  1. Hello everyone,

    Will a faxed copy of the banks letter on when the account was opened and everything else work. I am stationed overseas so it will have to send it to my house then send it here then I have to send it to my fiance. This can take two months for that alone. I have given my fiance the last 14 months bank statements, 6 months of pay stubs, my letter of employment and W-2 for the last 3 years.

    I just need to know if I fax will work or not. Can anyone help answering this.

    I know I need the i-134 and documents supporting that but I need to know what original documents my fiance will need for her interview? I copied the packet before I mailed it to the VCS and I am starting to get everything together because I will be going to see her in may and want to have everything with me so I dont have to worry about mailing it and it getting lost in the mail.

    I know this is a stupid question but I still want to ask. Ok on question 7. company name when I write my company's name and I print only part shows and, when I write it by hand of course it will all show. However the it goes to the edge of the page and I am not sure if that will work. I do not think I can use the initals of my comany.

    What do I do if anyone knows?

    You can write by hand. If it is legible it will be OK. If in doubt, attach a separate sheet and specify it is the answer to the question. On the affadavit answer "see attached"

  5. Hello everyone,

    I am sorry to bother you with this but I am worried about one thing. I was married to a Philippine woman I wont go into details why I divorced her. She never has been in the states also. The point is I filed for a divorce and my lawyer did not pay attention to my county in Texas and filed in another county than I live. He told me it would be fine since they do not have rights over anything in the Philippines and I did not own anything while we were married.

    Now what I am really worried about is that mess up on the county that I was divorced will cause my petition for my fiance's K1 visa to be denied. If there would be an issue what can I do to remidy this. I am in Iraq supporting the military so I can not go back to the states for at least six months.

    I hope I am worrying for nothing.

    And again I am only asking if anyone knows whether this will cause my fiance's visa to be denied!!

I understand it is not a game that is why I asked for any information someone once told me that to get something notarized does not mean anything but affidavets are notarized and its just u swearing to something. I will have her go ahead and see about getting something from the Japan government that says she is single if at all posible.

    All we want is to be together and if we thought that showing how we feel by calling each other husband and wife in an email would be a potential denial point for a K1 visa we would have never started it. We call each other dear and love some but, for us using husband and wife is the most endering name even though we are not already married.

    All I can do at this point is to hope that the OC in the interview understands that it is just our way of showing extream affection for each other.

  7. I think the others that responded, misunderstood your concern. Your concern is that although you are not married, in you emails you refer to each other as husband and wife and she signs, Mrs (your last name). This is defininitely NOT GOOD but she may be able to explain it at the interview.

    Yeah but she only says that in the emails but at the same time not all of the emails does she use my last name. But everything she signed like the letter of intent to marry she signed using her first and last name and it was notarized at the US consulat in Osaka. The same with her G-325a and everything else she signed only the emails is where she will use my last name. I was just worried that they may think because of the email and only the emails that we are married. I was only divorce offically for 2 days when I got to japan and the divorce did not have time to be processed through the system to be able to get a divorce.

    I would suggest she stop referring to you as her husband or to herself as Mrs. ... and that you submit no more evidence that does so, then prepare both an explanation and apology for any confusion. They'll understand it is explained as some silly thing people in love do and you in fact are NOT husband and wife.

    My fiance called me husband in some of the emails I sent for evidence also. I see that it is bad but why is this a bad thing? Just curious

    Because being married would disqualify one from obtaining a K1 visa.

    I Understand what you are saying everyone and thank you for the advice I have already told her to refer to her self with her name not mine. I have also told her that we can not refer to each other as husband and wife in emails because my government is that stupid to assume we are married based off of emails.

    Now in Japan the only way to get married is civil they do not reconize church or temple weddings. If you wish to marry in Japan, you will do so according to Japanese law. Marriage in Japan consists of a civil marriage registration by the couple at a Japanese municipal government office.

    Only this civil registration constitutes a legal marriage in Japan. Ceremonies performed by religious or fraternal bodies in Japan, while perhaps more meaningful for you, are not legal marriages.Consular officers unfortunately cannot perform marriages.

    And since I was divorced on the 10th of November and left on the 10th from the states there is no way I could could get married. Based on the fact it takes a minumum of a week for the divorce papers to go through the clerks office in Texas. Second as I said above only civil is legal and I have not been to the consulat or an affidavet and would not be able to get one with out the divorce papers.

  9. Court certified (embossed and stamped) copies of divorce decrees are fine for sending in with the I-129F, OR, you can make copies of a certified, embossed, stamped divorce decree (using a xerox machine) and send that one it too and it will be accepted.

    It doesn't matter which county your divorce was filed in, as long as you are divorced at the time of filing the I-129F.

    I was divorced before I filed and its (emossed and stamped). I want to thank everyone for there input

    Well as far as getting denied for the name calling in the emails i dont see how that can hurt you. if you were married before and send in the documentation proving your divorce you should be ok. As far as the proof goes i believe that they are more interested in knowing if you guys met at this point in time and if you i guess qualify to go to an interview. I think that when you get to the interview theya re really interested in if the relationship is real or not. I also sent in a flight ticket as well as cell phone bills, phone cards, a letter jhonatan sent to my mother and i just got approved so that should work out. You should absoluetly send anything you sent to uscis to her. Anything can happen. Taking a duplicate of what you sent plus additional proof is always a plus. Being organized and having that information can save you valuable time. I would like to say that it really depends on the person that opens your paper and how organized your packet is. I read on here that a lot of people got RFEs because they did not put their pictures in a clear bag or something. I put my pictures in an envelope and still got approved. so if you sent off your packet dont worry about it until you hear something because there is really nothing you can do but wait. but i am sure everything will be fine :)

    I used document protectors and used a lable machine to label each on I put her g-325a separate from mine and the pictures in a clear ziplock bag and then into a document protector I had I think 15 or more different document protectors each labled. I believe my packet is organized and I wanted safe but easy to disassemble that is why I chose to use tocument protectors. I did not want to stapel or paper clip anything. I was very organized and methodical on how I put my packet together. My emails and hers were in separate too.

    I am only worried about the emails mainly however, my lawyer for the divorce filed in a different county than I live in but said it would be ok since we did not own any property. I hope since it is a court certified copy of the divorce that it will be fine with them.

  11. Hello everyone,

    I am worried about getting my I-129f denied. I send in a lot of emails that both my self and fiancee wrote to each other and, the reason I am worried because we call each other husband and wife in every email. She uses my last name in her signature on every email. What is the likely hood we will be denied and, what will I need to show that we are not married?

    I sent 23 pictures of us together in different areas of Japan and with her friends and family and I figured that would have been pretty good for proof. I also sent my the itenarary for the flight I took and the credit card bill for that flight and an Item I bought in Japan on my credit card. We also both wrote letters on how we feel about each other which was not required but I wanted to give them much more proof than they needed hopping that they will not delay the process asking for more proof.

    The other question I would like to ask is do I need to get another notarized copy of my letter of intent to marry and divorce and send to her? Do I need to sign a new I-129f and G-325a along with everything else I sent to the USCIS and send to my fiancee? I scanded everything I sent and emailed them to her but am not sure if I need to get everything notarized again.

    Ok sent my I-129f yesterday and made a copy of everything even the receipt of mailing it certified. The question is I was divorced and you have to send the original in but do I need to send an original to my fiancee too? What about everything else that was notorized do I need to get another original of them all?

    I need help with the I-134 I am trying to get it prepared to a certain point. I can figure out most of it but my problem is with question 7. The reason is I work in another country I can not mention where on the fact of operation security and all that fun stuff. So how would I fill that part out put the company address in the states but then that would not be the actual address that of where I work however, where I work only has an APO address not one for the country.

    I know this is a stupid question but I want everything to be correct on my I-129f to get my wifes visa. I need to know what to put for place of marriage is it the city or the country because, unlike the other questions it does not ask for a city just place. So does that mean city and country, just city or just country? Thank you for the help and again sorry for the stupid question.

    I am working on filling out my G-325a and it asked for parents residents. The example gives the same city of birth and resident for the parents. First question my father is decesed so what do I put and, second my mother lives in a different city than her birth?

    Then I married a filippina and divorced her in the states so my question is do I put married in Philippines or the the city & Philippines?

    you're RIGHT that the country (in this case Japan) needs to have jurisdiction over at least one of the people getting married.

    You're WRONG that the OP needs to worry about being a legal resident to marry a Japanese citizen in Japan.

    Again, the government has to have jurisdiction in order to effect a marriage. Same thing with a divorce.

    Let's say you move to England and want a divorce from your US Citizen husband who you married in Japan,

    while you were an Australian Citizen but legal resident of Japan (wow, that's a mouthful).

    Well, in order for the British government to grant you a divorce, they would have to have jurisdiction over at least one of you.

    The way the jurisdiction of a non-citizen if proved is by legal residency status or in some places a time requirement.

    Essentially, most governments consider that wherever you live for 6 months and 1 day or more, is the country that

    has jurisdiction over you.

    No reason to bog the OP down chasing after information that's not required for his case.

    There's enough bogging down to be done by the system as it is.

    Thank you all for your help we are still trying to figure out what we will do. We are thinking that after we get married that she will come to the states for 90 days then leave and then come back for another 90 days do that until she is given her immigration visa.

  18. Hi Duane ... if u millitary u can apply i-129 only Fiance visa i mean and u can expdite her visa and she well be in usa so fast almost 4 months ... good luck :)

    Im not millitatry so i cant do that and we want to get married that so that her family can be there at our wedding then we will get married in the states for my family. Im not a resident in Japan I just go on my vacation to be with my fiance. If I file for residecy in Japan that will be a long wait and, then I dont know how that will work if im only there for a few weeks out of the year.

  19. I need some help on this my fiance and I want to get married in Japan she of course is Japanese. I spend 320 days in Iraq working so we dont live together but 16 days every 4 months. What do we need to do and how long would the process take. Also would it be wise to marry now so that we will get the visa by january of 2010? Thank you for any help.
