Thanks Ken86. I read both the forum DCF guide and your thread. The guide says 6 months though. It also says;

In addition, emergency cases, such as life and death of health and safety, and cases determined to be in the national interest can be processed without the residency requirement being met. Examples of family emergencies include minor children who would be unexpectedly left without a caretaker.

This would have applied to you and you could have applied without the residency requirement.

By the way, how much time does New Delhi take from DCF filing to visa stamping?

Well i told them about the emergency case in mine. but they said we have to complete the 3 month process and apply it...it says that is not for Indian embassy and consulates ...

well for most of the countries it is 6 months but for India its 3 months...

well from the day u file the petition(I-130) it takes around 2 months to get the visa stamped..

well as soon as u submit the packet 3.5 after filing petiton.the quicker the process will be ..

Please apply for police certificate now..coz in india it takes arnd 1-2 months to get it....

Do register your marriage in Indian court thats compulsory....that also takes arounbd 15-20 days...

for that your wife has to go to US embassy and get the NOC certificate for marriage...to apply in indian courts...

I was also looking for DCF information. Regarding registering marriage in India, is it fine if it is done via "Registrar of Marriages (as done for indian cititzens)" or is it mandatory to register it in Indian courts. If so what is the procedure to get NOC from US embassy. How much time did they take for it.

I own property here in India. So based on that is it possible to get residensy in India? I own that property since last 5 years. I am not sure what other details they need if it is based on owning the property...

I was wondering if they would allow based on a stay of three months and work for about months or so, or if one had to work for three months too in India. Also I was wondering if they would allow if the person keeps the job in US and simultaneously works in India too in the three months duration. I am the petitioner in my case. Thanks for your help.

Hope your application process is going on smoothly. For applying through DCF could you please let me know how long you stayed in India. I read before that in Delhi they were accepting some cases with a stay of 3 months. Did they ask you any specific questions about the duration of your stay in India?

well my wife is petioner and iam benificiary...so she stayed here 3 months and she got her residency here.

well my case went like this in US embassy when we went to file I 130

we went to embassy waited in line for 6 hours and they finally called us. My wife told them that we need the seprate room to discuss our case. And they took us in seprate room and saw all our documents. Since we are already married in US and we have a daughtrer there which is 2yrs (actually not my daughter its from my wifes ex-Boyfriend) so CO saw our daughter birth certificate and he checked my previous F1(student) visa in computer he said i dont see any immigration proceddings in your case and even he said that he is not sure. But i know i dont have any immigration procedings in US and then he checked our I 130 and G-325A marked with red pen and collected all our documents and he said your petition is approved! Then he gave us the packet 3.5 by hand and he told us to read it carefully and send all papers to VFS address. now the thing is in those papers are asking me the case number which I dont have.....IM BIG TIME CONFUSED... ..my paperwork is all ready and ready to send but doesnt have case number ...

Did you apply for DCF processing or K3? I am also interested in DCF. So I just wanted to check if about 3 months of stay in India is OK to apply for DCF. Could you please update about which option did you choose?
