I noticed that there are so many controversies here in our very own Philippine forum lately and I'm saddened by it seriously. Please let us keep the PEACE here brothers and sisters instead of attacking each other and fighting for nonsense things .We are all here to help and support each other especially those who are still in limbo and desperate to be united with their loved ones here in the US. Let's be careful if we want to post something and see if it's offensive or not. If it will only provoke anger and hatred then refrain from posting such topic so we can keep the peace.

Hmmmm.... you have point. Actually, hubby and i , enjoyed reading and at the same time laughing out loud... hehehe! Its kinda exciting when people here are punching the bad and rude members who doesnt know how to respect other people ideas.

A young lady in the Philippines was married to a filipino man that verbally and physically tortured her. During the time of their wedding, she used her childhood given name for the marriage certificate. Through rumors, she heard that her name was incorrect. Upon requesting and receiving her Birth Certificate 2 years ago, she discovered that her real name is in fact different than listed on her marriage certificate. Are there legal grounds to assume that her marriage is considered null and void due to this technicality, or should I say this huge error?

I know she needs a lawyer, just wondering if anyone here has had a similar situation and has knowledge of possible outcomes or of the current law in such situations.

She now lives far from him, her main question is if she needs to apply for annulment to pursue possible Fiance Visa or can she proceed with the name on her Birth Certificate?

Also note, according to her cenomar, she is single, but that is according to the name on her Birth Certificate.

I will let the wife look at this one when she comes home. Stay tuned. This one might interest her.

Thanks for all the replies, I did a little research of my own since posting this and according to Philippine law, Article 35, sentence 5. there is possible grounds for "Null and Void from the beginning" due to identity issues. However, it is for the courts to decide. As far as I know, she used her nick name, which at the time she thought to be her real name.

It applies only to a person marrying another through a mistake in identity (marrying the wrong person). it does not apply to her. The mistake results from her giving the incorrect first name when applying for marriage license. This does not render the marriage null and void since she was also known by that name.

I agree with you...because once she get the CENOMAR at NSO, record would show that her nick name in her previous marriage and her real name that she is using at present is in the same person.

ok heres the situation, i have a bf from USA....he been filed as a being petitioner since august 2008 till now yet havent heard from approval from his side and im waiting too.... and now i found a new man which they both same country but different state .....then who is also willing to petition as same petition with my old bf.... but the question that really bothered me is that, is it okay two petitioner do petition on me? though both sides on them havent know the real situation and i dont have plan to tell to them coz its very complicated and i dont want to hurt one of them.....does the NVC or USAID or USCIS, wont trace up for my side? that i have a two petitioner?

some friends told me it wont trace up my side coz it just trace up for there own each profile of the men, is it true?

HOnesty is the best policy. Ask her friend if she experienced that having not traced up the records. If it is her own experienced then maybe her friend is right. But if her friend just learned it from a hear say, she maybe wrong. I think there is no way that USCIS cannot trace up the record even they have in different state. It sad to hear this kind of story. Two timer , is dangerous!

Oddly enough, I just found out by doing a google search that people in the United States are allowed to change their name whenever they want to (as long as it is not used to commit fraud) and it doesn't even have to involve any legal paperwork. Names can be changed in two ways:

1) by picking a new name and using it consistently. This is called "common usage".

2) going through a formal or legal process

If the above is true, then, having a different name in the petitioner's BC should not be a problem as long as he mentions the other name used in the I-129F.

Yes, i beleived that his fiancee did not commit any fraud, since he already met his fiancee in the Philippines using his passport in his new name. Only my own opinion.

Just want to clarify if their application was been approved. If it was already approved, then she might nothing to worry about, it would never been gone to Manila if his fiancee is not yet cleared here in the USA. Before an application approve they do a background check here.

What she need , are those identification that her fiancee was been submitted in their applications. If possible she must all the copies.

Yes it could be possible that this might be part of the question during the enterview. If it is true that his changing of name has no problem...I think, you need to know the reason why he changed his name, so that you know how to answer the question just in case. If that reason is acceptable , maybe you will be good.

Your fiancee must make sure that her birth certificate had already been corrected at NSO. If i were you, advice her to follow on what is the correct written name in her birth certificate.

In my case, my school record and government record shows that my name was " Maria " , (i was using Maria since birth) When hubby applied for my K1 visa, i found out that my birth certificate wrote as " Marian". I asked advice to a lawyer, he advice me to just follow on what is the correct name in my birth certificate. I dont like to changed my name so i went to our local civil registrar and asked advice also, they told me i can use the name "Maria" but i need to file for a change of name for correction. And a name to be corrected , will take a long process and a lot of money. It should be published for six months or a year before it all done.

So, what i did i just follow on what is written in my live birth... and it worked so smoothly. Since your fiancee telling you that her new name has no problem, i think it was already corrected. So maybe she is good.

She is free to marry you illegaly if her previous husband is not concern or interested in their marriage anymore, but you cannot bring her to USA. She need a clearance in her first marriage at NSO.

W2 is what you need it. All they want is the verification of the income of your fiancee and that papers tells how much is his income for the whole year. Good luck.

I dont think it is an harrashment... i understand employees are just doing their job well. They have rules and policy to be followed being an employees , It is for our own good and safe boarding. Dont worry, as long as you know your rights and privilige , you can complain if you are being harrash. Im sure , nobody in the airport employees would like to lost their job.

Yes, kids can skip the seminar, they are not require to attend. CFO topic is for adult people who are married or going to marry a foriegners. Let your fiancee attend without the kids. she will be fine.

PAL business class is quite expensive , ofcourse it depends every time of the year. I bought ticket last July , 2008 and it cost 1,200 (if i remember it right) one way only. It was so nice, seats are wider than the economy class, foods are especial...you can order anything you like. You are more comfortable and got VIP treatment by the stewardees .

During my medical examination i checked in at " Pearl Manila Hotel" just a walking distance to St Lukes and US embassy. Breakfast is free, with wi fi, complete bathroom accessories, with music lounge bar, swimming pool , rooms are clean , with securities too and only 50 dollar per night.

Your girlfriend can get certification of singleness from NSO office .... certificate of no marriage or CENOMAR. You can order it by just calling at NSO or get it personally. I suggest not to mention that she is getting passport for fiance visa since the DFA will not allow your girlfriend application without the CFO certificate seminar first. She can filled up the form by stating for future travel purposes (outside country).

If she never been married a CENOMAR will do. Good luck to your girlfriend visa journey.

month due to my monthly visit but only 1 or 2 and they vanished in just a lil bit of 2 or 3days.Am not so sure why all of a sudden it appears on my face and i been suffering

from it for a lil bit over of two weeks.I tried Pro-Active but it seems to get worse,so i quit and start using the Maxipeel i regulary use in the Philippines.I happened to see at the

Filipino store iwhere i usually shop for Fil goodies.Why the breakout?is there anyone here suffered same thing as me?I'm dying to get rid of this red spots on my face and chin

Just like you i suffered acne since i came here. I do not know exactly what the causes of my acne...but i have a feeling that it is maybe of the foods that i ate( fatty foods) I tried different creams like clearasil, benzoyl peroxide, i even tried also tea tree oil for acne but it did not work. So my hubby decided to see me a doctor , he do not like seeing me having big red spots down on my face.

My doctor give me a cream, differin (adapalene gel) and anti-biotic for 10 days. Thanks God... gradually my red spots is gone.
