  1. Does the case after it is completed get a date and it is sent to the embassy or does it get sent to the embassy and then a date is assigned? I don't have a date yet but my case was completed on the 12th and now on 25th left for the embassy. I always thought the completed case doesn't get sent out until a date was assigned. Any ideas, does this mean a date may have been set or they will let the embassy pick the date once it gets there? Thanks

    I'm not sure about that.... i think the date gets set before it goes to the embassy. Also it could depend on the country - ours is Mexico. You could call the NVC and find out though

  2. did it say on the AVR that you had a date? or the wait 8 weeks deal that I am getting when I call?

    No it didn't say it on the AVR.... but i pressed 5 to speak to an acutal operator!!! They told me yesterday and i called again today to verify it. I recomended that everyone keep calling - don't listen about the waiting until the 2nd week of each month and the AVR's message to wait 8 week to get notification. You should call :star:

    Yeah that's what i thought - i'm not sure how true it is that they only schedule during the 2nd week of each month. I called on February 20th and they said i hadn't been scheduled this month and to check back during the 2nd week of March. For some reason i decided to call yesterday and they gave me this date! My lawyer told me not to make any arrangements until we have the actual letter in hand.

I called the NVC automated voice line last night and it said they had received our packet of information (assuming Affidavit of Support) but that there was missing or incomplete information. Also said they mailed a letter on January 14th. What could this be about????? We have a respectable attorney so i can't imagine them missing something. Anyone else with this experience?????

    This is because they are waiting for your DS-230 packet to be sent it. Also, talk to operator and confirm that there is no RFE yet.

    Oh okay.... is this the packet where my husband has to send a copy of his passport; original birth and marriage certificate; etc??

    Online mines says they sent it out on Dec.1 but i havent got nothing in the mail yet. Does the new number come with this letter?

    You can call the National Visa Center and get your new NVC case number. You don't have to wait on the letter. All you have to do is enter your receipt number from USCIS. My approval was on November 26th but NVC didn't receive it until December 1st. This is when i got the new case number.

  7. Did you file an I-485 with your I-130?

    Overstays or beneficiaries who have been working unlawfully normally file I-130, I485, and I-485 Supplement A (unfortunately there is a penalty of $1000 with the I-485A for overstay and/or working unlawfully).

    From the instructions for I-485 Supplement A (which is what your husband appears, without any other information, to fall under):

    Section 245(i) of the Act allows certain aliens to file for adjustment of status upon payment of a penalty fee of $1,000, even though some of the conditions required by section 245(a) and © of the Act are not met. Aliens in the United States who have an immigrant visa immediately available, but who entered the United States without inspection, remained in the United States past the period of admission, worked unlawfully, or are otherwise ineligible for adjustment of status under section 245© of the Act must submit this form along with Form I-485, Application to Register Permanent Residence or Adjust Status.

    The advice to consult an attorney is good advice, but if you have not filed the I-485 for AOS, and assuming that you, the spouse, are a UC citizen, this will likely be your next step. The approval notice for the I-130 petition along with proof of your citizenship is an attachment for the I-485 which will meet the requirement for "immigrant visa immediately available" for him.

    NO THE ONLY THING I FILED WAS THE I-130.

    SHOULD I GO AHEAD AND DO THE I-145??? :blink:

    We mailed out our application for I-130 in May 08 it was pending for 6 months. on Dec 1st i got an email saying that it was approved.

    Can anyone tell me what is next.

    Hey glad to see someone else from Mexico with a similar timeline!! Our I-130 was approved November 26th. We have a local attorney. My husband is too illegal and has been here for 10 years. He'll have to file a waiver and i heard it's basically impossible without an attorney.

    I KNOW GOOD TO KNOW FOR ME TOO THAT THERE IS SOMEONE ELSE FROM MEXICO TOO.

    I HAVENT GOT AN ATTORNEY YET CAUSE I DONT KNOW IF IT IS NECESSARY.

    He's from Oaxaca.... and your husband?? I would advise an attorney since he's been here so long illegally. From what we've been told, the next step is the Fee Bill Package; Sponsorship Package; then the Waiver. After that, just wait until the interview. We will be flying into El Paso and taking a taxi over to Juarez. Maybe we'll get lucky and have the same interview date. I'd like to know someone else while i'm there :star:

  9. Congrats to all... but I'm feeling a little left out. My I-130 petition was transferred from VSC to CSC on 11/05/2008... but I'm still not approved and I haven't heard a thing. It's been 206 days since it was received, but who's counting??

    Also, many of you have entered "touched" in your timelines... how do you find out if your case has been "touched" and what exactly does that mean? I have checked my case status online and signed up for e-mail notifications at USCIS, but have only ever received the I-797 NOA's in the mail... am I missing something? I'm trying to be patient, but getting a little worried.

    Log in to your USCIS account and look at the date under "last updated". If the date has changed, this indicates a "touch". Most of the time the status hasn't changed but the date will. Don't worry, it was several months before i ever seen a touch. But after i started getting them, our case was approved in about two weeks. From my understanding a touch means that your case is being accessed by someone at the service center - correct me if i'm wrong. About the e-mail notifications, i signed up for those too but never received a single e-mail! Don't rely on that. Good Luck!

    My I-130 has been approved!!! Yippe. The I-130 was transferred from VSC to CSC on Nov. 6th and Approved on Nov. 21th. Thank you lord. Now its time for the NVC. The notice says that NVC will send the info to my husband. What should I do? Do you think I should call NVC?

    Congratulations. :) Yes this is a lovely christmas present!!! Let me know what your lawyer says about the next step. Because the notice says it could take up to 90 days for NVC to contact my husband (the beneficiary). I want to do everything I can to speed up the process. Thank you lord for this.

  11. Hey guys............. OUR I130 WAS APPROVED!!!! :D Just got notification online that our NOA2 approval notice was sent out on November 26th!! Our case was transferred to CSC on November 5th from Vermont. What a wonderful and early Christmas present!!!! I know there were tons of cases transferred to CSC in November so i hope this gives some people hope. I wish the same for everyone else still waiting!!! :goofy:

  12. I checked the USCIS website and it looks as if they updated our case as of the 26th of November but there is nothing mentioned on what they have done to our case. Is that a touch that i see some talking about on here, what does that mean. Is this a good thing or a bad thing. Any insight is helpful. Thanks Chuck and Teresa

    I think it's a good thing! You can see by my signature below that my case was "touched" several times in the two weeks prior to the approval. Just found out today that our I130 was approved on November 26th. Good Luck :-)
