  1. Hi,

I'm ready file I751 but I don't seem to remember I changed my AR-11 to current address 2 years ago or not.

Is it too late to change it now? Should I just submit I751 since it might confuses them?

More and more I think of it, I don't think I changed my address to current one when we moved here. Stupid.

    Would this be a problem?

From what I read online, the address on the 751 is the address that they will send correspondences to.

  2.

We just had our interview yesterday. Everything seemed to go well, we answered all of the questions truthfully and substantiated our relationship. The interviewer took the visa from my wife's Philipino passport. My only concern is that she would not conclude whether or not my wife would actually be approved for her conditional greencard.

I'm about 99% confident we're approved, but what do you think? Is her taking my wife's visa a telltale sign that we passed the interview, or is there a possibility that they are going to ask us for more information?

    thanks

From what I read online, you will receive some notices:

    1) Notice of intent to deny - which is USCIS request for more evidence from you because the officer was not convinced of your bona fide.

    2) Notice of Stokes interview.

CINCINNATI, Ohio — Federal authorities have charged 50 people in an alleged Cincinnati-based scheme to arrange sham marriages to evade U.S. immigration laws.

Authorities unsealed the indictments Tuesday of 23 people they say are in the country illegally and 27 U.S. citizens involved in sham marriages.

Federal officials say all 50 suspects are charged with marriage fraud, 49 are charged with making false written statements and 39 are charged with making false representations.

Each crime is punishable by up to five years imprisonment and a fine.

Those in the country illegally also face deportation.

Authorities say illegal immigrants paid fees to U.S. citizens and leaders of the operation to arrange marriages and create false marriage and immigration documents.

The ongoing investigation led to 10 indictments in March.

  4. The wife just went to the biometrics at USCIS application support center this morning, and everything went alright. Except, when we checked her passport, the I-94 stub was missing. Is this normal at the biometrics interview? I had seen in another thread that it is usually taken until the interview itself.

Also, she was told she had to wait for an officer to "approve" something, but she didn't really understand what that "approval" was. She saw that on her form they had us fill out they put her maiden name (we filled it out with her married name). Could it have been this? or something else?

    Thanks,

    Felipe.

Not having an I-94 will cause problems at the I-130 interview.

  5. cuz if we end up waiting forever, I might just consider this. and I heard Canada is eager for new immigrants anyways?

    False.

I read online that Canada has a lot of unemployment. doctors, engineers, and specialists from foreign countries are working low wage jobs and driving cabs and bussing tables and janitorial. To open your own business requires $800 grand, plus extra for your moving expenses. High taxes also will reduce your discretionary income. google "not canada" for the truth.

  6. I have not heard of this anywhere on VJ, and it seems a bit far fetched to me, but I would not be surprised were it true.... a friend of mine knows someone who was visited by an officer, and he wanted to see their living situations (ie, were they living as a married couple)!!

Apparently it happens to a few people down in southern california, but I have never heard of it before! Has it happened to anyone here? Is it just something of the past?

Not that I am worried, cause it would work in our favour! But would like to be prepared for a scary knock on the door!

Your friend made a big mistake in letting ICE enter the premises. They are only allowed to enter if they have a warrant.

  7. since your 485 will be denied, and you still obviously want a green card, I suggest that you talk to lawyer about VAWA. He will tell you the requirements of VAWA. There's a good chance you might get a green card this way. VAWA is dependent on many things, but among them are 2 crucial pieces of evidence: that your marriage was bona fide. that your marriage was abusive. If the judge is convinced by the evidence, you will get a green card.

consult with an immigration law attorney, who has experience with immigration court.

VAWA means violence against women act.

  8. a better question is, why would this guy leave the usa, leave his wife and kid behind, enter usa on b-2 to attend his residency program on a b-2? does not make sense to me, and i think CBP made a good call by turning him away. better not get caught later on misrepresentation. that will haunt your future chances of LPR.

  9. From what I read online, First, they will issue a Notice of Intent to Deny, which they will mail to you in 2-3 months. You will have the opportunity to submit new evidence to rebut or explain why the 130 should not be denied. Keep the case open. Don't let it get denied, or else ICE will come get you.

People have gone to more than 1 interview. So expect another interview or more interviews.

    Major highlights fta:

"expects to have a bill ready by Labor Day that is more generous to highly skilled immigrant workers than those who are lower skilled and is tough on future waves of illegal immigration.

The department also said it is abandoning a Bush administration plan to force employers to fire workers who can't resolve a mismatch between their Social Security numbers don't match their names. The administration said it would come up with a new rule."

So, in other words, increase quota of H-1B visas.
