And I have a questions for you all.

If neither me nor my hubby have a police record and were never arrested, do we need to bring a statement from the court stating that we have no record?

Or can we skip that part?

It seems to me that we don't need to bring anything but I'm not 100% sure..

I'm pretty sure you do not need to bring anything if you have not been arrested or convicted of a crime. We had our interview today and I have a police record that I gave them at the interview for DUI in my home country. She kept the document to put into my file but did not ask me anything more about it. I was worried that I could be denied because of a very stupid decision I had done in my early years. Luckily, our IO was very understanding.

YAY!!!! We had our interview this morning and everything went smoothly. My husband and I were very nervous about the interview but our IO was very pleasant and did not give us a hard time. We were in and out. All she did was go over our general information Names, DOB, Asked me a few questions like have I been arrested, Am I apart of a terrorist group, espionage which she laughed about and said sorry but we have to ask...of course I said No to all. Then she said I was APPROVED!!!

She didn't even look at our supporting documents that I had brought with me, since I had already submitted them when I applied for AOS. She did look at our Wedding Album and loved it! She told us that I'll receive my green card in 2-3weeks.

She did say that our next interview to lift the conditional permanent residency in 2years will be a lot harder and to start preparing documents with both our names on it. But for now we are soooo happy and relieved!!! Goodluck to everybody else with their interviews!

I received my AOS interview letter on Dec 15th 08' for Feb 2nd 09'...I received my EAD on Jan 8th 09' but I also applied for my AP which I thought basically came hand in hand with your EAD. I haven't received any letters pertaining to my AP so I'm a little worried if it has been denied. Does anybody know if you can travel outside the US without your AP but with a Greencard???

I am also waiting for my Interview letter. People have started getting their approvals already.

does it make sense to make infopass appt for my IL query?

I think you have nothing to worry about. It's a waste of time at this point to get an infopass about IL. Any USCIS rep. will tell you it takes about 8 months. That's what they told me at the infopass I went to. If in June you don't hear anything, then maybe you can try an infopass to see if evrythings alright. I know it's long! We just need to be a lil more patient! Good luck!

Did you get your DL yet? really weird since I applied for my TX Driver Licence 3yrs ago while I was here on my holiday and they didn't give me a hard time. I was scheduled for the interview on February 10. Hopefully everything goes well. On the uscis website my case still shows up at NBC so the site does not always update it seams.

I'm still waiting on my EAD & AP which is way overdue...I have my interview on Feb 2nd. so fingers crossed that it all works out.

It's pretty stupid though since I think I will probably get my green card before I get my EAD & AP papers. Oh well, I guess it's back to counting sheep!

Bah! NOA arrived today saying the FBI couldn't process the fingerprints. New bio-redo scheduled for Nov 4.

Yes it's such a disappointment that they can't do their jobs properly!! I just received the same letter saying the same thing. I'm so disappointed it's been rescheduled for Nov 06 but what worries me is that on the NOA it only has the barcode for the I-485 when the first NOA for my biometrics had the I-485 and EAD. Does that mean that they approved to process my EAD? I just hope it doesn't delay the process any later.

I'm also on the same boat. I have an F-1 visa and have filed for my aos. I'm thinking of taking a break from school next year since we can no longer pay the ridiculous international student rates. I have depended on my student loan the last year but I've recently found out that the private loan I was getting no longer offered it to international students.

My college also told me that for me to be classed as in state resident I have to wait a year after I got married before I can start paying normal rates. My husband and I are thinking of relocating to another city and was just waiting for my EAD & AP to arrive which should be Dec 08' so we could both work to save up for my college tuition. Now I'm a little worried that if I don't register next semester I'll be breaking my F1 status and might not look good when I go to my interview. Also my passport expires this December and want to know if I need a valid passport to take with me to the interview??

I'm currently on F-1 (OPT). The only way to be in F1 status would be to be enrolled (full-time, I think). If you don't enroll, you are then out-of-status for the F-1. If you file the AOS early enough before the semester ends, then your husband's F-1 status will end (assuming you don't re-enroll) and would then be in 'AOS' status (which is like immigration limbo).

The only downside to not keeping the F1 in status is that, in case the adjustment of status becomes denied, your husband would now be required to leave the country as he cannot fall back on the F-1 status anymore.

Also, did he finish his degree? Because F-1 are allowed 1 year of optional practical training i.e. you can legally work for one year (thus staying in the US for one year). I know that the fees for the adjustment of status covers for employment authorization application while the AOS is pending. I don't know how simultaneous EAD applications (the other for the F1 OPT) would work out.

I'm sure that the international student advisor just wasn't familiar and didn't mean any harm. On the other hand, when I called USCIS to ask about an F-1 adjusting to permanent resident based on marriage, the person did tell me that I had to leave the country and wait for approval outside the US (which I knew was BS). This time around, my international student advisor was the one who told me that a lot of F-1s adjust to permanent residents while they're working via the OPT and not have to leave the country.

Hi, I'm a USA Citizen and I want to marry my girlfriend, who is an international student on a F1 visa. She currently attending college and have an I-20. Her Visa have expired in August but she still have an I-20 so she is still ok to stay in the USA. I read the Guide on this website and it seem I need to fill form I-130, G-325a, I-864, I-485, and I-765. Is these forms the correct one to fill after we get married?

Yes those are the forms you need to fill out...I'm an international student and have just filed for my green card... You say her visa has expired?? I think as long as she's enrolled as a full time student then she won't have any problems also make sure she doesn't leave the country otherwise they will make her renew her F-1 visa before she can enter back to the U.S.

I got my biometrics done on friday 10/17...but I'm worried that I still can't check my case online. My receipt number starts with MSC, does anyone know what the deal is? Also I have a F-1 Visa and my passport expires this December and want to know if i need a new passport to present at the interview??

omg!! i've been waiting and waiting for my biometrics sched and until today i have no mail yet... USCIS received oct 2nd, checked encashed on the 3rd and got noa on the 7th... i thought i will get my biometrics sched on the following week but nothing yet!!! why it took so long for my sched huhuhuhu... last touched was oct 8th.. hope and pray for the mail this week.........................................

Passed my interview and our journey is finnaly reaching its destination.

I arrived at the embassy at 8am and was told that I can only go in at 8.30am. Went through security check and was given queue number. I waited for about 10 minutes before my number was called and handed them the docs required. After checking the docs, the lady asked me to come back again at 1.30 for my actual interview. I was out of the embassy by 9.30am.

After lunch, I went back to the embassy at 1.00pm. I then again went through the security check and went straight to the waiting room. I was waiting nervously for my number to be called and there were 3 of us in the waiting room. At about 1.35pm, my number was called and I went to counter 6 for my interview.

The CO greeted me and he was young and polite.

CO: Tell me, how come you are married to a guy xx older than you?

CO: What makes you like him?

CO: How do you guys met? Where did you meet him for the first time?

He asked a few more questions about our relationship and then he cancelled my B2 visa.

At one point, he was saying "I am not trying to be rude or trying to intrude your privacy but there are people who are using marriage as a ticket to USA. I hope you don't mind me asking these questions."

And I replied "I understand"

CO: What does your husband work as?

CO: You were living in the states for the last 6 months?

Me: I was visiting.

CO: Visiting? So, you have not moved all your stuff to the states?

I smiled when he said that.

Then he went through the file and look through all the documents. He also took out the photos that I provided earlier and we were going through some of the pics. He also commented on some on the photos.

He gave me back all my original docs and also my expired passport.

CO: You are qualify for the CR1 visa. Congrats! Please be seated and we will give you the instruction on how to collect your passport tomorrow.

Thats it!!!!! Interview was done in about 15 minutes. I was really nervous but I am glad that my husband and I are well prepared. And we kinda expected that kind of questions.

Throughout the interview, I maintained a very good eye contact with the CO. I looked into his eyes when I was answering his questions.

I was out of the embassy by 2.15pm.

I am glad that this is over and I can moved to USA to reunite with my husband.

I would like to thank VJ for all the advise, help and contribution for the last 10 months. It sure does makes us feel better when we know there are people like us outside there. For those who has yet to complete the journey, hang on there and your patience will pay off one day!
