  1. Hello VJ friends, this is regarding my friend who is married to a Navy and doing her AOS. They received an RFE saying not meeting the 125% income. They have only submitted his 2008 and 2009 W2 and not the tax form so I assume that causes the problem. I have advised him to submit his tax forms 1040 along with the W2's but according to him his line 22 of the form shows his income not being sufficient. He said some earnings that they receive are not being tax... does anyone knows about this? Can you please help us on what to do and what documents to submit to respond to the RFE? Thank you

  2. Approved1 :) dance dance dance. Our interview was yesterday... he just ask some questions like what is special about him, about me. and what my husband do. He ask for supporting papers but he didnt even look at them. He told us in a joking way that it is the immigration rule that for me to get a 10 year visa after 21 months we should have twins and its a requirement. It took about 20 mins since my son who came on a K2 visa was with us. He was ask his age, the capital of CA and the capital of US and 12 - 3. Just waiting for green card to arrive in mail :) Congrats to all of us

    My wife has her interview two weeks from now in Manila, Philippines. If anyone has recently interviewed at the Embassy could they please let us know what are some examples of the questions and the demeanor of the interviewers? We would greatly appreciate your input.

    I was interviewed in Manila too on a K1 visa same office they are interviewing immigrant like family sponsored visa's. They ask me how me and my fiance met, how many times we met, where and when, what he do for work, if I have met his family, they have ask about my son, how old was he and his birthday, they ask how many times my fiance has visited Philippines and when. Since I was working in Dubai at the time of our interview and came back to Philippines for our interview they ask me about my work in Dubai and if I am still going back once my visa is approved.

Just looking into this information myself, and wasn't going to file for an EAD for my 11 year old daughter, but now think that she needs a SSN to be claimed as a dependent on our 2010 tax return? We were told the same by the SS office, that a K-2 can only get a SSN with either an EAD or their GC.

    Would be glad for any information anyone might have about this.

    For the time being, I'm going to go ahead and submit the I-765 for her. If she's not eligible, they'll deny it.

    Have you filed your and your daughters AOS? If not then you can file EAD along with your AOS and it is free. She is actually eligible for an EAD, some file along with AOS since no one can really say how long AOS will be approved. I did'nt file for my son when we filed EAD since I thought we would get our GC in 2 to 3 months after filing AOS but unfortunately it took longer than that so now I am just waiting for AOS approval before I could get him an SSN. If you already filed your AOS you can apply for an EAD for her and send a copy of your AOS NOA so you don't have to pay the fee. EAD and travel document (I-751 and I-131) are free when filed along with an AOS application (I-485). And yes you are right they need SSN to be claimed as dependents on tax and sometimes depending on how strict your insurance coverage ... some do not cover someone who do not have SSN

In response to our RFE Affidavit of Support... we submitted my father in laws tax transcript for the past 3 years, filled up and signed I-864 by my father in law and for current income since he is doing contract job right now his Form 1099 and 1st pages of his bank statement showing total deposits and total withdrawals every month for a period of 1 year, we just wanted to show that there is consistent income coming every month plus it is back up by his form 1099 from his contractor.

    We recieved our interview letter for Dec 8, 2010 so I guess our RFE response was sufficient.

  6. You usually don't call, you just walk in there to see if they will allow you to do an early biometrics. My advice is either go early or around 3 pm when they are not too busy to take you in. In my experience we did an early biometrics, we arrived at 3:15 pm and in 15 mins me and my son are both done and the room is empty. Everyone in the USCIS was nice to assist us, they just look at our letter and ask to fill up the form, finger print, took pictures, signature and that's it. You try to find out how walk in works in your area if there are successful stories no harm in trying :) It was a good thing I did early check in coz right after my biometrics my case showed up online and my RFE notice was sent to me.

    * Beneficiary is $1010.00

    and to the Derivative of beneficiary $600.

    i wonder i though its only cost

    $1010 for all what is a $600.00 for?

    Oh I am filing along with my son... he is my derivative so that is the payment of $ 600 is for. If you are filing alone without any K2's the paymetn is $ 1,010.00 before Nov 23, 2010. After that a new schedule of payment should be followed, check USCIS website for the updated fees after Nov 23, 2010.

  8. I am an advocate of Microfinance and supporter of Mindanao Microfinance Council... this is very true. A lot of microfinance worker put their heart in what they do as it may little it makes a lot of difference to some people's lives. I used to visit poor areas around Philippines particularly in Mindanao to see how microfinance has helped them and it is really touching when you visit a simple family with a small sari-sari store in front of their house and a mother who is very thankful to microfinance that it has helped them improve their lives in some ways. Go Microfinance! End poverty in Philippines!

  9. Someone here from VJ did a walk in San Diego, CA to a center which was not in his appointment letter. He was turned down in the center where he was suppose to do his biometrics and did a walk in trying his luck. They said no so what he did he drove to the next center near where he live and they did his biometrics for him.

    Well, I guess it depends on how friendly the centers in your area and with your luck. If it is no that far you can try and do it in the center near your place but if it would mean driving for 2 hrs just to get denied to a walk in is not worth it.

  11. Not necessarily in the country that you are from. I think in the form there is a question that is asking for Embassy where to process the visa, if your wife put Singapore then you can process your visa in Singapore as long as you are legally residing in Singapore (valid work permit or permanent resident) that means you will do your interview in Singapore. However, most people had advise to process the visa interview and all at their home country like in Philippines where results are more predictable and might be an advantage since you are from there.

    I process my papers in Philippines while I was working in UAE. I came home to do the interview and went back again to UAE to end my contract since the visa has a validity of 6 months to enter US upon issuance.

  12. If it is a lot not all... among your chat choose random 10 conversations and translate them to English and the rest of the chats and email take a snapshot. Well ours are all in english since my husband don't speak tagalog though he was a Filipino, he grew up here... and the cards yes you have to translate them to English. I have a lot of emails and chat since we have been away from each other for 4 years so what I did is I print the first few emails when we started communicating... some emails in the middle and those that are recent and with the chat converstation... I just pick up 10 random conversation from beg till recent. You might want to do the same. All other documents like birth certificate, cenomar and other legal documents are already translated in English from Philippines.
