My cousin is married and he is here on job visa. His parents are US citizen and they want to apply for immigration visa for him.

My cousin was lucked out on immigration visa when his parents came here. He was 6 months over age. He is wondering if he could

use the same uscis receipt number which their parents came on and then try adjustment of status. USCIS has all is information of him

from his parents approval paper, but he couldnt come because he was over age and he is here now on job visa. Can someone answer

this question for him.

My case was complete on 01/08/2009 and it was forwarded to the Madras (Channei) Embassy Today (01/14/2009) and the interview date is on 02/25/2009 and ETA: 03/13/2009 - IAH (Houston)

Well I got approved for both I130 and I129F K-3. My files have been forwarded to NVC. I haven't received any conformation on I130 from NVC, but I got a letter stating that my I129F has been forwarded to the consulate in India. My question is that if my wife should pursue K-3 or wait or I130? I was thinking maybe she should go through the K-3 process and get the visa and just wait of the I130 process to go through. Is is possible or her to do that?

I want her to come here on I130 because she would get the greencard. But I don't want her to loose this opportunity of K-3.

K-3 petition is only valid until march. If NVC delays my I130 then she can come on K-3. If she waits for I130 and not pursue K-3 then the time will expire.

So, my question is basically can she get the K-3 visa approval and wait there for I130 visa?

CJ-G, I understand the K3 processing dates really don't make any sense, but if you look at the I130 processing dates then you can make some sense out of it. It seems that they are working on the I130’s at faster pace or just that they have way too many K-3’s petitions than I130.

These are the processing dates for I130:

June 15 = July 02, 2007

July 15= September 03, 2007

August 15 = September 03, 2007

September 15 = November 26, 2007

October 19 = February 26, 2008

November 19 = February 26, 2008

According to these dates, VSC has processed 240 days of petitions in 157 days.

At this rate, by next update (Dec. 19th) the I130 processing date should be April 11, 2008.

I filed K-3 after I130 so my wife could be he here early, but it seems that I130 is going to be processed before K-3. Actually, that would be better for us. We don’t have to do all that adjustment of status paper work.

this is unreal...i am seeing my congressman's aide friday afternoon to see what the hell is taking them so long if the officer had my files in his hands!!! It will be interesting because the congressman's office offered help given the 6 month processing time that were published. This is getting unbearable for us both. People in India are doubting if our marriage is real!

I actually developed this a friendly relationship with the staff at my congressmen's office. Lucky for me, the office is just down my street.

They spoke to me positively and they said they will do what ever they can to help me out and to look into my case. Lets just hope something good comes out of this.

Guys I have an idea - we should advice the people (US citizens) to join the military if they plan to file for K3. If you are in military then your case is their TOP priority. I spoke to one of the US Army recruiter to find out about this and he confirmed that if I was to join the military then they can take care of my file.

Hi folks, I have already filed my I-129f and waiting on the NOA2. With the initial filing, I sent in lots of proof of ongoing relationship, travel tickets, hotel receipts with both names, etc.

However, my babygirl was just in a motorbike accident and I can't handle it. I have decided to go stay with her in Vietnam until her interview.

My question is this: How do I show proof of ongoing relationship if I am living with her? No phone bills, no emails, no chats ... I can take photos, sure.

1. We mostly eat at the house when I am there, so no restaurant receipts.

2. I stay at her house when I am there and while you CAN file with the police, she never has before and says her local police have been bad about foreigners staying in houses in that area. She says no one ever checks and I can just stay. But then we have no police documentation either and no hotel receipts.

I know many of you will say, file with the police anyway to get the document but she is very afraid I won't be able to stay with her. If she won't do this, is there any other way for me to show proof that I was with her for a few months? (aside from my plane ticket to Vietnam and passport stamps?)

Any creative ideas would be great right now!

Dude I am pretty sure that you can go with her to the interview. Just take you ticket, passport and yourself as proof. Just take you wifes accident report of medical bill. Actually, you being there will help the case and not hurt it.

my mom talked to him today cuz i was just to much of a basket case about all of this... i have misjudged him i believe....after he talked and told us everything he has been doing to try to get our case resolved he offered to give me my money back if i was not satisfied with his service so.........im saying it now i misjudged him i feel that he is doing the best he can given the circumstances.........csc is nothing nice to deal with and just that offer to refund us my money that i paid him shows me that he is honest .........he was very kind when talking and very through ...i guess i just needed it laid out for me so i could understand all the steps he has taken so Cal will stay our attorney i feel better and more at ease

well my lawyer is working on my case too. She made my case her priority, but I know that doesn't mean anything. She can work on the case is there is something wrong with it. If the case is still within the processing time then she can not do anything. She is trying to push some buttons here and there with her contacts and that is something the lawyer can only do. Anyway, I am happy with my lawyer.

Regardless of what the processing times say on the USCIS website, we all know it is running about 5 months to receive the NOA2 from the time the NOA1 is processed. So no point in really worrying about things until those 5 months have passed, not much else we can do, and other people have managed to wait that long. Soon it will be our turn.

I just becomes hard if the dates don't change. It's really hard for me. My wife is on the other side of the world. The time difference is 11.30 hrs. When i am up she is sleeping and when she is up I am ready to go to bed. Sometimes is hard to manage financial too.

My waiting time:

I130 - 278 Days = 9.26 months

I129 - 252 Days = 8.40

New processing dates are posted. This is really pathetic!!!

I129F - date is now(7th Mar. 2008)

I don't rust these date, but here must be some reality to it.

If you call then now they are going to tell you to wait extra 30 working days.

Next week is thanksgiving and I am sure they have couple of days off and after that basically they are going to be more laid back because the holiday season is approaching.

This is not to discouraged anyone, but there nothing we could do. If you guys have any positive news regrading this then please share it with us.

I went to my congressmen and spoke to the people over there. It seems that they are very familiar with this situation and they said they will look into my case.

I don't hate anyone, but i would like to advice people to not to add a lot of their picture on the response. That doesn't mean that they are not good looking or anything, but its hard to read messages and i have to flip through pages to find a decent message. I am sure that i have lost a lot of decent, important, my case related messages because of those long timelines and those multiple personal pictures.

I was driving 5mph at school and there are two young boys students on my path so I stopped for them. They crossed the two way street. Unexpectedly, one of the two boys is keep coming back and forth on my path, so I have to stopped. Everytime I roll, he come back again zigzagging on my path again and I stopped again. I watched and starred at him, when he look at me he just smilling at me. On the otherhand a lot of students watching him and his classmates were shouting at him "What are you doing?!?! You wanna get killed?!?!

If this happen to you what would you do?

1.) Report him to the school principal where he study? or

2.)Just forget about it?

I currently am being represented by a lawyer. After a lot of thought, and learning a ton from VJ, I realize that I may be better off going through this process on my own. There is only so much the lawyer can do. If I decide to do this on my own, what do I need to do as far as the immigration process is concerned? What kind of paperwork would I have to provide? Would there be any detrimental effect on the immigration process. I am currently waiting for NOA2 from VSC. The lawyer is the designated as our agent via G-28.

Well, i don't know why you are so worried. Just look at timelines and see that a lot of people are in you situation.

About the lawyer: I have a lawyer are she is doing whatever she could to find info for me. It all depends on what kind of a lawyer you have. My I130 date is 02/24/08 and I129 is 03/11/08 and i haven't heard from USCIS. My lawyer is using AILA's (www.aila.org) liaisons to find out information for me. The thing with the lawyer is that if in case something goes wrong then you can blame them. Well i know some lawyers are jerk, but i am happy with my lawyer.

Just have patience bro - everything is going to be fine. If you change lawyers then I am sure you will have more problems. The new lawyer is always going to say that the previous lawyer made mistakes. And if you really think your lawyer is not doing anything then change the lawyer because once the time is gone you can never get it back.
