  1. SO we got our B2 and we'd like to get married while we're in the US and return to our lives abroad.

    can we get married and just leave, or will we run into problems on my fiancee's next entry into the US? i'm reading lots of conflicting info...

    just found the answer to my own question after a lot of searching, if anyone's interested...

    N11.1-1.--Fiance(e) of U.S. Citizen or Permanent Resident Alien. An alien proceeding to the United States to marry a U.S. citizen is classifiable K-1 as a nonimmigrant under INA 101(a)(15)(K). [see 22 CFR 41.81.] The prospective spouse of a U.S. citizen or lawful permanent resident may, however, be classified B-2 visitor in cases where the consular officer is satisfied that the fiance(e) intends to return to a residence abroad soon after the marriage.

  2. DS-156 Question 36 Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?

    but the K-1 is a non immigrant visa, is it not? so i wrote "no."

    the interview is next week, i am more than happy to write a new DS-156 and a new #36 on if i messed it up. i was under the impression that since K-1 is non-immigrant, that #36 would be "no."

    obviously we're in "full disclosure" mode, no lies here.

    thoughts?

  3. hmmm if all u have to do is submit ur packet, and pay pretty much the same fee for k1 visa interview as u do for b/2 interview u have a better chance of getting the k1, if u dont want to get married in the usa and stay

    u can at least have a 90 day vacation, or u can marry in the usa and still go back when ur ninety days is finished, this is just my opinion but i know that the b/2 is hard to get even if u dont have a k1 visa petition going on.

    the embassy may feel that u think u can not pass the interview so ur trying to by pass the interview for it and go on b/2 for the same purpose that they k1 was applied for.

    yes i did forget about that part of it

    as i said before, we abandoned bc we can't prove domicile--we 're not moving to the US and i haven't evenlived there in 7 years anyway. i dont want to lie to a CO.

    we already have the police report from sri lanka and the $ for the medical wasn't the issue. i think the best idea would be to use the abandoning of the K1 as evidence that we're staying put.

    should i put that as a section in his evidence binder or a separate envelope "in case they ask" about the K1? i don't want to offer if it they dont ask but i don't want to look as though we're trying to hide it either.

  4. so here's the deal:

    my fiance and i live together abroad and have established lives here. we thought about moving to the US and applied for a K-1 in november, but we changed our minds and are staying abroad.

    the embassy here got our paperwork from the NVC, and we got a packet 3 but we never submitted it. we even thought about going through with the K-1 just to get married and come back here but i didn't want to lie about domicile.

    here's my question: when my fiance goes for the B2 interview, what are the chances that the consular officer will know we have a K-1 pending? of course we were honest on all the paperwork but they only ask about immigrant visas, so the K-1 isn't on there.

    i would imagine the CO's don't do much prep work until the packet 3 comes in and they know you're serious, but i could be wrong. do they do any prep work or do they take each B2 and all information on the spot?

    of course my fiance won't lie if he's asked about the K-1, but if they don't ask he's not going to volunteer that information.

    we have strong ties outside the US, if not for the darn K-1 i think we have a decent shot at a B2. what do you think? are we wasting our time?

    my fiance is from sri lanka and even though we happen to live here in phnom penh we assumed that we'd got through the embassy there-- well, turns out we were wrong and our packet was sent to the embassy here in march. we have yet to hear/receive anything from the embassy.

    question: is it crazy to think we'll have visas in our hands before july 1?

    if not, we've got a lot of flight rearranging to do...

    i am filling out an I-134 to be safe but all my income is from a non-american company overseas, so i don't think my income counts anyway.

    regarding my tax returns...do they need to be the returns from the IRS directly or can they be copies of the forms my accountant sent to the IRS?

    i assume they will be only looking at these for domicile purposes anyway, we have a co sponsor.

  7. i am a teacher and when i go to the interview with my fiance (i am the USC) i won't have a job. we'll be moving back to the US in july and i can't start looking for a job until i get there. (i've lived and taught abroad for 7 years.)

    we have an excellent co-sponsor (my brother) who we'll be living with until we get on our feet.

    1. should i bring in pay stubs from my most recent job? i've been teaching for 10 years now.

    2. will this negatively affect my fiance's ability to get the visa?

    since the interview usually based on proving a bona fide relationship (no problem there) and we have an excellent co-sponsor (my rich brother), we will just do the interview as planned and hope they also just assume we're moving.

    oh, and of course we are travelling to the US to visit my family, get married, and be gone before the visa expires. it's just the AOS part we'll skip since we live abroad.

  9. we finally got our NOA2, yay! but our circumstances have changed, and we want to prevent any problems at the embassy in colombo when we go to interview.

    when we first applied we were planning on moving back to the US, but with the economic situation there, we decided to stay here in a third country, cambodia (we've lived here together for one year and have a baby daughter.)

    we are still going for the K-1 visa in order to visit my family and get married while we're in the US. we don't plan on applying for AOS, but rather we'll just come back here to cambodia. as i mentioned in a previous post, as a poor single guy from a poor country he would never get a tourist visa.

    now for the questions...

    1.) affadavit of support-- i have a good job here, does that count or do i need a co-sponsor in the US?

    2.) i understand this is a rare situation, in the event we get an interview with a person at the consulate who wants to reject us based on the fact that we're not moving to the US, what can we say in our defense? i've had a quick look at some of the foreign service manuals and haven't found a thing.

    should i contact a lawyer to get some concrete regulations to print out that states that we can still enter the US even though we don't plan on living there? i do have a contact at the embassy who knows us but he's not in the consular section-- would it be wise to consult him?

    3.) my baby and i plan on going to the interview with my fiance. how much can i speak? will they address me with questions as well as him? can i help him out or will they tell me to shut up? :blush:

    i don't want to leave anything up to chance, my mom and dad are dying to their granddaughter! thanks in advance for your help.

    What is your current address? I just realized you said your abroad.

    Perhaps that had something to do with it?

    we have an EAC number. yeah, we live in cambodia.

    and why would they transfer it from the CSC to the VSC? now we have to wait even longer. my fiance is from sri lanka and it's a pain in the a*s to travel/get visas ANYWHERE with his passport-- they seem to be on a worldwide blacklist along with nigerians and iraqis.

    i guess we'll just have to wait and see...

  11. so my fiance and i are overseas presently and we applied for a K-1 in november. we've decided to stay overseas but obviously we still have the visa in progress. if we get approved, we'll still get married in the US, but we'll just head back abroad instead of living there and applying for the green card.

    does anyone think this will have an impact on them approving or denying the visa?

    we couldn't get a tourist visa for him, we didn't even try...single guy, no assets, etc.

  12. wow, someone got an NOA2 already? oh my gosh that is amazing.

    i hope all is well, fellow November filers. we are dreaming of actually entering the US together as a family in june (we live in cambodia now.) i prepared my fiance for the worst-- our baby and i in the US (job hunting!) and him in sri lanka waiting for all the interviews and paperwork.

  13. I think it's best to get all the documents as son as possible, then there is no rush at the next step.

    you need to get a police cert from london AND from sri lanka- -the sri lanka one takes 7-8 weeks. email

    "Consular, Colombo" <ConsularColombo@state.gov-- and ask for the police cert for a K-1 visa. they will need the following information:

    Full name:

    Type of immigrant visa and case number:

    Date of birth:

    Place of birth:

    Sri Lankan National Identity Card number:

    Passport number for foreign passport holders:

  14. Just wanted to reiterate what nick said... original = certified...this means either raised or embossed seal.... not the very first one ever made for you. ;)

    Wouldn't it be something if we all had to get that? :huh:

    It was requested that I send my original as well. Just picked one up in the city I was born.

    ok, thank god. i sent an email to the consulate saying i have a certified copy from the health dept with the seal and they said, "no, we need the original." so it's just a matter of semantics-- i was about to have my mom and dad rip their attic apart!
