    No, I have not been working. I only received my EAD a couple of weeks ago.

    Unemployment is only available (for a limited time) if you where recently employed.

    No, I have not been working. I only received my EAD a couple of weeks ago.

    Unemployment benefits are financed by unemployment insurance taxes payed by your employer. You have not yet held a job in the U.S. so you certainly do not qualify for unemployment.

  2. Quick summary: Entered the U.S. on a K1 visa in March of this year, hubby and I got married in May, filed for AOS in June, received EAD in July, been applying like crazy since.

    Now, hubby has lost his job and is looking into getting unemployment benefit until he can find something else, which has raised the question for us whether or not I am eligible to apply for unemployment benefit as well.

  3. Thank you very much for your reply. I just tried to use the infopass, am I understanding it correctly that you have to be a paying member of the USCIS to be able to use it?

    Nvm, I saw what I was doing wrong. I got an appointment with the USCIS but it is two weeks from now. My aunt will be long dead by then. Do you think I can just show up there on Monday without an appointment if I explain to them that I really need to go quickly? Thank you once again.

    Thanks so much. I apologize if this question has been asked before. I tried looking in the forums but it was so confusing.

    To get AP approved, you don't really need any 'good' reason - you simply state the nature of the travel and thats it - normally it would take anywhere from 30-90 days to get approved. That's not what you're asking though.

    What you would be wanting (presumably) is some sort of expedited/emergency AP - you would do this by making an infopass appointment. In order to prove the emergency you would need some sort of proof - doctor's notes help a lot here (you can't just show up asking for emergency AP and not be asked to prove it).

    Bring the proof along with your completed I-131 and it is very likely you would leave the appointment with the AP (or it would arrive shortly thereafter).

  5. I just found out that my aunt is dying and I want to fly back to see her before that happens, or at least to go to her funeral. How long will it take me to get Advanced Parole and does the expected death of an aunt count as acceptable reason for traveling? I came into the US on a K1 visa and got married in May. I applied for AOS in early June and have since received notice of action for the AOS and my EAD.

    You may use either one - if you plan to be known as your married name, it is best to use the married name on the AOS/EAD forms (so you don't have to go through the trouble of changing the name later). :thumbs:

I read in the instructions for the application that K1 visa holders do not need to send an entire medical examination again, but just a "vaccination supplement". Does that mean I have to copy the one from the old report (from when I filed the 1-129F) or do I have to go to the doctor again to get a new one?

There is U.S. customs on the airport in Aruba, makes it easier for tourists to have pre-clearance there, and that is where they checked my visa when I traveled to the U.S. I came in on a fiance visa. Now I am preparing to file for adjustment of status and I have to fill in my POE, would that be Aruba or Miami (which is the first place we landed)???

    Your point of entry is the place where US customs checked your passport ,visa and stamped your entry to the US.

  13. Netherland's is an oddity... the request MUST come from the US consulate

    Police Records

    Available. Police records can only be requested for immigrant visa applicants by the United States Consulate or Embassy where the applicant's case is being processed. Any certificate presented directly by applicants cannot be accepted. To request a police record, the visa processing post should send an email to the Consulate General in Amsterdam at ImmigrantVisasAMS@state.gov. The request must include:

    Applicant's full name(s) including aliases:

    Date, city/town and country of birth;

    Complete address of last residence in The Netherlands.

    The Consulate General in Amsterdam may need up to 15 working days to obtain the certificate, provided there is no derogatory information concerning the applicant. If there is derogatory information it may take up to five weeks.

    The certificate, which is in the Dutch language, covers criminal investigations only. Criminal records are expunged after a number of years, depending on the offense, following termination of the case (i.e., after service of any prison sentence) provided no other offense is committed in the interim. Police records may, therefore, not constitute a full summary of criminal records. Applicants with a criminal history can obtain their own conviction record from the sentencing court.

    These certificates may be used only in processing immigrant visa applications and may not be given to the applicant or to any private individual. The visa applicant may not be informed of the source of any derogatory information contained in the police certificate.

    Thank you so much for making me aware of this information. It turns out the certificate I requested will be ready in time after all, but I notified the Embassy of this information and they said they would also request their own.

    There's a Colombian girl who lived in Aruba for quite a long time as well and she paid someone to help her get her police certificate from there. I think this person, a lawyer, got it for her in 2 weeks I believe, but I'm not sure how difficult it was to get.

    In any case, try to go to contact the embassy and see what they say. This girl did the same thing thinking she won't get it in time and they said not to miss her interview, she didn't cancel and received her certificate before then.

    Thanks Diana. I actually did hire a lawyer to help me get the Police Certificate but ended up having to do everything myself because she never filed the petition for it. Thankfully I had not paid her yet. I don't intend to either.

    I am new here, I hope you can help me. I am an Aruban citizen.

    My American fiance filed an I-129F on my behalf in May. We were approved in September. On September 16th, we received a letter from the NVC saying they would send the application to the Embassy in Caracas within a week and that I would receive a packet with instructions from them. When a month passed and I had not received anything, I emailed the Embassy and received a reply the day after, telling me my appointment for my interview would be 3 weeks later and a whole list of documents I needed to bring with me.

    I have been stressing and running, trying to get everything in order, but I am pretty certain I am not going to get my Police Certificate for the 9 years I lived in the Netherlands in time for the interview. All my other documents are in order.

    Should I email the embassy and let them know? Should I try to reschedule the interview? I have heard that is a bad idea. Or should I just go and explain the situation when I am there? I will have to fly to Venezuela for the interview, so it is not like I can go back easily.
