  1. I am about to file an I-864EZ to the NVC. My 1040 from 2008 puts me over the 125% of the poverty level. I have a job now, but last year I was on un-employment for part of the year so my W-2s do not cover all of my income. i just started my new job but it is not a salaried position. I am a licensed insurance agent and working on commission so my income, at this time does not show me above the required amount of income. It will as soon as I build the business up.

    Will my 2008 and 2007 W2'w which show my income above the 125% be enough? I am concerned that the NVC when seeing that some of my income from 2008 was from unemployment insurance that they will require substantiation of current income. If they do require something, since I do not have a salaried job, would that present a problem?

    Does anyone have any experience with this?

  2. Hello,

    I just completed the I-130 and was ready to send it off and I got laid-off from my job. I have been laid off for about a week now. My wife is in the Philippines. I don't want to submit the form with me being unemployed but do not want to lie about being currently employed. Has anyone had to deal with this? The prudent thing to do would be to wait until I get another job, I think. I can submit it as employed with my last employer and I am sure that I will be working long before the US Immigration checks. Any suggestions or experience with this?
