  1. So, I was a January filer and I had a feeling something was wrong since it has been about 10 days and the check wasn't cashed as of yet. To my dismay, the packet was sent back. There isn't much info about my situation, so I am hoping you guys can help. Basically, I had started a topic on here before I sent in the packet regarding my husband having been issued a 10 year green card, I assume mistakingly, on 3/26/2009 (we were married Dec 8. 2007 - so less than 2 years). However, not knowing there was a law basically stating that if married for less than 2 years at time green card was issued, you must remove conditions within 2 years. We just thought the agent issued him a 10 year card.

    Anyway, I was instructed by our attorney that even though it was a mistake and his card didn't expire until 3/31/2019, we must still remove conditions to avoid problems in the future.

    So I mailed the packet on Jan 18th. We received it back today with the reason being "other" and handwritten it states that the card issued with the 551 must be returned with I-751 and fee. We did as directed and make copies of front and back. How would we know to send card back, and plus, then my husband would be without a green card in the interim.

    On the I-751 when it asks for card expiration, I had put the actual date on card of 3/31/2019 (with an * and then a separate page explaining the mistake) and they crossed that out and put 3/26/2011. Does this mean we need to redo the application as well and just put 3/26/2011??

    There is no place explaining this type of mistake...how would we have known to send card back??

    I saw your problem and my friend has a similar problem to yours. She did not return her card but went to the local DHS and asked helped from somebody there. One of the staff was so helpful and guided them what to do. The staff even gave them an option to have all the correspondence relating the problem be sent to her instead to them directly, which they opted. In 4 months she got her correct green card. Hope this works on you too. Just give it a shot.

  2. If your other evidence is solid IMO it is not necessary but send what you are comfortable with. In our case I am not sending any as I feel I have sufficent evidence without them. Good luck.

    will you also include a tax return of 2010? i am filing stuff for February, and i am not sure if we can file for income tax that soon.

  3. One of the conditions of being a legal permanent resident of the US is that you have to actually reside in the US. If you are intending to be out of the US for over one year, you must apply for a reentry permit before leaving the US. the question is addressed on the web site below:

    Thank you for taking time to reply. I know that re-entry is needed. But I am not gone for long yet but will be after the I751.

    My question is: should I also submit a police clearance if I say yes to #9 question of the form (being here in australia with an address for over 2 months now). I will tell them in my cover letter that I am going to apply a re-entry permit after the I751. But until that time, I will be staying in the US.

    Or is it smart not to mention anything about Australia? I am scared if I get on the interview part and my husband is working, he won't be able to come.

  4. Hi! I need help guys.

    I'm filling out the I751 and there's this question on part3 #9: Have you resided at any other address since you became a permanent resident?

    My case is my husband, with our daughter and I are currently in Australia -- husband will be working here for 2 years. We've been here for almost 2 months now. Should I say yes to that question (I think I should)?

    One more thing, I am going to be honest in my cover letter that my husband has a job in Australia and that I will be travelling here to the US until I get a re-entry permit. Will that be a wise thing to do?

  5. Thanks a lot for taking time to share your thoughts about this. Yeah, it's a great idea to have a cover letter. I hadn't thought about that.

    I am just going to submit all that I got. Unfortunately, there'd be no joint bills. It's too late to arrange for that. My husband was laughing so hard saying that he could transfer all the bills in my name with all his pleasure... and he could run away.

    I wish some people who have tried submitting theirs without joint bill could post too and appease me :(

  6. I will have my turn of filing for removing of conditions in February.

    I have joint account evidence, health insurance and tax returns. Birth certificate of our daughter. Mails from his family, pictures but No bills under both our names. I am a housewife and don't earn anything. I have pictures with his family and him with my family. Oh my, I'm feaking out after reading a post from someone receiving RFE for having just the same evidence that I have.

    I can also show e-tickets of travel together. I'm so freaking out right now. Can somebody please tell me I'll be ok?

    I basically just have the same evidence to show in February like what you have. My husband I don't have bills under both our names. I am a housewife and I don't earn anything. I take care of house stuff except for bills. I can show tax returns, joint bank account and health insurance, pictures, birth certificate of our daughter, mails addressed to both our names.

    We do not have bills. Will that be a problem?

  8. How long do you plan on being in Australia? If it is less than two years, I'd try for staying in the US, removing conditions, then joining him after applying for a re-entry permit. If you guys are planning on being abroad for more than 2 years, I'd give up on the greencard now, then apply for a fresh spousal visa via DCF when you want to return.

    PS: if he is going over on a government or military contract, you may be able to remove conditions from there.

    Thanks a lot! We'll only be there for 2 years. Well, that's what his contract is saying but could be extended who knows. While waiting for people to reply, I just decided to stay for lifting of conditions purposes and be with him in between period. My husband is agreable on it, I just hope it works and the USCIS will not give a fuss about it, you know.

  9. I'm caught in between but not really?

    I'm here in the US with a conditional permanent resident visa. My removal of condition should be made sometime around February but my husband accepted a job offer in Australia. Husband is American Citizen. We have a child together and he is bringing us with him to Australia. I am not sure what to do with my US status. My husband said that he has no problem me continuing the processing of the resident visa but to stay in this country without him (he has no family in this state, his parents already passed away, and I don't have family in the country, too.) doesn't sound wise -- insurance in case any of us is sent to the doctor or hospital, etc., plus we will be apart.

    My question is, can I still apply for the removal of condition even when I won't be staying here but will only be here for that sake (filing the paper)? Should I just voluntarily give up my resident right? Or is there a way to tell our situation to USCIS and ask what we can do about this -- say for example let us file everything in Australia? I know the last part sounds silly but I'm really in limbo and don't know what to do.

    Any idea? Suggestions? Advise?

  10. Oh so sorry, I've never been on the computer lately. I'm still trying to settle down here at home. There's so many things to do -- husband, baby, lanudry, etc etc.

    I'm so grateful to those who replied. It really would be a great idea if we meet! I have not been to so many places yet in Washington so obviously I have not met lots of Pinoys yet twas why I really am so hopeful to meet some of the members here who are from the same are where I'm at.

    We probably meet 20yish of June, what do you think?

  11. Is it true that CFO Cebu only accommodates 15 people a day? Is it also true that you have to register at the guard first? I'm planning to go there tomorrow and I'm just worried if I go there and have to go back, that would mean I would go back on Wednesday for US bound people. I have a one year old kid and I don't have a luxury of time to stay at the CFO from 6AM. Please advise. I'd really appreciate any advice!

    My daughter and I are leaving the country soon to join the head of the family!

    I have a question, what passport will my daughter use to leave the country, US or Philippine passport? Her Philippine passport isn't available yet till middle of this month yet my husband want us there with him this week. Is it possible if we will just use her US passport? Will immigration in the Philippines let us go? Thanks in advance!

    PS

    Do we also have to bring a letter from my husband to authorize me to travel with our daughter? I heard letters like that is required but isn't just clear to me what really is the process. Thanks again!

    Thank you guys for always answering my questions specially those people I have sent private messages and who were so kind to reply and answer my questions.

    My visa says "upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year". What does that mean? Hehehe... I guess it's never ending questions still. :)

  15. My husband and I had to face the same ordeal too. What he did, he just filed for TAX as "married filing separately". He said it costs a lot of money filing that way but we will get the money back once we complete visa and get our ssn by filing an amended tax return from "married filing separately" to "married filing jointly".

  16. I stayed at Diamond Hotel for my medical last April 7th. It's along Roxas Blvd and just 4 blocks away from the embassy. You'd see the embassy from your hotel window if you have the bayview.

    The price is not that cheap in my standards but their room was clean and neat and just like the picture you see in their website. I was even comfortable letting my toddler walked around the room barefoot. It's a bit rundown hotel but they've kept it well. Their bathroom was spotless. People were nice (though breakfast has less choices). Internet's fast! I even played finalfantasyXI with my husband while we're there while skyping. I strongly recommend this hotel. I'll be staying there again come my interview date.

    Tip if you want a cheap rate: have your fiancee booked it under her name. There's a thousand pesos difference if a local booked the room. Plus internet will be free if it's a local staying in the room. Just let your fiance call the hotel for reservation. No need of credit/debit card to reserve the room. Once reserved, they will keep it for you until 4PM of that day.

    Diamond hotel should give me 50% off for posting this. :D

  17. Please help. I'm really worried because this is my 2nd interview date. My husband and I rescheduled my interview because we're still waiting for my TIN and his recent income tax return transcript. Do you know how long it would take to get a TIN? My 2nd interview date is on May 4th, 2009 and until now, we still don't have those things. Consequently, I can't send my DS230. Am I right? I just wonder how it would be to have the interview when things are not done yet in NVC. Is there anyone here who already have interview dates, but haven't completed their case in NVC?

    Can I send DS230 before AOS directly from the Philippines to NVC?

    Please help. I am really worried and this process is making me sick.

    Is ther anyone of you who applied for TIN? How long did it take you? Can you think of other option for us.

    I really don't understand and forgive me I'm confused why you have to get TIN. When I submitted my DS230, the guide didn't say anything about TIN. Or maybe that's the requirement for K3?

    If you're working on your CR1 just like what we're doing, I'm pretty sure your TIN isn't needed for submitting DS230.
