  2. Good day to all members, Please, I need some help regarding my case.

    Maybe one of you had the same situation.

    I am a naturalized USC. Has minor child (his Filipino dad and i were never married) and under CCA of 2000, he is automatically a USC so i applied for a passport for him a month and a half ago, but the Dept of State sent a letter (attached on this topic) that i need a custody decree or a statement from a competent authority that my country pressumes that i have my minor son's legal custody.

    I even went to the Philippines and let his dad sign the form DS 3053 allowing our son to apply for passport without his presence at the acceptance agent.

    My question is?

    1. How can i get a custody decree? I attached also the copy Family code of the Phils (I also attached on thistopic) and highlighted it in red that all illegitimate children will be under the parental authority of their mother.

    2. If it is not possible to get a custody decree, WHO is the competent authority that can help me prove that I have the legal custody of my minor child and how can i obtain a letter from him?

    My kids were using my x Last name on their Birth certificate but we were not legally married. If the kids are illegitimate,,the mother has the sole custudy of the kids. . Whe n I got naturalized I did not have any problem getting my kids their US Passport. Try getting one at the authorized Post office that issues passport coz that's where I got mine and my kid's US passport.

  3. My son is scheduled for his interview next month, I am from the Philippines. Hubby cant he needs to pass a lot of paper work to get leave. And he doesnt have much leave days right now.

    Your son can travel alone escorted by airline personnel. U will pay a bit extra they will make sure ur son will get to his destination safe.

    I do not know where to post this so my apologies if in the wrong forum.

    Our situation is a bit dire. We had our interview on March 8 in Manila and we got a 221G asking for more evidence and documents which we submitted on the 11th and were received on the 14th. There was a status update on the 16th but we have heard nothing since.

    My pregnant wife is currently just about at the limit where she can safely fly. If we do not get our visa with in the next 2 weeks we will most likely have to have the baby here.

    My question is how do we take our baby to the USA if we do have to wait until after it is born? My wife will have her visa hopefully but what about the baby? Do I need to start a whole new petition or something? What is involved and how long will it take? What about flying with a new born? How old will he have to be to safely travel?

    If the child is born in the Phillipines u can file for a CRBA or Consular Report of Birth Abroad. My youngest was born there and had no problem bringing him here while hes only 2 months old.

  5. My son (11 years old - minor) is under his biological dad's name however he is illegitimate. We were never married and I havent seen him for 5 years or so. has anyone done a IR-2 for their kid wherein the US citizen spouse did the petition? Do you guys have a link of how the process is and what are the requirements, fees? Would I need consent, DNA, etc etc? Thanks! Any info would help. I see a lot about k1/CR1 but I'm having some difficulty finding info about IR-2. Im already here in the US and married.

    Since your son is illegitimate , u don't need the father's consent coz u have the sole custudy of him. My husband petitioned my 2 kids with no problem

    Well, I believe that his is a unique circumstance where the child and parent are trying to be together and I believe that the immigration officer could see that. While B2 is typically required to prove that he has ties in the Philippines and that he is not going to stay in the US illegally, he has legal rights to stay in the US with the proper adjustment of status procedures should he decide to stay. I am his mother and sole biological parent and his stepfather who is my husband - both US citizens.

    We went with the B2 route because at the moment he doesn't know if he would like it in the US, its easier to file a petition once he likes it than file a petition and ends up not liking it and documents get complicated.

    I understand that purchasing the ticket was a gamble for us but we are also pressed for time. His school comes back in session first week of June and of course would like to be back by then.

    buying a ticket with no visa yet is not a good idea. It takes a lot of paper works for a minor to fly here. U have to have authenticated documents from here for ur hubby to travel with ur son.so much documents needed thats why i ended up flying back to pick up my 2 minor kids ..less hassle .

  7. I am preparing to file a k1 & k2 visa at the same time. My fiance was never married to the father of her son and the father has abandon them , although he lives close by but never sees or supports the child for over 2 years. Do I need to have the father sign any form to allow the child to travel to usa?

    My 2 minor kids uses their biological father's last name and was lis5ed in the kid's birth certificate as the father but we were not legally married. I was able to bring my 2 kids here with no father's consent or any issues till my kid's got their US citizenship through me.Now theyre legally adopted by my hubby.

Hi gang.....been a while since being on here... gotta few Qs for you guys....I am a US born citizen and i married a filipina which now has her 10 year green card....ok, my 1st Q is: i want to get my step daughter(wife's daughter) to USA, or is it better to let my wife file? we were married in philippines and wife came to USA under the CR1 catagory in 2011.. i've read all over VJ and read post after post...the more i read the more i get confused... can my step daughter get here faster under me filing or let the wifey??? ....2 do we need to file the I-130 or am i overlooking something as to where we don't have to file anything..

    Better if u the citizen file an I-130for ur stepdaughter.how old is she?

  9. if shes from a small province i would suggest going to a local passport agency ,,they process NSO birth certificate..they will process it and sure save time travelling back and forth and save lots of $$$. Thats what i did since my kids live with my mom in a remote area when ky kids was still in the Phils.

    I will try to write clearly but I am very depressed right now.

    We have our NOA2, we didn't think ahead about the passport. Both busy. I have a teenager at home, and much work. She is single mom in university. No excuse but that is the setting.

    She goes to her local DFA to get passport. They say get a social security ID. She goes to social security office they say it will take from 3 to 12 months to get the ID because the paperwork has to travel from her island province to various offices in Manila.

    Lets say it takes 6 months, then 45 days to get passport, then schedule the interview. We are right up against the expiration date of even a year long extended K1!

    We are both really feeling defeated. Can anyone help make lemonade out of these lemons?

    She has:

    school id

    postal id

    TOR transcript of records

    NBI police clearance

    Phil health id

    baptismal certificate

    birth certificates for both her and her 3 year old

  11. I would suggest u to do more readings and research about step parent adoption. I thought agencies that u can get adoption papers are just that easy as they seem to be. After months of reading and researching,,we ended up hiring a lawyer for my 2 kids adoption. Some states requires a lawyer and residency. We officially filed our paper work in the court with of course a lawyer (Bunch of paperworks) last Sept. 27 and were just waiting for the final hearing next week. I will definetely post an update once were done with this process for my fellow pinays.the fathers consent is the number 1 requirement before u can go to the next step.

  12. It really depends on ur situation, i live 6 hrs from Manila and i was a green card holder that time already so it was easy for me...i only made one trip during the interview and that was it. They did not require for DNA or anything. It was worth for me. Coz i dont have hospital bills when i came back to US.

  13. We had hour son in De La Salle hospital in Dasmarinas, Cavite in May. We had to do an emergency CS, which ended up costing 125k php, which included everything (hospital fees for two nights and three days stay there, doctor's fees, medication, etc.) We chose De La Salle because it was the best hospital within 1 hour from our apartment in Dasmarinas. A normal birth without any issues would have been 40k to 50k there. I have no real experience of the same from the USA, but my impression is that the quality of care was comparable to a standard hospital in the USA, FWIW.

    We took the hospital's birth certificate to the municipal recording office about a week after birth. They filed it with NSO and we were able to get our son's NSO birth certificate through the online service in about month and half after birth (did not try earlier). We submitted the CRBA and passport application about a month later, and were told by the consular office that we should expect our son to get his US passport in about 3.5 months from submitting, if everything goes well. Still waiting...

  14. Well, we had our first child in the US. But now the only hospital near where my family lives has gone "out-of-network" from our insurance. So we're seriously considering having our second child in Philippines (Davao City). Questions:

    1. What's the approximate cost of a normal delivery at a decent hospital (at or equivalent to Davao Doctor's)?

    2. About how long does it take to get a US passport for the child so we can return to the US? In that past I have heard it can take many months just for the NSO to record & produce a birth certificate on NSO paper. Is there any way to get around this? Will the US Embassy accept anything othe than a B/C on NSO paper? Is there some sort of expedited service from NSO? Once we file the CRBA with the required documentation, how long does it take for the US Embassy to issue a passport?

When i had an unplanned pregnancy hubby and i decided to give birth to our first child in the Philippines and that was 6 yrs. Ago. I gave birth thru a C section in a.private hospital with a private doctor and private room. All my bills approximately was about $4k .about the CRBA it only took me 10 days from the time i sent my application till getting my sons US passport . My son is a dual citizen
