Anyone know why they wouldn't want me to get a copy of my packet? I already paid so they aren't getting any more money if they keep me in the dark.

    It is Really strange.

  14. This lawyer has had experience with Afghanistan K1 Visa applications. In fact I spoke to about 10 other lawyers until I found one that had experience (and proof) of past successful cases with Afghanistan.

    I'm not sure why she didn't want me to check the status of my petition. Her reasoning seemed kinda bogus. Which is why I'm somewhat worried, I'm checking it once I get off work tonight.
