  1. Do I need to apply for my I765 then or is it just redundant? My L1B Visa is good for another 2.5 years, so once you get the green card you could start working already no?

    One more thing...when you file the 485 it says you need 2 pictures...ok, but if ya'll think I should file the 765 as well it says it requires 2 pictures as well. So do you really need to send 4 pictures?

    Don't try to reinvent how water boils. Simply follow the instructions in the Adjustment of Status guide and forms. If they ask for something -as ridiculous as it might sound to you- yes, you HAVE to comply.

  3. I'm down in the US on a work VISA. I managed to get an L1 intercompany transfer. Meanwhile the Spousal Visa has been in progress. We are at the point where USCIS told us that we need to now file the I485... So I'm just a little confused on filling out the form as I want to make sure I adjust off the family visa and NOT the L1 visa.

    On Part 3 of the form it asks what my Non-Immigrant Visa number is...would that be the I94 record number? The reason I ask is because it asks for my I94 number in Part 1.

    Also in Part 3 it asks the consulate the Visa was issued, but for an L1B visa, I applied right at the border, in a do or die situation...fortunately it was a do :) So would I just put N/A on that one?

    Your story is a bit confusing...what do you mean a spousal visa has been in progress...has your spouse filed and got approval for an I-130 and/or I-129? On what basis did you receive instructions from USCIS to file the I-485? Do you have a K-1 or a K-3 visa? Those are the only instances in which you would be adjusting status from a family visa. (The IR/CR family visa does not do AOS, because that is done before the visa is issued and once the beneficiary arrives in the US, the greencard is sent to the home address.)

    It is confusing....and I'm confused too ...

    We applied for a 130 back in September. Two weeks later a job came up in the US, and I got an L1 visa in January so I've been down here working on that for a month. Feb 9th we received a letter saying ...

    Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN Current Status: Approval notice sent. On February 9, 2009, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN.

    We got that, and then on the 20th we received a letter asking for a choice of agent, and then it said if the person plans on adjusting status we should call first. We called and they said not to pay the AOS fee, but send in the 485.

    Also...my case# starts with MTL which I've read is for Montreal in Canada. Since then we've phoned and changed my address to my current one in the US. Is my interview going to be in Montreal?

    I know we didn't do the fiancee visa, and I don't think we did the k3 either. The only thing we sent in was the 130 paperwork...we didn't do the I129.

  5. My wife and I had filed for our I130 back in November. In January a job opportunity through my company came up and I ended up transferring on an L1 visa to our office in the US. Now I received an email today from CRIS stating

    Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

    Current Status: Approval notice sent.

    First...what does this email mean? And secondly...where do we go from here as I was starting to think about sending in a I485 which apparently I should have done with the I130 in the first place, but didn't know?

    I managed to find a job in one of our US offices so I can move to be with my wife, and the company is currently working on the paperwork for the Visa. I'm wondering about driving a Uhaul across the border and what paperwork do I need to fill out. It seems like I just need to fill the 3299 form. Is that correct?

    Also...the only things I will be taking will be like my bed, tv and stereo, computer, clothes, and few dishes and what nots.

  7. I just got married a week and a half ago down here in Georgia. I am from Canada and my wife from here. I will be returning soon to Canada, but my company is looking into sending me back down here to telework from Georgia on a TN visa for a year so that I can be with her. My question is, once I get here and started working on a TN visa, then would I be able to apply for the CR1 visa by filing the I130 paperwork?

  8. Answer questions that are asked, and don't elaborate. When they ask the purpose of your visit, say "vacation" and stop. If they ask you if you will be visiting with friends or family while here, say yes, and stop. If they ask who specifically, say fiancee. And stop. Never lie to a US official, They Will Catch You in it. That's their job. Be confident but not rude, and look them in the eye. If you're looking down at your shoes, they'll think you're suspicious.

    As for ties to home to prove you will be returning, a letter from your employer stating you are on approved vacation leave, and you are expected back on XX date, a copy of your rental or mortgage agreement on your residence, copies of utility bills etc etc etc. just anything that shows you have obligation to return to Canada at the end of your specified trip. But don't offer any of it up unless they ask for it.

    Yes thanks, that sounds honest and not lieing, which is what I'm looking for. I've got a letter from my supervisor, my boss, and HR at work, and my preacher all stating they expect me back in Canada on the 10th of November, and I plan on bringing a letter or at the very least a mortgage statement from my bank. If none of that works...nothing would I think.

  9. if people can just go to the US and get married while they're visiting so why there's K1 visas

    There is a K1 so people who go to get married can get married and stay in the US while the AOS portion is processed.

    We got married in the US (twice!) and my husband has been living in Canada while we have been going through the CR1 process. He's visited a bazillion times while we've waited and have never had a problem.

    Thats correct. I was thinking the difference between the K1 and what we plan on doing is that I plan on returning to Canada and doing the long slow process of immigration whereas with a K1 I would be able to stay in the country.

    I guess my fear is simply the fact that I've heard some stories of people being sent home at the border. My intent is not one bit to lie to the border guards and I honestly have no choice but to come home as I'm am quite thoroughly tied to Canada with work and mortgage and such. I'm working with my company and they are possibly going to get me working from the States so I don't want to mess that up by getting married and then staying down there illegally...I couldn't do it consciously<sp> in the first place anyways.

  10. Hi. Me and my fiancee plan on getting married in two weeks in Georgia where she lives. I'm Canadian and she is a US born citizen. We haven't applied for the K1, and after the wedding, I will be returning back to Canada and then we will be applying for the K3....and then waiting....

    I don't have any intentions of staying in the US except for a couple weeks of course after the wedding for a honeymoon but returning to Canda after that. From reading here it seems like this is perfectly legal, but it sounds like I should have as much paperwork as I possibly can tieing me back to Canada, which I am in the process of gathering up.

    My question is what exactly should I state for the purpose of my visit when I fly down? Should I simply say that I'm visiting my fiancee or should I just be right up front and tell them I'm getting married?
