  2. I just wanted to say thank you to the people who run and maintain this site as well as the people who contribute to it. Because of this site, I managed to navigate the past 4 years from a K-1 visa to an unconditional green card without the need for a lawyer. Even though the money I spent on the immigration process was no small sum, it would have been a lot higher without the information contained within this forum.

    As a thank you, I have ensured I filled out my timeline as well as posted reviews of interviews plus lists of other things I submitted to the USCIS in order to make my immigration process as pain free as possible.

    For all those people reading this, there is no question about the US immigration procedure that has not been answered within this forum. In the rare and unlikely event there is a unique question posed, there's an army of members with years of experience who can answer it effectively.

    Once again, thanks all!

  3. As an aside; I provided the following evidence that the marriage was genuine;

    • Copy of my Marriage Certificate.

    • Copy of my Divorce Decree.

    • Copy of Joint Federal, State, and Local tax returns for the filing year of 2010.

    • A copy of the joint lease agreement my ex-wife and I signed when we lived in the apartment at >INSERT ADDRESS HERE<

    • Other miscellaneous documents from the leasing office addressed to myself and my ex-wife during our time at the apartment.

    • A statement from the leasing manager of the complex stating, to the best of his knowledge, my the marriage between myself and my ex-wife was legitimate.

    • Several documents stating that my ex-wife was covered on my health care policy I obtain through my employer.

    • Documentation showing a joint auto insurance policy.

    • Documentation showing we owned a car together.

    • A copy of the original divorce complaint showing my wife filed for divorce based on irretrievable breakdown of the marriage and also filed for equal distribution of marital assets, and alimony.

    • A copy of the court order showing I had to pay my ex-wife spousal support and maintain her medical insurance until our divorce was finalized.

    • Receipts showing I had to pay for legal counsel during the divorce.

    • A copy of my Permanent Resident Card (front and back).

    • Two letters addressed to my ex-wife when we lived together.

    • Receipt for an engagement ring.

    • Copies of several cards my ex-wife gave to me during our marriage.

    • Two statements form friends that knew myself and my ex-wife during our marriage stating our marriage was genuine.

    • Photographs showing my wife and I during various times throughout our marriage. Dates and places are written on the reverse of each photograph.

  4. From my timeline;

    My interview was scheduled for 0915. I arrived at 0900. I was seen at 0930 by Officer Johnson. He explained to me that he is filling in for someone who called in sick and he hasn't had chance to review my case. I could see my paperwork was 3 inches thick and the inch thick RoC evidence I had provided was in a separate folder as my file was too large to contain it. He made me swear to be truthful to the questions he was going ask. He asked me when my ex-wifes birthday is, then specifics about dates and times to do with when and where we met, when and where we were married, when we separated, when I moved out, when we divorced, etc, etc. He mentioned that he needed to see my previous years tax returns (which I didn't have because I filed them separately from my wife because we had been separated 6 months by this point). He said if he needed to see them to make a decision on my case, he would send an RFE out. He then explained to me that in 4-6 weeks I would receive a judgement in the mail. If I was approved, I would receive my permanent green card approx 2 weeks later or if it was denied, there would be a reason stating why and details of how I could appeal that decision. The interview lasted about 30 mins.

  5. So here's my story......

    I came into the country on a K-1 and have been married for 2 years.

    My permanent resident card expires 03/29/12.

    I left my wife 6 weeks ago as we were just not working out. No one cheated, no one did anything wrong, I was just deeply unhappy and wanted out.

    I understand that I need to file my I-751 in January and that I can apply for a waiver as long as I provide substantial evidence that the marriage wasn't a sham marriage.

    The problem is that she has is hurt and doing all kinds of stupid stuff that people do when they are hurt. The bottom line is that I have to get a divorce layer and will probably go to court. This means that I severely doubt I will be divorced before my permanent resident card expires.

    What is the procedure for dealing with this?

    I'd be grateful for any help, info, and/or guides.

    Thanks in advance.

  6. Here's the situation;

    I came into the US on a K-1 Visa and married my then g/f about 2 years ago. I received my green card about 15 months ago and have to wait 6 months to apply to remove the conditions. According to this site, it's takes about 6 months for the I-751 to be processed thus in about a year, my GC will be unconditional as opposed to being conditional as it is right now.

    I have found some info here;

    http://divorce.lovetoknow.com/Green_Card_Divorce

    about what to do in case of a divorce.

    Whilst my wife and I aren't even close to getting a divorce, we seem to be drifting apart and I'm worried that if we did divorce, I'm going to have to leave. Like many people, I now have a life here complete with apt, car, job, friends, etc so I obviously don't want to leave.

    I'm interested if anyone can testify to the advice given in the link above and if anybody has actually been through this.

    Thanks in advance

  7. As the title of the this thread eludes, I can't remember if I notified the USCIS if I changed my address.

    Is there any way of verifying if I did?

    I obviously don't want to re-do what I've already done....

    I see I can fill out the online form (https://egov.uscis.gov/crisgwi/go?action=coa.Terms) so I wont have a paper trail.

    Any help would be greatly appreciated.

    And yes, I should have kept better records but 'life' happens....

  8. Now, I normally wouldn't be worried about this at all as I have nothing to hide; but hearing that someone is making up this kind of lies about us is obviously worrying me. Is there anyone who got visited at home, and in that case how did it go? How long it took to hear more from them?

    Thank you in advance for reading this!

    I haven't read through the entire thread but would just like to answer the part from the OP I quoted above.

    It is entirely possible that the authorities made up the 'somebody had reported your husband and yourself as a fake marriage' in order to see your reaction. Government agencies have done FAR worse.

    As I think has already been said, it's lawyer time!

  9. Here's (hopefully) the final update.

    The Congressman's office have been chasing my medical for weeks and I've been calling them or e-mailing them daily. The medical is a year old in about a weeks time. I had finally given up yesterday and booked a medical for next Monday and the USCIS were gracious enough to extend my deadline as that has now passed.

    I then got an e-mail today from the Congressman's Office;

    Dan,

    I just received a call from the California USCIS office. Miraculously, they indicated that your case was reviewed and all the medical information was present. However, they still needed pages 2 and 3 of your I-485 application. I have a copy of your I-485 in the office and I sent scanned copies of these pages, which they indicated would be sufficient.

    Therefore, the medical appointment that you scheduled for the 29th should be unnecessary. If all goes well, the case should be decided in the next few working days. I'll keep you updated if I get anymore information.

    It's been a long ride, but it might finally be coming to an end! :dance:

  10. Just another quick update;

    I've been harassing the hell out of the the Congressman's aide ALL week.

    The bottom line is this;

    The USCIS blames the TSA for losing the medical and don't care about finding it. To them, it's lost and I need a new one. They did give me the option of wavering the medical and going to my local USCIS centre to have my case based without a medical. I didn't go for this as I don't want to get special treatment.

    Bottom line is that I have asked the Congressman's aide to contact the medical practice in London where I had my medical done and to ask them to send a copy to the Congressman's Office. We will then send this registered mail to the USCIS. The Congressman's aide is going to contact the USCIS on Monday and see if this will be accepted in lieu of a I-693. I don't see why it wouldn't be.

    Once again, I will update this thread as this debacle progresses.

  11. My husband moved here to PA from England as well. He could drive with his UK license for 1 year from the date of entry to the US. He didn't need an international drivers permit because his UK license is in English. Now I called my car insurance and made sure he was covered while driving with his UK license. And Allstate said He's covered as long as he has permission from me to drive.

    He had to get a PA permit (written test) and also take the driving test. To get the permit all you need is EAD(or Green Card), Marriage certificate, passport, social security card, 2 pieces of mail to prove you live in PA (we used the NOA from the AOS and a bank statement). He also needed to get a physical, very simple really, nothing like the physical to come to the US!! For the driving test, He needed to show proof of insurance for the car he'd be taking the test in, ID and permit. He had to show he could work the lights, parallel park and drive on the road for about 5 minutes, it was very very easy!

    Rang the DMV and they basically said what you posted.

    The lady also recommended that I take a minimum of 50 hours of driving tests between passing the theory and taking the practical..... :wacko:

    I have an exceptional extensive list of categories on my licence and 10's of thousands of hours driving all over the world.

    Anyway, after the whole emigration process, figuring out which pedal makes the car go faster and which makes it go slower should be easy... :hehe:

  12. Ummm that IS an international drivers licence.. it's a licence from an international location.

    You're confusing "International driving permit" and driving licence.

    Yeah, I think I was. But from your previous post;

    "Pennsylvania honors a valid foreign driver’s license with an international driving permit for a period of up to one year. If the foreign license and/or international permit expires before one year, the individual must apply for a Pennsylvania learner’s permit to continue to drive in this state. "

    Still wondering about the reciprocation though when exchanging for a PA licence though......

    I'll give the DMV a call tomorrow.

    Thanks for the replies!

  13. I've been living in Pa for over 6 months now and am eagerly awaiting my Green Card.

    I've hunted through the PA DMV website but am unable to find the answers to the questions I have so I am hoping someone on this forum can help.

    Once I receive my green card;

    1. Do I have to take a driving test or can I swap my FULL UK Driving Licence for a reciprocal PA licence?
    2. How long can I legally drive in PA on my UK Licence?

    Thanks in advance!

  14. Buster, I just wanted to say good on you for fighting this and making them get it right when they make an error. Sometimes I feel so frustrated seeing people in VJ just rolling over.

    I figure I have the work permit (which is the important thing) and there not going to boot me out of the country so why not get a decent resolution?

    I'm not even asking for special treatment, I just want them to follow their damn rules that my wife and I have jumped hoops through to abide by.

  15. Another quick update;

    I managed to go see the Congressman's aide today who is dealing with my case.

    I gave her the new RFE I received (which is the same as the last one except has a new due date) and asked her about what to do with the I-693.

    I explained to her I have the DS-3025, the receipt for the medical, and a copy of my chest x-ray. The receipt and DS-3025 I have sent to the USCIS twice....

    She is now aware of the new due date and is going to contact the director at the USCIS California branch about clearing this up. I suggested that the USCIS could just ring the place I had my medical at and get another copy. I would have rung them but I don't think they would release the results to me.

    I'll update this thread as things progress.

  16. Well, that's one hurdle overcome. Glad you got in touch with a rep (or their office) who is competent at working this sort of thing.

    Yeah, it's an election year...... :thumbs:

    Sorry you're STILL having I693 issues. :(

    I'll speak to the Congressman's aide tomorrow and she what she suggests. I'm wondering if I can contact the place in London I had my initial medical and get them to my e-mail my results.

    The whole 'lost medical' is a systematic failure in the system and not just a random occurrence that needs to be addressed.

    Either way, I'll let everybody know.

  17. Just wanted to add an update;

    My wife and I went to see the Congressman and explained our predicament. He said he would do his best to sort it out as re-filing was ridiculous.

    Two weeks after seeing him, one of his aides contacted us saying that she had spoken to the Director at the USCIS California centre and they accepted blame for the RFE being confusing and agreed to re-open the case free of charge.

    We got a letter today which is the EXACT same as the original RFE (see post #17) but has a new due date; 5 weeks from now.

    We are going to see the Congressman's aide tomorrow about what to do about the request for the I-693 as my medical is only 9 months old.

    The USCIS wont accept responsibility for it being lost so I may have to get another done.

    I will keep you all informed via this thread as to the outcome.
