  1. I don't think the custom agent will accept PO BoxThey will ask, in regard to your visa about to expires, but it would not cause any issues as long as you explain the reasons. You can change your last name anytime at your local SS office with your marriage certificate. I am not sure if you can do that at the POE.

Thanks KoJ. Any more opinion and info from other members please?

  2. You mean if they issued visa on 01/31/13 and you had medical exam on 01/15/13, your visa would be good until 07/15/13? (for example).

But I heard medical exam is good for 1 year?

Yes, that's right. Believe me, I just had interview few months ago. My visa was issued on 12/6/2012, my medical exam dated 11/8/2012. And my visa expires on 5/7/2013.

  3. Hi,

My husband just moved to TX this April, and he is still in search of apartment now. Therefore, we do not have a physical address yet. He will rent a mailbox at the post office until we move into the new apartment. I will arrive in TX on May 3, my POE is IAH. I know that I need to notice CBP officer about the change of address. But does my husband need to do the Change of Address on USCIS website?

My visa expires on May 7. Due to my family issues and my husband's relocation, I cannot come to the US earlier. Is there any troubles when my arrival is too close to the expiration date? Will they ask the reason for that?

Also, we got married in Vietnam. My husband wants me to take his last name when I come there. Can I notice the officer at the airport about the desired name change on SS card and green card? If not, what do I need to do to change to my husband's last name?

    Thanks a lot.

  4. My friend is preparing for AOS now. She came to the doctor and had everything (blood test, vaccination record, chest x-ray) done. Since she's from Vietnam, her TB skin test is positive. She had to have chest x-ray after that, and it is negative. According to USCIS instructions, you are recommended but not required to have TB treatment for 9 months if your TB skin test is positive and your chest x-ray is negative. But the doctor insists to send her to TB center and have treatment for 9 months (take 1 pill every month). Doctor said she will sign form I-693 after my friend takes the 1st pill. But my friend denied to do so because she is healthy, and she is afraid of the side effect. The doctor then denied to sign the form.

My friend called USCIS and she is told that she is not required to follow the treatment. So in this case, does the doctor have right to force my friend follow the treatment plan while it is just recommended, not required? And can my friend bring the blood test, vaccination record, and x-ray to another designated civil surgeon for him/her to complete the form?

    Thanks for your help.

  5. Congratulations!!!!!! Sweet Apple Happy holiday to u guys too. Mine interview will be on December 20th hope I'll get the Pink too guys hehehe

oh yeah 1 question pls. did u guy prepare the timeline and did they ask for it???

Thanks and Happy Holiday to you too. I submitted our timeline when we sent the petition to USCIS already so I dont bring it to the interview. Dont worry if you didnt submit it because they do not ask for it. You can bring it to the interview and give to the Vietnamese staff who checks your documents before the interview.

  6. I recently discovered this website and would like to get some advice and opinions on my situation especially dealing with red flags and what steps I should take.

I brought my previous wife from Canada into the US in 1999 under the K1 visa using an immigration lawyer and everything was pretty easy. Unfortunately the thought of divorce came to my mind within the past few years. This past summer, I had an opportunity to stay in Vietnam for about three months so I went over there by myself to think about my life. Within the first few week, I decided that I wanted a divorce and told some of my friends, but I decided that I would wait until I get back to the US to tell my wife face to face. During my stay in Vietnam, I met a girl and we went spent a lot of time together for a few weeks but I didn't tell her that I was still married because I was already planning the divorce. I came back to the US and told my wife that I wanted a divorce and I proceeded with the paperwork and separation. I continued to talk to girl in Vietnam everyday and did end up telling her that I was married and that I was going through a divorce. She was not happy with me and I can't blame her. I had to forward her an e-mail that I sent to a friend stating that I was planning a divorce to prove that she was not the reason for the divorce. The e-mail was sent about two months before I even met her. So we continue to chat, talk, IM and Skype everyday. She even met my dad and some of my relatives in HCMC. She does have an aunt that lives in the US, but I have never spoken or met her. I have sent her gifts and money over the past few months. My divorce was finalized last week and I am planning to go back to Vietnam at the end of February. We have even been talking about having an engagement ceremony and a trip to Thailand together. And when I come back to the US, I was planning to start the K1 visa process.

So the obvious red flags are that I have done the K1 visa before with a Canadian citizen and that I just got a divorce. How much of an issue will it be that I met my girlfriend when I was still marry? My ex-wife does not know about her so I am also concern about my ex being contacted by immigration and her causing problems during the K1 process. At the same time, my ex would be even more devastated that I am moving on with my life so quickly so I prefer not to tell her now.

Should I prepare or bring over anything on my next trip to Vietnam to prepare for the K1? Should I not even proceed with the paperwork until after the second trip and the engagement ceremony? We don't have much evidence of us together in Vietnam from my previous trip because we were just having fun and had no thoughts of things being serious. I only have my airline boarding pass and I can print out some credit card statements showing hotel and some purchases. But I paid mostly in cash and there is only one picture of us together even though we saw each other everyday for almost three weeks. I also stayed at my dad's houses, but I never registered so I am not sure if that will be an issue during the K1 process.

I contacted my previous immigration lawyer and was told that I shouldn't be too concern about my red flags. Of course, it would also cost me $4500 if I were to hire them again. So I am wondering if I need them or am I better off hiring an immigration lawyer in HCMC who is more familiar with the system and probably a lot less expensive. By the way, I am a Viet Kieu who is a naturalized US citizen that was raised in the US to the point that I am really an American and just look Vietnamese. It's a good thing that my girlfriend knows enough English to read what I type and my broken Vietnamese is enough where we can talk to each other.

As mention, opinions and advice are welcome.

My husband sponsored another Viet girl in 2005 and divorced in 2007. I met him in 2007 and we got married in 2010 after he made 3 trips to Vietnam. I think you shouldnt do anything on and after 2nd trip yet. You should just file the petition after 3rd trip. For the attorney, I highly recommend Marc Ellis, he bases in Saigon. He is well known on this website. I hired him and he charged me $1500. But the fee varies by cases. You should just contact him for consultation and fee. He charged $100 for 1 hour consultation.

  7. I had interview on 12/4 and got pink. The interview was so easy and so fast, just about 10 minutes. You guys can view my other topic for our case's background.

    http://www.visajourney.com/forums/topic/394141-2-years-since-last-visit-does-it-cause-refusal/page__p__5789705__fromsearch__1#entry5789705

I really didnt expect a pink. And my husband does not come back for my interview. When I came to the window, I put all my evidences on the counter. They were shocked when they see that lol. They interview me in English because my husband is American.

    - How and when did you guys meet? (Myspace.com)

    - How could he find you? Did he know you through mutual friends? (I said Myspace does not show mutual friend like facebook, he searched around and saw me)

    - Why did he send friend request to you?

    - When was your first meet? (it was 10 months after we knew each other online. The CO said you guys know each other quite well before you meet. I said yes)

    - How many trips does he make? (After my answer, he said we meet once every year, I said yes)

    - How do you contact each other and how often?

    - What time is it in the US now?

    - How long have you been married?

    - What is his job? How long has he worked there? Does he work for any owner or company?

    - Does he speak Vietnamese? (I said just a little bit and bad words. They laughed)

    - When was the last time you met him? (I said Jan 2011, he repeated Jan 2011? I said yes and explained that husband had car accident, I asked if he wanna see pictures of the car after accident and letter from doctor. He said he wanna see the pix. I paepared pix of the car before and after accident. The CO looked at the pix and ask How was the accident? What is his injury? Is he better now? I said better but still need therapy, and asked if he wants the letter from doctor but he said No)

    - The CO said that I have a lot of evidences and pix, dont need to give all, just give them my favorite pix. I gave him the pix of our casual marriage announcement party, pix of us signed the marriage certificate. He looked at the pix and didnt ask anything. I think because I labeled them already. Then I gave him pix of us with a famous Vietnamese singer and told him she is my husband's idol. They laughed :)

After that the Vietnamese translator told me to take back all of my evidences. Then they said I was approved.

I really was surprised a lot. I didnt think it was that easy. They didnt ask any questions regarding our red flags or any questions about our friends, our family members, and didnt want to see a lot of evidences. I think it is because our petition was prepared very well. Our files to USCIS weighed 3 kilos lol. Marc front-loaded our petition with all the evidences and documents I have, he wrote letter to explain our red flags (no wedding, and my husband's previous petition). I asked my husband to write statement of relationship of him and his ex-wife, also of him and I.

  8. Just called the NVC and they said that next week they will be scheduling interview dates for December. Though, seeing that sweetapple already got an interview date, it has already started.

Good luck to everyone waiting for their interview date. I know my wife is very anxious to get hers.

I called and knew my date but I still have not received appointment letter via email yet. They told me they will send later. I know one person who is the same situation as me.

  9. Is it ok to prepare those forms in advance? I thought they do not take those forms at the interview and will ask for submission later. And they asked your wife for chat logs? I plan to give them printscreens of our webcam instead of chat logs.

Congrat on the pink and thanks for sharing

  10. no, she got pink on right away. we had the RFP before the NOA2. We met again before the interview so i think that was another plus for our case. i booked the plane ticket before we even received the RFP for NOA2.

Your case is different than mine. My husband has not come back for almost 2 years after he filed the petition. But anyways, I will tell him to write a letter as you suggest.
