    Why even taking the slightest chances and handing foreign border agents documents that they don't need to see?

    All she needed to enter into Canada is to show was her valid Japanese passport and she would have saved herself a lot of trouble.

    The Green Card is a U.S. document. It is needed to enter the U.S. again when coming back from Canada.

    All of this could have been avoided easily. Never volunteer information when dealing with police or federal agents.

    I had another thought on this idea...

    This sounds good in theory, however...

    Let's say she only hands the Candian border agent her Japanese passport as you suggest. The agent will surely look through it and notice that the passport was last stamped at a U.S. border in 2009. They will know that based on the passport only, she is not allowed to be in the U.S. at all. A Japanese citizen is generally allowed in the U.S. or Canada with a 90 days tourist visa. She would need to show them that she could be allowed back into the U.S. In addition, these agents ask a lot of questions, as you know. It is not easy or advisable to hide information from them.

  2. Hi All,

    My wife is a Japanese citizen with an expired 2-year GC and and NOA letter for the I-751 that we filed in August. She was on her way to Canada yesterday for a holiday and the Canadian border agents would not allow her to cross into Canada based on her expired GC. She went back and forth between the Canadian and US border offices twice. The US agents said she was OK to cross and that her NOA letter was valid for her to leave and re-enter the US. Fortunately we only live a few hours from the border, but it was still quite a shock and a big disappointment.

    Has anyone experienced this before?

    Based on this I would conclude that if you have an expired 2-year GC + NOA letter, you can probably go back to your country of citizenship but you may not be allowed into a country other than that one. Maybe she just encountered the wrong Canadian border agent.

    @Darnell - you're right...actually there are tons of threads about this. I was searching for the wrong strings. Thanks.

    I like the secure credit card option. BOA told her about this option while she was applying for their "un-secure" card (which she was later denied for).

    In the short term, I guess we will have only my name on the mortgage. Not a problem I suppose. She can be added to the title.

    My wife got her green card about 6 months ago. I am wondering what other folks have done to establish credit for their new spouse.

    We are currently searching for a house to buy. During the mortgage pre-approval process I was told that my wife's name could not be added to the mortgage because she did not have any credit history. My wife was also denied a credit card for the same reason.

    We transfered our utility bill to her name thinking that this may help after some time.

    Any other have experience with this issue?

  8. Hello again fellow Japan Filers! Hope you all had a Happy New Year! :)

    We have finally received our NOA2 and I had a few questions regarding the next steps we need to go through. :dance:

    - Can he get his Police Certificate now after receiving NOA2? He just needs a copy of it right?

    -When can we schedule the medical appointment? Can it be done now or do we wait for Packet 3? Are there any forms the doctor needs to fill out from Packet 3?

    - What exactly does Packet 3 contain?

    -There is no packet 4 right? Just an email reply once they receive the Packet 3?

    -Once they receive Packet 3, can we schedule the interview date? Or can we do it earlier?

    I was trying to browse the thread for these answers but I guess it varies depending on the type of visa. Since we are doing K1 visa any answers from a previous K1 filer will be appreciated :star:

    I have combed these forums many times for various information and I usually find Google to be more effective.

    These forums contains some enormously valuable information. I agree, it may take some time to plow through it all, but its worth it.

  10. When in doubt heir on the side of caution...

    I sent 6 passport photos, 3 copies of the I-94, and 3 copies of the K-1.

    It can't hurt to duplicate.

    There are several posts on this forum where people have posted their AOS/AP/EAD cover letters. Those included an inventory of everything they sent. I found those posts to be very helpful when I was compiling my wife's package.

    Include a cover letter and organize the package very well. It is worth your efforts.

  11. Got my SSN after our wedding, I brought with me my passport and our original wedding certificate and filled the form with my married name but I checked the box "legal alien not allowed to work". I already had SSN before I filed my AOS before.

    If you are a K-1 I am pretty sure you are supposed to check "Legal Alien Allowed to Work".

  12. Here is what the SSA HQ official emailed me. He told me to bring this to the local SSA office when I go back. I guess this will seal the deal.

    He also told me that he called the regional office and confirmed that once the SSN application is in the system it should be approved. The married name vs. maiden name issue is not an issue.

    Thank you for contacting the Social Security Administration regarding

    eligibility to be assigned a Social Security number.

    An individual that entered the United States with K-1 status applying for a work authorized Social Security number (SSN) must present evidence at one of our offices to establish his or her age, identity, and current lawful employment authorized status.

    An individual needs to provide at least two documents as evidence to establish age, identity, and current lawful employment authorized status.

    Example: If the immigration document, for example, Form I-94, Form I-551, Form I-766, is used to establish work authorization and identity, the alien must provide another document to establish age.

    We will not assign an SSN or issue a card to an individual that is within 14 days of his or her alien status expiring. Until the 76th day after entry an individual with K-1 status only needs to provide an unexpired I-94 showing current K-1 status to establish employment authorized status for SSN purposes.

    Once, an individual that entered the United States with K-1 status has been in the United States 76 days he or she will need another document, for example, Form I-551, Form I-766, to establish employment authorized status for SSN purposes.

    The identity document used to establish the old name must match the name on the current SSN record. The identity document is acceptable even if over two years old or expired.

    Note: Refer the Social Security office personnel to EM-06064, which was issued 10/02/2006 and EM-07045, which was issued 07/03/2007 for the current procedures regarding name changes based on marriage.

    We cannot accept an application filing receipt or notice of action as evidence of an immigration document.

    Normally, an SSN card should be received in the mail within two weeks after the application and document(s) have been received and verified.

    However, when an alien requests an SSN or replacement card, we must verify his or her documents/current status with the appropriate bureau of the Department of Homeland Security (DHS). If the initial online verification is not possible through the Systematic Alien Verification for Entitlements (SAVE) system, we may need to send a Form G-845 to the appropriate bureau of DHS for manual verification.

    Social Security field offices can submit an additional electronic online verification, which with the majority of applications eliminates the need to send a Form G-845 along with a copy of the applicant’s immigration documents.

    However, some applications still require a copy of the immigration document(s) to be mailed to the appropriate bureau of DHS along with Form G-845 for manual verification.

    Note: If the applicant has changed his/her name after an immigration document, for example, Form I-94, was issued, for example, married and is now using the married name, but has not obtained a corrected immigration document showing the new name; this is not a name discrepancy for enumeration purposes, that is, SAVE clearance, if the applicant can provide an acceptable legal name change document to establish the new name.

    The 14 day status expiration limit for assigning an SSN and/or issuing a card applies even if an individual submitted his or her application before being within the 14 day period and entered the 14 day period while waiting for his or her status to be verified.

    Our offices can also assist applicants by issuing a notice acknowledging the SSN application while documents are being verified.

    If ineligible to be assigned an SSN, Social Security offices can provide written notice using Form SSA-L676 to explain that an SSN cannot be assigned due to your fiancé/spouse not having provided authorization to work in the United States for SSN purposes, or evidence of a valid nonwork reason for needing an SSN.

    The following are valid nonwork reasons:

    update:

    I got a fairly promising reply from my email to this website. An official called from the SSA Headquarters in Baltimore. He got some information from me and then called the Albany office. Then he called me back and said that the Albany office will now at least accept the application. He said that will allow the application to get into the system and be processed by the regional office. Apparently, that doesn't necessarily mean that it will be approved, but its a start.

  14. hmmmm I was awarded a SS card before we were married. We tried to do the name change AFTER marriage (went down with all the correct documents) and was told it was not possible as there was less than 2 weeks left on the Visa and the system locked anyone out who tried to amend it as i am now with AOS pending and my Visa is no longer valid! How much time is left on your visa? I'm wondering if this is where the problem lies?

    The K-1 is valid until 10/23 so there is more than 3 weeks left on it.

    I am moving your thread from the AOS forum to the SSN section. "I Quit" (formerly mdyoung) hangs out in that section and is the resident expert.

    I had a copy of that 'RM 00203.500' policy with me at the SSA office. I showed it to the clerk. His only reaction was, "Oh, can you show me where you found that. I was trying to find that the other day". At this point, he turned his monitor around and asked me to point him to where these documents were located on the web.

    I don't think 'RM 00203.500' would have helped me much in this situation anyway. The clerk's argument was not based on employment status. He simply said the system would not allow my wife's new name because only her old name was in that system. If we had come to him before we were married, he would have issued the card, no problem.

  16. Thanks for the options and info. I should have mentioned that I mailed the AOS/EAD/AP package last week and am waiting to hear back on all that.

    Back to the SSA fiasco...

    At one point, I actually told the SSA clerk that I could simply go to another SSA office and not reveal our marriage and get the SSN. I told him that because the flaws in his logic were so obvious. He then told me that if I did that I would be "committing fraud". The guy was a complete clown.

    It is nearly impossible to have a sensible debate with these people. I just wish there were some documents that could educate them with.

    She should have applied before you got married and soon after her arrival in the US.

    Correct, like I said...in hindsight, that is what I would have done and that is what I would advise others to do.
