  1. I also mailed the I-129F (for K-3) on September 16 and received the NOA1 on September 22. So, I am definitely with you guys! I just hope & pray that we do not have to wait that long.

  2. Sent our application to VSC in mid-September. Yet to get our notice of action (see my other post) but hoping that VSC is just slow is generating the notices.

    Oh my God! Lovers in Love..I just looked at your times & read the approximate amount of time for the I-130 & I-129F for the CSC. It can't believe it states that it my take that long. That is scary! God, I can't believe it! =(

    I applied in September for I-130 and I-129F for my wife. I called USCIS today and spoke with an immigration officer. He told me that my case has not been assigned to an officer. I asked him how long before it is assigned and he would not give me a clear answer or an estimate. But he did say once it is assigned to an officer, then it moves pretty quickly after that.

    Does anyone have any idea how long does it take USCIS to assign K3 applications to officers?

    I'd appreciate your answer.

    Did you send both the I-130 & 129F just this September that passed...last month? What Service Center did you mail it to?

    Yes, I sent both I-130 and I-129F this past September 08. The service center is CSC.

    I actually did the same...mailed the I-130 in August & I-129F in September at CSC as well. Did you get a NOA for either or? Can I ask, what telephone number did you use to call CSC? And how/what did you do to get through to actually speak to someone? I have had such a hard time to get through and speak to someone live.

  6. yes you can file directly to the US embassy in Bosnia-Herzegovina; people say it's fast and easy process!

    That's right I forgot! My husband would have to then go to the US Embassy in Bosnia! I briefly assumed he would be able to go US Embassy in Germany but b/c he is a Bosnian citizen, then he would go to Bosnia.

    UGH..I hate this! =(

    We may just wait for this I-129F to be approved for the K3 Visa...I hope it will be approved soon.

  7. From reading some posts on here, a "touch" could be something as simple as your case being taken out of one filing cabinet and put into another.

    So as pushbrk says, a touch really has no practical meaning. Though I suppose it can assure you that it hasn't been lost! :)

  8. For K-3 it is I-134

    So, it is a I-134 instead of the I-864 for K-3?

    I-134 for K-3 VISA interview, I-864 if you stick to the CR-1 path (I-130 petition only) or I-864 is used when adjusting status from a K-3 in the USA.

    Consider carefully the K-3, in most cases it does not save much time, compare timelines, K-3 was developed at a time when CR-1 cases were taking a very long time, this simply is not the case anymore.

    CR-1 has the big benefit of GREEN-CARD upon entry, NO ADJUSTMENT OF STATUS. K-3 CANNOT get SSN, WORK, or Get driver's license until they have EAD or Green-card, EAD can take 90 days or MORE to get.

    K-3:

    I-130: $355

    I-129F: NONE

    Consulate: $131

    AOS: $1010

    ($1496)

    CR-1

    I-130: $355

    NVC I-864: $70

    NVC Visa fee: $400 ($355+$45)

    ($825)

    I see many posts from K-3 holders stating, "Wow this sucks, I an stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

    YuAndDan, can I then go ahead and go for the CR-1? even though I have an I-130, as well as, an I-129F pending? Do you think this is possible?

    AOS = Affidavit of Support (I-864 for NVC (CR-1) visa, or I-134 for consulate (K-Visa))

    OR

    AOS = Adjustment of Status from a K-Visa in the USA.

    I am filing for the K3 Visa, so I am assuming that I need the Affidavit of Support? So I also need the I-864 for this?

    For K-3 it is I-134

    So, it is a I-134 instead of the I-864 for K-3?

    Hi!I am actually applying for the K3 Visa for my husband. I have mailed out the I-130 in August, received a NOA1 a week or so after stating that is pending.

    On September 16, I mailed out the I-129F and of course, received the NOA1 a week or so after, which states that the I-129F is pending and they waived the fee (b/c it is for the K3 Visa).

    Sorry, I am now even more confused that before. Some people are telling me to go straight for the CR-1. And I am going crazy. Thank you!

  11. there are certain advantages to the CR/IR1 visa... in the end it is a personal decision... Problem is the active I-130 at the service center... AFAIK, you cannot have two active petitions for the same benneficiary.

    FWIW, you have not made a visa decision yet and the I-130 and the I-129F are still concurrently processing .......

    Really? So, unfortunately I cannot go this route because I already have the I-130 & I-129F pending. Ugh! I hate this! I mailed the I-130 in August, received the NOA1 literally 2 weeks after mailing it.

    I then mailed the I-129F in September and same thing, received the NOA1 a week or so after.

    Payxibka...can I ask you. When a I-129F gets approved. What is needed is the Police Certificate, Birth Certificate, DS-230 & I-864?

    Is this correct? I'm assuming when the I-129F gets approved it will state what else is needed.

  12. I am a US CITIZEN, currently in Germany with my Husband. He is a citizen of Bosnia&Hercegovina BUT has lived in Germany pretty much all his life. We got married in August in Denmark because it was seriously that fastest way to go.

    Anyway, I mailed out the I-130 and received the NOA1, stating that it is pending.

    I then mailed the I-129F, received the NOA1 stating that is is pending & that they waived the fee b/c we are going towards a K3 Visa.

    I am in Germany for 5 months now. SHOULD I just wait & stay for another month to do this Direct Consular filing? I recently received an 3-5 extended Visa from Germany and of course, I am living with my husband in his home.

    What should I do? Would this Direct Consular Filing be right for me? Can anyone PLEASE help?

  13. I thought you had to be residing in the US? How will you be the beneficiary if you arent employed?

    No..I am the petitioner. I am obviusly the US citizen but am currently in Germany with my husband but may actually go back to the states next week. I understand what you are stating but I came to Germany a few months ago to get married to my husband with the intentions of staying until he received his visa. I also listed the us address on the forms...as my parents address in the states where I live. It is confusing but thank you! =)

  14. Hi everyone! I'm hoping someone can please help answer a few of my questions regarding the I-129F packet that I mailed out to California.

    I am a US citizen currently in Germany. I just got married to my husband in August ...we actually got married in Denmark, because it was the easiest route to get married here in Europe without having to wait a month or so to get married in Germany.

    Anyway, my husband was born in Bosnia & Hercegovina (& holds their passport) but has been living here in Germany since he was a child.

    I have already mailed out the I-130 packet and received the NOA stating that the packet is pending.

    I have mailed the I-129F packet and received the NOA stating that the packet is being reviewed and that the usual amount of money due for I-129F was waived for me because I am filing with the hopes of my husband receiving the K-3 Visa.

    So, in the I-129F form, I described how my husband and I met..I also stated that I would stay with him in Germany until the packet is approved and when (God willing) he receives his Visa.

    I am into my 5th month here in Germany and honestly, somewhat going crazy. I am not working and unfortunately, I heard that my father has to have surgery. Would it be bad/wrong of me to go back home in the states even though I mentioned in the I-129F that I would stay with my husband until all Visa process is completed? I really hate leaving him but I for my own sanity & that the fact that my father needs surgery..I am contemplating on going back home. What should I do? Please help! Thank you soo much! :crying:

    Also, when I get the 2nd notice, stating that our I-129F was approved..what is then needed from my husband:

    *I-864 (Do I fill this out or my husband?)

    *DS-230 Part 1 (Do I sign PART 1..does it need to be notarized?)

    *Police Certificate (Because my husband was born in Bosnia&Hercegovina..does he need a police report from them or Germany, where he has been living since a child?)---also, translated in English..correct?

    *Birth Certificate

    It does not matter about staying in Germany. If you need to leave, leave. It is no different than someone living in the US, traveling to see their SO.

    The I-864-As the USC, you fill it out showing that you have the money to support your husband.

    The DS-230-He signs part one of that. No it does not need to be notarized.

    Police Certificates-He needs one for everywhere he has lived for more thana year since the age of 16. As far as translations of certificates, check with the embassy requirements. Most do not need to be translated if in english or the language of the country where the embassy is.

    Birth Certificate - Yes he needs his birth certificate.

If I get a job that pays between $30,000 to $40,000 will that be accepted by the Embassy as being enough for me to support my husband?

    Also, is this individual below your comment correct?

I was afraid that because I stated in the I-129f form that I will stay in Germany w/my husband until he gets a Visa AND now to possibly leave back to Chicago..that I would get penalized (or him not get a Visa) because of that. I am sooo worried as to what they look at.

    You will pr0bably need a co sponsor since you are not currently working.

    No, it is no problem with you traveling. Yhey do not care where you are traveling.

    You need the DS-230 for both. The I-864 is for the CR1, and for the K3 it is the I-134 (i think is the number)

    I see...so the I-134 is the Affidavit for Support. So, I can still be the sponsor even if I am not working or if I am working? But if I am not working, I would still need a co-sponsor? Are there salary requirements for sponsorship?

  15. Is it taking so long to receive the NOA2 for our I-129 F & I-130 petitions b/c my husband EWI yrs ago? We were completely honest while completing the petitions, but now I'm worried b/c we haven't heard anything in 7 months. We thought the initial process was designed to verify that the marriage is legitimate and that a waiver could be filed later at the interview stage. Are we wrong to think this way? I miss my husband so much, and I don't understand the long delay, esp since others who filed after us are getting their approvals much sooner. Please respond if you have some idea about this.
