  1. SPSguy: good thoughts, i will have to mull it over. The time all needs to line up so perfectly which makes me nervous..

    ... wait so a plane ticked cannot be purchased before Yuli(my foreign spouse) gets her visa? obviously she cannot board one but it seemed from LingChe's NVC shortcut wiki that only after the visa is obtained can a plane ticket be bought, have i misread that??

    That is important in my decision to accompany Yuli to the interview or not because i will need to buy a ticket before the interview for her to return with me if I am to go there during the interview and accompany.

    Also the bit about their mind perhaps being made before the interview, i think that is good advice, even if wrong it is good advice, i will think of my packets that i send in as opportunities to show nvc and uscis how engaged i am in this relationship as opposed to simply filling in forms and supplying info

    Darnell: oh excellent! you know i have read so much of this stuff over and over, and there are no difficult concepts but so many simple pieces, easy to confuse and transpose and forget.. very helpful just now to see that nvc link right now. I have been reading it over and over and it is giving me peace of mind as my brain slowly builds a map with this information.

    I do have a question though about required paperwork, i'm sure i read somewhere that police records arent required for indonesia. NVC, if i understand correctly, will tell me everything that we need to have when they send out the packet. In the meantime where do i check requirements for a given country? i could swear i saw a link on VJ before.

    You can find country specific information. You have to get Surat Kelakuan Baik from Mabes Polri in Jl. Trunojoyo, Jakarta, but if your wife is not in Jakarta I think there's other way, I'm not so sure about this.

    There's Indonesian community almost in every big state. West coast states and east coast, texas and colorado usually has pretty sizeable Indonesian community.

    Okay so really a two part question

    PART 1: my wife speaks no English, how might that effect her interview for our IR1/CR1 I-130 petition at the US embassy (she is in Indonesia and will remain until after visa is obtained) ((unless anyone has ideas of how to get her here before that, i think she doesn't have enough money or assets to get a tourist visa))

    PART 2: If a translator is needed at the embassy, could it be me? I speak fluent Indonesian, fluent conversational Indonesian anyway. I often need her to translate others' Indonesian into "our" Indonesian but the two of us have no trouble communicating between each other. I would really love to go to the interview with her and translate but it is a risk with the timing because she doesn't feel confident to fly on her own here after her visa is obtained because of her lack of English and lack of experience flying. If i go to the interview with her and she doesn't "pass" for one reason or another, delaying the process, i will have to return alone and save money and vacation time all over again which certainty adds to our time apart, I don't want that and neither does she.

    Also i don't know if this is relevant to this question or not but I feel that our evidence of a bonafied marriage is relatively decent, my whole family went to the wedding in Indonesia and i have many photos of both familys together, phone records, tons of congratulation letters postmarked just before i left the us for the wedding and some other stuff, no commingled finances though.

    Any thoughts from anyone to help me clarify these questions would be greatly appreciated.

    I have first hand experience in US Embassy Jakarta, and I tell you it was really easy. Indonesia is not a fraud country so the interview atmosphere is relaxing. The CO is able to speak Indonesian and really friendly, we joke around a lot. I joined in to the interview room with my wife, it seems the CO ask me more questions than her! All in all only less than 5 questions asked, the rest the CO doing was looking at documents and his computer monitor. He then congratulate us, and said we can pick up the passport w/visa in 3 business days.

    Spouse of permanent resident falls into category 2A. According to chart after point 5, they are now processing 2A cases which was submitted on 15 April 2005. If you just submit the I-130 IR1 application, it will be processed in approximately 4 years.

    It is much better if your husband can apply for naturalization ASAP, then it will only take 8 months, or even less to bring you here.

  4. In my case, my wife hasn't got her welcome letter either (it's been a month) so I called USCIS this morning and they told me to fill out AR-11 which is change of address form to make sure it goes to the right address. Isn't it a little bit strange?

    If you have not moved, yes. I'd call again and ask to speak to a supervisor.

    Thanks for your suggestion. Strangely though I received a welcome notice today, dated 6/11 when I made the call! Well at least I know it is processed now.

  5. We are finally back together! I went back to the country to accompany her during her smooth interview.

    Flying back together and enter at LA. There were no questions ask, just an inexperienced officer direct us to secondary room for first time immigrants.

    She was sent back outside right away for the green card processing. The whole process including fingerprinting took about one hour. Then after changing some pleasant exchanges with the officers they welcome her to the U.S. with I-551 stamp on her passport.

    We are pregnant! A little bit unexpected. We've been trying before to have kids after 1.5 year of marriage with no avail, then she denied entry. When I came visit her on December 2008 we make our first child :D .

    The problem is I resigned from my job on October 2008 and still jobless until now. So when the baby dues on August we are considering to have labor in Mexico (and maybe get 3 citizenship :lol: ) or maybe back to her home country after she get her green card. Or maybe medicaid, we haven't decide yet.

    I do really believe that this is God's will because we did not plan for all of this to happen.

    Now does she need her green card to apply for a driver license? And does she need SSN to open bank account and credit cards?

    Another question, the joint sponsor's I-864 and his tax documents were returned when we got her visa at the interview. Does it mean that they release him from joint sponsor responsibility?

    Thanks to visa journey our immigration has been smooth and quite easy.

    Do you know which vaccine/s she is missing?

    Well, in her country record keeping is pretty bad so although she remembers some she won't have any papers with her. Do you think it is different between K visa and IR/CR1 visa? As far as I remember if you do non-immigrant visa they're not require you to have vaccinations until you get to US.

  7. Just called AVR, said case forwarded to embassy Feb 25. Talked to operator yesterday and found out interview date April 23. I kind of hope it was March 23 instead but at least we got a date. Thanks gracious God!

    Thanks. So I think it depends on the consulate how they schedule interviews. They sent the interview letter yesterday as well, I should have it within few days. Hope the best for all of you.

  8. OK, our fee bills are paid and we had the AVR message for that. Next we mailed the DS-230 and I-864. and NVC received them. Now the AVR has a message that just says an instruction package will be mailed to you in the next 2 weeks. What is this? Is it a case complete and the instructions is the interview letter? Or is it a message referring to the generation of the DS-230? I am confused since the package has been received already. Anyone have an idea what it might be?

    It should be IV fee bill if you paid all your bills online.

  9. Just called NVC and unless the operator is lying or drunk, MY CASE IS COMPLETED TODAY!!! Thanks God!!!

    AVR still says waiting for missing information and documents. THANKS GOD IT WAS A FALSE RFE.

    @ stevei, have u gotten an appointment yet or they told you to call back or they will call you?

    The operator told me that consulate will determine the interview date. I hope it will be soon enough!

  10. This is the instructions taken from I-864EZ

    Who May Use Form I-864EZ?

    You may use Form I-864EZ IF ALL the following conditions

    apply:

    1. You are the person who filed or is filing the Form I-130,

    Petition for Alien Relative, for a relative being sponsored;

    2. The relative you are sponsoring is the only person listed on

    the Form I-130 petition;

    3. The income you are using to qualify is based entirely on

    your salary or pension and is shown on one or more Forms

    W-2 provided by your employer(s) or former employer(s).

    So use I-864EZ if YOU ONLY is the sponsor of the ONLY ONE beneficiary. If you have a joint sponsor use I-864. I hope it helps.
