  1. Hi everybody,

I would like to travel to Germany for 2 weeks in January. I have a pending AOS Application, my case was transferred to California on 09/28/2009 which means that I mostlikely won´t have an interview in order to get approved for my green card.

My question is : Can I return to the US with using my AP even my greencard was approved while I was in Germany ?

Btw: I filed my AOS before my I-94 expired

    I appriciate any advice

  2. Hi everyone,

We have sent our AOS (I-485 +I-765) on 08/29/2009 by USPS and USPS said that the package already come to Chicago lockbox. Could anyone please so kind to let me know when they will send NOA for us because it has been one week we not yet received that if they get the pacakage or not, i am a little bit worried...

thank you so much for your kindness,

    Huong

Us too! We mailed ours on 8/31 and got confirmation from usps that they delivered it on 09/01. I might be a bit anxious but they still haven't cashed our check yet. So am I just a bit too anxious?!?! I am assuming it might be due to Labor Day so a bit of a delay there???

    Thanks!!!

Hi, I guess you´re right, its delayed because of the long labor day weekend...we filed our AOS on 08/31 and jut got the confirmation card from USPS back that our case was delivered on 09/02....they didn´t cash the check either....so I think I will wait another 7 or 10 days before I start getting worried.....

  3. I can´t believe that you didn´t know about the K1-Visa rules...I mean once you decide to get married to a USC and starting the Visa-Process don´t you try to get all kind of information to make sure that everything works out ? And to know that you are only able to marry the Petitioner and have to file for AOS before your visa expires is BASIC-KNOWLEDGE !!!

And by the way..its so easy to get all information....VJ or the website of the US-Embassy in your country...that works very well

But now you will need a really really good lawyer to get you out of this mess......good luck

  4. In my opinion a marriage has a lot to do with responsibility for each other and this includes besides a lot of love financial stability as well...

I agree that love is the most important thing, but love won´t pay your rent and won´t fill your fridge....

when I read all this posts on the vj-website I´m sometimes really surprised how many aliens giving up their existence to go to the US even the USC does not meet the income requirements...I mean wouldn´t it be more clever for the USC to move to the aliens country ?... or is everything about to come to the US ? ....

In my case I give up a well paid und certain job, a great appartement, I give up the chance to see my family and friends when ever I want....that´s a big deal for me....and if I imagine I would do all that with the knowing that we can´t live or hardly live from the money he makes or has....

even my fiance is making well over the poverty line and we have good savings I´m a little concernd....well....we will live in NYC !....so, how people who don´t meet the requirements and need a co-sponsor can deal with that ? I guess I will never understand this...

P.S. I´m also surprised how many people especially in this topic can´t take any critical comments ....

  5. Is the USA still the promised land ???

...well it depends on your expectations...I´m about to move to the us (my k1-Interview is in two days) because I decided for the man (USC) I love and it is easier for me to move over there than for him coming here since he doesn´t speak my language and probably won´t be able to find a job here in his profession... I dont go there because it might be promised land...

actually I gotta confess that i´m a little bit scared of the future in the us, because of the economy crisis...I´m from Germany, I have a well paid and secure bankingjob, a great appartement and don´t need to be worried about health care...so and now I´ll move to new york city....where the rents and the costs of living are extraordinary high and the last thing they need is another banker....so I won´t find a job in my profession....

Right now, I fell like I give up the land of "milk an honey" for moving to my fiance who fortunately has a relatively good income with a really good health plan. ...we can survive without a second income...but anyway I wanna and probably gotta find a job (any job !!!) as soon as i´m legally able to work..

I never questioned myself if the US is the promised land ...I go there because the man I love lives there ...and if he would live at the end of the world, I would go there...

  6. Hi everybody,

its a little bit complicated: my fiance (USC) works for a real estate company which is one of two owners of a commercial building in NYC...so he got the necessary employment letter from this company A which he signed the contract with years ago...but the paystubs and in his tax return as well showing the name of the second owner of this builing (Company B)...so which employer should be named in the I-134....we took the one which gave my fiance the employment letter...but is this right or should we put both companies in..?....need quick advice ...my interview is in 19 days

    thanks a lot

I am going to make this more simple..and more complicated all at the same time.

If he is claiming income from both companies, he needs to list both companies. You cannot say "I make $100,000" then show proof of income for $50,000 and expect the consulate to use their fertile imagination to justify the rest (they do not have imaginations).

But here is where it gets more complicated. He is filing a tax return, yes? He has w-2s, yes? Or no? If he has a w-2 from each company then your question is unnecessary, you already knew the answer. But if he doesn't have w-2s (and I suspect he does not given the job description you supply, and my experience with commercial real esate concerns) then he has 1099's and is in fact "self employed".

Which really makes no difference except how you answer the question and what counts for income. If self employed it will be what is listed on line 22 of the Federal 1040 form. Attach his schedule C in addition to the 1099s.

No his not self-employed.and he also has only one job...the employment letter shows the same salary as his tax return and of course his paystubs...I think it´s like this....company A (employs him and company B does the payroll...both companies are owners of Rockefeller Center (that´s where he´s working) ....even he can´t explain me this....so I think we do 3 versions of the Affidavit: 1. Employer is company A

    2. Employer is Company B

    3. Employer are A+B

so after I tried to explain this at the interview they can decide what they wanna have...that drives me nuts....

  8. when do you plan to get married? your timeline doesn't add up.

We got married in Queens, and didn't have a social security at the time.

    1) You need to go there and get a marriage license then you can come back 24hours later to get married,

    2) the license is valid for 60 days so you can come back and do the marriage certificate anytime before the 60 days window.

Getting Married in New York City

The Marriage License, By Normal Rockwell

How To Get Your Wedding License

If you are getting married in New York City you can obtain your marriage license in any of the city clerk's borough offices. You do not need an appointment, but both bride and groom must appear together to get the license.

Some thing you need to know about obtaining your liscense:

    * The license is valid throughout the state. For example, you can get your license in Manhattan and get married in Queens -- or in Albany for that matter.

    * The license is prepared while you are in the clerks office, but there is a TWENTY FOUR HOUR WAITING PERIOD before you can marry. So be sure to include that timing in your plans if your are coming in from out of town to be wed. The license remains valid for 60 Days.

    * The fee is $30.00????? call the number listed below to check for the exact fees , and only money orders are accepted. Make M.O. payable to City Clerk.

    * You must have identification that prooves your age. Acceptable ID can include: birth certificate, baptismal certificate, passport, driver's license, green card, military identification.

    * If divorced you must provide the month, day and year your marriage(s) ended and who the deffendant was. In the Manhattan clerks office it is "suggested" you bring the divorce papers with you; in other parts of New York it is mandatory.

    * Blood tests and medical exams no longer required in NY.

You can obtain your license in the following clerks office. They are generally open between 9 am and 4 pm Monday through Friday, and some offices take a break for lunch at 11:30 until 1 pm. Please call first.

IN MANHATTAN: Manhattn Municipal Building, 1 Centre Street, (212) 669-2400.

IN QUEENS: Queens Borough Hall, 120-55 Queens Boulevard, Kew Gardens,(718) 286-2829.

    IN THE BRONX: 1780 Grand Concourse,(718) 731-2277.

    IN BROOKLYN: 210 Joralemon Street, (718) 802-3585.

IN STATEN ISLAND: Staten Island VBorough Hall, 10 Richmond Terrace, (718) 816-2290.

    Hey many thanks for that....

We plan our wedding for August 21, 2009 and I was a little bit concerned that I couldn´t get my SSN on time (arrrival in the US: July 22 !) ....I will live in Queens as well but they recently opened the new renovated marriage bureau in Manhatten, so we wanna get married there....

As I learnend now I don´t need a SSN that´s good news, so thanks again !

  9. Hi everybody,

I hope anybody can help me...once I receive my K1-Visa (hopefully in May) I´d like to send my household stuff via mail (with DHL) to the US...has anybody an idea which forms for the US-Customs I will need ?...do I have to put every single item on the inventory list...and do I need to attach a copy of my passport/visa to proof that I´m moving to the US ?...I plan to send my belongings by the end of June, I will move likely on July 22...

    Thanks in advance

I was reading about it somewhere on the internet, cant remember exactly where but i will try and find the site again and get back to you, unless someone else can tell you quicker. Would you mind telling me how much DHL charges?

Hi...I can tell only how much the fee is sending it from Germany: up to 10 Kg= 42 EUR

    up to 20 Kg = 62 EUR

its a lot of money..but taking all your stuff with you on the flight is more expensive and quiet uncomfortable
