  3. Just got back yesterday. Had a wonderful trip meeting Lourdelie for the first time in person. Only down side was the air pollution. Even though I couldn't catch a breath of fresh air, I would have liked to stay longer than I could.

    Working on the I-129F paperwork now. Checking and double checking and triple checking. Hope to mail by Tuesday and not get a RFE. :D

    When I left there in the PI last July 16 2010, I flew w/ Delta too, eventhough I travelled to HongKong one time to picked it up my husband there and flew back to the PI, I felt nervous still when I think I'm going all alone to the US but I did it well...BTW, my flight was Davao-Manila-Japan-Detroit-Tampa and I have no $$$$ in my wallet that time coz I don't want too hehe only pesos but it's better you'll bring lil bit extra of $.Wear comfortale lol. :)

    So,do you mean ,you are not required to file a tax report where you did not make money?

    sorry in this context AOS = Affadavit of Support, if you did not earn above a certain amount you do not need to file taxes thats correct please read my third post

    per AFM HQRPM 70/21.1 you need only file the most recent tax return not the last three years

    "The sponsor must submit with the Form I-864 the sponsors U.S. Federal income tax return for the most recent tax year (that is, the completed tax year immediately preceding the date the sponsor signs the Form I-864). USCIS may generally expect a sponsor, after April 15 of any given year (or April 16 or 17, in a year in which April 15 is on a Saturday or Sunday), to have completed his or her tax return for the previous year. If the sponsor requested an extension, the sponsor should provide proof of filing for the extension. If the sponsor did not file a tax return, the sponsor must prove that he or she was not required to file. If a sponsor should have filed, the sponsor must file retroactively and provide proof of filing. Note that U.S. citizens generally have an obligation to file a tax return on non-U.S. earnings even if there was no tax liability.

    Regarding domicile also per HQRPM 70/21.1 AFM

    "If the sponsor is not domiciled in the United States, the sponsor can still sign and submit a Form I-864 so long as the sponsor satisfies the Department of State officer, immigration officer, or immigration judge, by a preponderance of the evidence, that the sponsor will establish a domicile in the United States on or before the date of the principal intending immigrants admission or adjustment of status. The intending immigrant will be inadmissible under section 212(a)(4) of the Act, and the intending immigrants application for admission or adjustment of status must be denied, if the sponsor has not, in fact, established a domicile in the United States on or before the date of the decision on the principal application for admission at a U.S. port of entry on an immigrant visa or adjustment of status"

    My wife is the US C and I am the beneficiary. We are married happily. We intend to relocate to the USA.She has not been filling her Federal Taxes as a mandatory requirement with regards to Affidavit of Support, and has not been living in the USA for quite a long time thus,no voting records,no US drivers license, and what not.My request are: Can she file the past Taxes prior my application for Visa? Though she started working in South Africa recently.Her mother is a South African, so she has dual citizenship.She did not feel obliged to file her US TAXES.Are there any waiver?

    I need your insight as experience being the best teacher so let your experience be my utmost guide.

    I agree with the penguin however, whats the need to file ? for the AOS ? she won't be able to sponsor your support anyway unless she has a job offer in the US so what she made in income really doesnt matter just deny having income if she didn't make money then she didnt need to file a tax report

  10. Oh - got it - the final nail in this coffin -

    Work Visas for Nurses - that program is all but stopped now. She has intent to work in USA as Nurse, getting married to USC is a 'way' around the ' Nurse work visa program'.

    The 'Nurse Work Visa Program' is on hold, or stopped, in USA. She'd have better chance to UK or Australia, currently, for a 'visiting nurse' work permit, as UK and OZ are still issuing them.

    Yes Darnell through the USCIS the program is on hold however through the Filipino Nurses Association a visa is a piece of cake compared to going through a CR/IR employers are more then willing to contract eligible nurses here in the US

    Just something not right here with this thread hmmmm :unsure:

    Are you from Davao City or Tagum? I am from Davao City. We are currently living in NY but looking to move to Cape Coral/Fort Myers area next year. We have been looking at quite a few houses and will probably be travelling there between September or October to buy a house.

  12. We hae a big FIL-AM group here composed of couples from Ocala, Williston, Beverly Hills, Inverness which are part of Central Florida....we do get together a lot. A nice group with no issues at all :)

  13. We are considering relocating next year to Florida. What area of Florida? It can take 12 hours to drive from top of Florida to the bottom.

    Are you West Coast Or East Coast, Panhandle or Southern Part. Are you close to DisneyWorld?

    We are west central - 50 miles east of Sarasota and 50 miles north of Fort Myers close to Port Charlotte/Punta Gorda area we are about 2.5 hours south of Disney ;)

    Go on Trulia.com and look for homes i ther Port Charlotte area you will be surprised what you can buy for 50 - 75 K

  14. Are you saying that if I send something via FedEx from the US to PH then it never passes through the hands of an Air21 Employee?

    What I am saying is, a package sent from the US is afforded the tools IE. tracking ability, and is held to a higher standard in terms of responsibility by FED EX not AIR21 so if anything is lost it is resolved by Fed EX not AIR21 who could care less I have shipped with both companies and I have never and I mean never had an issue shipping from the US to Tagum City, it has always been timely and usually ahead of schedule and I have used them maybe 30 - 40 packages

  15. One thing to keep in mind is that FedEx uses Air21 in the Philippines whereas DHL has it's own employees there. I have shipped things to the Philippines using FedEx, UPS & DHL. Using UPS & DHL there were issues with PH Customs wanting to over-charge me on the tariffs. Only DHL helped me and reduced the tariff from 12,000Php to less than 600Php!

    I'll never ship anything to the PH using another carrier....

    Correction Bob, FED EX Philippines is owned by AIR21 (MAIL&MORE), FED EX shipping from overseas is FED EX two seperate companies differant offices differant uniforms, differant tracking management tools differant everything !
