  1. Did you send I-130 and I-485 to gether to the Chicago PO box??? Do not respond to NVC unless you plan on doing an immigrant visa interview in your home country.

    Yes I did send both to USCIS Chicago PO Box 805887. Ahhhh now I am confused :( I read the guidelines for NVC on VJ after my i130 was approved so I reply to the DS 3032 already. Did I mess everything up?what should I do now?

    Contact NVC and tell them about your pending AOS. USCIS should recall the file from NVC when they start processing the I-485.

    I received a letter from USCIS with my I-130 Approved and as I expected, NATIONAL VISA CENTER sent me a letter with DS-3032 form which I filed and already mailed to NVC.

    My husband also received a letter that same day from NVC regarding an Affidavit of Support Processing Bill FEE (USD 70.00) we were ready to go on line and pay when we noticed under "IMPORTANT NOTES" the following statement:

    quote"1.If the applicant inteds to adjust status with the U.S. Citizenship and Inmigration Services (USCIS), please contact the NVC before making any payments or taking further action."unquote

    Since I married my husband while I was under a tourist visa, we sent both form 1-130-Inmigrant Petition for Relative, Fiance or Orphan and I-485- Applicantion to Register Permanent Residence or Adjustment of Status.(which by the way, I have not received a NOA although USCIS cashed the check 10 days after receiving it).

    So my question

    1. Do we need to pay the AOS usd 70.00 or not? It looks like a contradiction to me. We called today and for some reason the answering machine states that they do not work today. I am very stressed out about it.

    2.Do you belive that not receiving a NOA yet from the I-485 has something to do with it? When we called USCIS it say may take 4 -6 months before we receive any comunication, but I check and some people have received it in 45 days :( Should I worry?

    I married on November 8th last year and filed the I-130 and I-485 and received a NOA for the I-130 on December 2nd and a Rejection Notice for the I-485 basically because we did not know we should send the I-130 first and then once we got the NOA for it then we could send the I-485. And so we sent the I-485 again at the very next day December 3th via Express US MAIL at the same address and we have not heard from them and is February, not even a NOA.Nothing.

    Should I be worry? Is there something I can do? This situation is in my mind all the time. I even blame my husband because he did not send it via courier like I ask, does it really matter?

    I would appreciate your comments,

    Sorry for your situation. I sent my AOS package via USPS Express mail, so I do not think it matter if you use USPS or courier. Did you check the tracking number and confirme whether your package was delivered?

    Also, did the check or money order for I-485 has already cashed? If the check/money order was already cashed, it might mean NOA for I-485 was sent but lost. If the check/money order has not cashed yet, it is possible I-485 was lost or somebody is still holding the package without opening it.

    When you resent I-485, did you attach I-130's NOA or at least wrote down the case number of I-130 in your cover letter to I-485 so that USCIS can know your I-130 and I-485 are for the same matter?

    Hope you can receive NOA soon. But if not, it might be better to call 800 number or make info pass appointment and find out what is going on.

    Thanks for your answer, I just check with my husband and yes USCIS cashed the check pretty much a few days after receiving the package, so its been like 45 days is that a reasonable amount of time? We will make the call on monday, thank you.

    Hi there!! I am from Peru too, to bad we live so far apart, I am currently waiting NOA for the I-485 I did not enter on a K1 visa. Have you ever made a Infopass appointment?

  7. we just received a letter from USCIS (form I-797C) stating that there is an error on the application,...."Invalid Part 2 Application Type Other Basis of Eligibility", in which section we had chosen.....H. Other Basis of eligibility.....I am a spouse to an American citizen. What should i be choosing if that is not the correct basis

    What i forgot to mention is that I entered on a visitor visa and not a fiancee visa. I don't know what option would apply to me. Thank you very much for your help. we know 2 other couples that entered as visitors and got married before it expired, and they chose the same option on part 2, with the same explanation. i am really unsure of what i should put, no other option offered applies to me. Thank you again for all your help.

  8. Hello everyone: I hope you can help me out:

    Today my husband and I went to the bank ( Regions Bank) to open a joint account since is one of the proofs required in the forms but they requested me a goverment issued ID , I told him I only had my passport so he suggested that we go to the Department of Licensing where I could apply for a non-driver license id but once we were there we noticed a big poster showing that effictive July 1,2005 to request any document I must show up a Proof of Lawful Presence , Proof of Identity or Proof of Residency, and obviously I have none ,anyways, the only thing I can think we can do right now is to print the bank policy wich we found on the web and the sign that we saw at the Department of Licensing and attached them to the papperwork. Do you think is a good idea? or should we just not send them.
