  1. I am getting ready to send in the I-129F Package, and I am thinking ahead for the Affidavit of Support (I know I don't have to include this now).

    I am wondering, I may in fact make 125% above the poverty line for a family of two (my fiance and I), but I recently relocated and started this job mid-April, so I wont have a tax return by the time I need to fill out the Affidavit. Can this be ok? Do I just keep collecting my pay stubs, and maybe get a letter from my employer which states how much I make and how many hours I generally work?

    Also: Just to make sure, this is 125% above the poverty line BEFORE TAXES, right?

  2. I have a question about the Declaration of having met within the past two years. I first met my fiance on a trip to Cuba in Sep 2007. Then I went back to spend a month with him June 15 - July 17 2008. Then I most recently spent February of this year there.

    My question is: If I don't have proof of being in Cuba the first time we met, should it be included? Should I just just lay out the date we met and the dates we were together, and state that I don't anymore have proof of the first meeting, but here is evidence from the last two times we were together?

    Also: The last time I was there I brought all the paperwork and we signed the documents at the very end of February. I am just now able to send in the package - hopefully within the week. Is this passage of time going to affect us?

  3. Thanks for the reply. Another question: Is it necessary for us to pick up the package from the Interest Section, if we can just download the forms anyway? Are there other things besides those forms that come with the packet that need to be picked up? Even if it is only the forms that come, is it necessary to pick up the packet in the process of things? Do they care if we never pick it up?

  4. Thank you both for the wonderful information. And thanks for breaking it down for me. I don't have a timeline because to tell you the truth I haven't ven sent in the I-129F yet. I am on the verge of having it ready to send in. I am already asking all these questions because I really need to have things well planned out for this process, and need to know more or less exactly what I am going to have to be doing while I am in Cuba. Thanks for helping me get a better grasp on this part of the process, it is kind of hard to find Cuba-specific info, you really have to spend time searching through the forums.

Once the packet arrives in Havana? Is it ok if the packet sits at the embassy for a while? If I have all this information, and can download all the forms from the website, do we even need to pick up the packet at all?

    Also: If he is single and has never been married, does he need additional documentation that he is single?

    The thing is that I am planning on going to Cuba to be with my fiance for his interview. It is kind of difficult for him to travel to Havana, so I was thinking I could just pick the packet up when I get there. But in doing this, would we be waiting too long if we have to be sending things in order to get an interview date? My understanding was that the packet 3 would be sent to Havana, I could pick it up when I get there, we could fill out the documents and bring them to the interview, for which we would already have the date set up.

    I know there are things he must do and documents he must obtain, like a medical exam, a letter from his job, etc. My understanding is that this list comes in Packet 3. Would it be better if we just arrange for him to make it to Havana to pick up the packet and start getting those things done, in order to make an interview date? Or will we be able to make in interview date and THEN get those things done, and bring them to the interview?

    Can someone help me sort this out?

    I've read on the forums that the medical exam for my Cuban fiance is paid for once he receives his Carta Blanca to leave the island. But doesn't he need to have the medical exam before the interview? If so, we don't have to pay for it until he gets the carta blanca?

    Can someone clarify this for me?

    My fiance is in Cuba. They send Packet 3 to the US Interest Section in Havana, but I have read that all the papers that are being sent can be found on a government website. Can I just download them and bring them with me when I go? Are there other things in the Packet 3 that we will need, aside from those forms? Can the packet stay in there for a while before getting picked up?

    Do they also send Package 1 (the original package I sent in first) to the Interest Section?

    When Packet 3 arrives there, it has been said that my fiance needs an appointment to pick it up. If I am going to be there for the interview, can I just pick it up when I get to Havana? It may be hard for him to travel to Havana just to pick up a packet.

    Sorry if this seems like a silly question to some of you, but I am getting all the things I need around to send the first I-129F package to the USCIS, and I am wondering: What is the best way to put it all together? With all the photos, ticket stubs, emails, forms, etc. Should I get plastic paper covers and use those for each individual item? Or should I just use paper clips? Can I just put everything in a manila envelop? Should I use a folder? Should I put it in a binder? What did you all do?

    I'm sure this question has been asked a number of times before, but the search hasn't led me to an answer.

    We are filling out the I-129F and G-325A and are not sure how to handle the name of my fiance. He is Cuban, so he has a first name, a middle name, and two last names. Should I try to condense a few of these, like put his first and middle name in the "first name" spot, or both is last names in the "last name spot"? Or should I put his second last name in "other names used"? Or should I make a note and put his second last name on a separate paper with an explanation?

    I think this is the only thing I need to finish filling out the forms.

    I am going to file for a K-1 soon, after one more visit with my fiance in Cuba. I know I will have some more time to think about it, but I am already thinking about the sponsor, and it has been kind of difficult for me to find family support. I am still in search of a good friend with the financial means to help.

    My question is this: If I were to be in school and receiving student loans that amounted to more than 125% of the poverty line, would this count as acceptable income?

    I am looking for ways to just do this myself, if need be, and this is an idea that occurred to me. Are student loans acceptable as income when there is no other job to back it up?

  15. Hello all, I am about to move to Louisiana and I am still just a little confused about addresses, if someone could help me sort this out I would really appreciate it:

    I have been told that there are two different addresses they ask for when filing for the K-1: a residing address and a mailing address. I have also been told that it is good idea to have a stable mailing address, so as not to lose any mail or cause any delays due to address changes. I have also been told that it doesn't matter where I live during the process, as long as I have a set mailing address. Are all these things true? Also, if my "residing address" and my "set mailing address" are in two different states, how do I know where to file (Vermont or California)? Which address is the "official address", so to speak? Is it the mailing address that is the most important?

    I have been nervous about making a move before starting the K-1 process, and am unsure about these address issues.

  16. Each form requires different information. Where your mailing address is and where you reside.

    There are only two centers that handle K1's. Vermont and California. See the link above I gave you.

  18. You need to file with whatever center handles the state you are using for your mailing address on the petition. Here is a current list.

    Even though they have a change of address form, as Yu and Dan stated, I would not trust any changes made. You need to use an address you know will stay consistent as you will need your NOA2 hardcopy and any relevant documents (rfe) throughout the remainder of the process.

    So, please tell me if I have this right. It does NOT matter where I live during the process. I just need to file in whatever state my mailing address is in. So if I use a constant mailing address like my mother's, and she lives in Michigan, I would have to file in Michigan. Even though I live in Florida and will be living in Louisiana, I can use my mother's address and file in Michigan? This means I cannot use my mom's address and file in Louisiana? This also means that if I file in Louisiana I should make sure to have a fixed address in Louisiana throughout the process?
