    Progress is good, approvals are better. Good seeing y'all getting where you need to go.

    Just a question, I received an RFE for the most recent year W-2/1099. When I had first submitted the AOS, I had used my 2007 tax information on the 864. Now that I've already done my 2008s, would I have to send the 2007 W-2/1099 or the 2008? And, if I do send the 2008, would I need to redo the 864 for the 2008 information and send that as well, because the letter only asked for the most recent year W-2/1099.

  2. I noticed the email to the congressman on the previous poster's timeline. My wife is also adjusting from a K-1 but upon receipt of my RFE, I haven't received any notice since Nov 08 regarding my AOS. Would notifying my congressman be an option to expedite the process? I noticed a lot of people having their cases transferred to offices but mine is in stasis at national benefits center and I'm getting worried that I can't do anything about it.

  3. Yes, I had noticed from reading over the October thread in particular that most people who have gotten an RFE have had no updates with regard to their status. I mailed my RFE (tax forms) back in November and there has been no touch since then. It seems to be in stasis at the National Benefits Center, not updated at all since 11/26.

    I've had another biometrics (separate one for the EAD, because I mailed it separately from the 485) on 12/19 with a touch on 12/22 for the EAD but nothing on the AOS.

    what gives? I am getting worried that mine has been lost along the road. i doubt that an expedite request at 60 days will do any good.

    I completed the K-1 process without a hitch and my wife come to the US in early August (I am the citizen, she is from S Korea). We got married later on that month and I realized that, during the AOS preparation, my wife had lost the NOA2 for the I-129F somewhere. So, I sent a I-824 for the NOA2 on the I-129F. The notice of receipt was sent on 9/23/08.

    Now, USCIS tells me that it might take upwards of 5 months (so until 2/23/09) for me to receive my approval notice. In the meantime, all my preparations for the AOS are on hold as that is the only thing I am currently missing and the expiration of her I-94 approaches (11/11/08). Effectively I have no choice but to wait for this.

    After 11/11, my understanding is that my wife would lose her status until the I-485 is sent. I don't necessarily have a problem with that, but during that no-status time frame, I guess she would effectively be unable to attend school, get a driver's license, etc?

    I know it was a bad move to losing the NOA2 on the I-129F but is this the only out that I have? To wait for the I-824 and have my wife without any status?

    Any advise would be appreciated. Thanks.
