  1. Terms are important in this process - this changes everything. If they are not married, I see it very difficult for her to be awarded another tourist visa; since this coming and going will not go well with immigration authorities in the US.

    What destination is this you keep talking about? Did they get the names of the border people? I still cannot phantom how the hell they destroyed the passport --- first I have ever heard of this.

    I dont know, but Ive heard of Many, Many cases ((Mexican)) where people have attempted to get the Visa, they get their passport and Officers Cross it out and they cannot got for a second round...there's other where they get crossed out and they can attempt about 2yrs after-and there's others where the OFFICER TEARS it up and destroys it...

  2. As well, the brother is a Permanent Resident of the US, not a citizen so could not file for any of the K visas anyway. He can file a CR-1 visa which will take some years before an immigrant number is available for her, but if he becomes a citizen in the meantime, can update the application and she can then be processed immediately.

    I too am concerned about the border officials both destroying the passport and killing the rooster. A lawyer is definitely indicated, as well as advising the Mexican Passport Office about what the US authorities did to the passport. The passport belonged to the Mexican Government, not to the Individual.

    Exactly right. The OP's brother should be already contacting his nearest Mexican consulate. this is too strange -

    I thank you all for your responses...we're just not sure what the process would be...let me make a correction, they are BF/GF, they are not married....I apologize for the confussion....

    Im sure they will come back to the Border and speak w/the Immigration Offices, they just had to arrive to the destination...but we didnt know what arguments to use or say...we thought Officers were correct...but they were mistrated and discriminated..there's other things that were said and done, that make it even more difficult...the officers used profanity...attempted to use force, and intimidated them and the child...

  3. What is it that your brother wants to do? There are many things that you have stated in this post, that indicates that your brother and his wife was co-habitating in the USA. So, I'm not quite where what advise you want to recieve.

    Are you looking for the correct and legal arrangements that your brother should have followed?

    Well they want to know what to do...so that she is able to travel Back and forth as she was doing before...they didnt think they were violating laws b/c she does not come and work...she comes and stays w/him and then she goes back...

    and Yes, what legal arrangements should they follow?

    they have not contracted an Attorney as of yet, bc they have just arrived to their destination, but yes, they took her passport and destroyed it-

    My Family is going through a situation and we don’t know how to handle it or what we can do…if there’s anything we can do!

    This is mainly concerning my brother, who is a Legal Permanent Resident-he met his wife, who has ((im not sure what kind of a visa it is)) but she has the Mexican passport w/the Visa that is given for 10 years and they come and visit for 6mos @ a time…they have been together for about 5 years now and had a baby in 2008-she stays in the states for 3-4 mos and goes back to Mexico for about 6-7 mos, then comes back w/her permit…well, about 3 weeks ago, she went back after being here for 5 mos and Inmigration took her passport away along and destroyed it-apparently, they ‘discovered’ she had the baby in the states and had been living Illegally in the states-she was not, she had the baby in the states, but was OUT of the states for 5-7 mos and revisited for 3-4 mos-Inmigration treated her very poorly and attempted to take my Brother’s permanent residency away as well-for having an illegal residing in the states they said…they were mistreated and abused…he was bringing some roosters-with documents-to Mexico-and the officer gave them a shot and killed them-we have found out that it was illegal for them to kill the roosters being that he did not cross the border, he could’ve been sent back w/them or kept them, but not Killed them-I guess they are protected by the law-do you guys have any suggestions? Is her passport expired? Did she lose her rights? Any ideas on how to proceed?

    It is with great pleasure that I share these news w/you...interview for my wife has been scheduled for April 2nd!!!!! cant wait!!! we are both really happy to know things are coming back to a 'normal' status...thank GOD for all of this...I truly couldn't have done it w/o God!!!   7. Visajourney Family, Im delighted to share GREAT news w/you! I received an email from NVC advising me of the appointment for interview!!!!! Is it more of an invitation? this is what it reads "An immigrant visa interview has been scheduled for the applicant at the U.S.

    Embassy/Consulate in CIUDAD JUAREZ on at 02:45 pm.""< I dont have a date...only a time stamp...what should I do??

    I just now found out and wanted to share w/you...Im calling my attorney first thing tomorrow! you ALL have a GREAT month and GOOD luck to all those pending for approvals...=)

    Awesome news....we are PREGNANT!!!!!! 6 weeks...saddest thing is my wife and I have not heard about INterview scheduled yet...we still got a couple of days left to know...((NVC sd we'll hear by the 20th if scheduled or not)) so, im keeping my fingers crossed....does a pregnancy prevent the beneficiary from comming?? I would say no, as it is my understanding that children born to US CITIZENS outside the US have immediate US CITIZENSHIP...I would just have to know what the process is JUST in case 9 months go by and we havent been scheduled...which I have FAITH will not take that long...

    what do you think?

A mother died in a terrible accident...leaving two children behing ((a 2 yr old and a 2 month old)) 2 years ago...the father abandoned them w/their grandmother...my wife and grandmother have had both children for 2 years after the mom's passing...I want and would love the opportunity to adopt the 2 yr old ((now 4)) and bring her w/us...the problem is, i have read several articles where ONE must live w/the adopted child 2YEARs before one can apply/petition...then I find other articles, like this one

    "Only US citizens may petition for the immediate immigration of foreign adopted children."

    .does that mean I dont have to meet the 2-year requirement?

    is there anyone adopting or going through this process??

    before u as a usa citizen can even think about adoption u have to get a home study to do that u can contact any adoption agency or u can contact the childrens protective agency and ask them if they have someone on staff that can do it for u

    the last one my mom had it cost about 1,300, u wont be able to get a child that u want to adopt into the usa with out it, u dont need one for each child if they are siblings but u will need to start with that

Thank you for replying...that's what I thought I understood from the 1st operator I spoke with...she said 'your case completed today, feb 9th and no further information is needed. we now have to send to embassy for scheduling, we schedule appointments as they are given to us by embassy by the second week of the month, to know if your interview is scheduled for March, we must wait and see if your case is sent by Feb 20th"...than I called back and the second operator gave the same information...im hoping I was given accurate information...

    I called NVC 02/09/09 to question my wife's case...It has been COMPLETED at NVC and is pending for Interview to be scheduled at Ciudad Juarez...they have given me hopes that POSSIBLY in March...they cant say YES or NO for scheduling, we must wait and pend unitl about Feb 20th to find out if scheduled or not...has anyone that sent I130's in August has been scheduled? anyone processing through Ciudad Juarez in Mexico? Any Ideas will be greatly appreciated...Thanks! and wish me luck!

    I have signed the paperwork for the attorney to send to Visa Processing Center...apparently this should be almost the final step...All we do now is wait for visa processing dept to complete and forward to Cd. Juarez for the interview...has anyone completed this process yet? what should I expect?

    Im really excited! i cld NVC today and they generated a 'package' on 10/20....she metioned something about fees so Im thinking its the DS?? and the affidavit of support!! im really hoping things go by smooth and fast, I have all they need except letter of employment, my job does want to give me the info yet and my attorney has not sent me the letter requesting such information from them!!!!!!!!!!!!

    I guess all I have to do now is just wait for things to come back in their place...THANK YOU GOD!!!!!!!!

    has anyone else heard anything yet????? any ideas of what's to come?? Thank you!!

    I am a US Naturalized citizen who is married to a Non-US resident/citizen...she lives in Mexico and has never visited the US. I filed the I-130 (petition for spouse) what visa category does she fall in?? I have read the visa types and seems to be that none of them apply...my attorney advised we only filed the I-130 as I-129f is taking just about as much to process as this petition...please let me know if you have some info to share! what visa Category should I consider her case to be? k-3? CR-1?? Thanks!

    I filed form i-130 in the month of August 3, 2008. I received receipt from immigration on August 12th...originally, I filed as Permanent Resident, but became a US citizen on that same date. I called Immigration, my attorney sent copies of my Naturalization Certificate on the same date...On August 27th, I received a letter advising that my case had been updated to a new visa Category, to US citizen Rather than Perm Res...Im not so sure about the process, what does it intale, what is required, what to expect??? I did not file a I-129f as my attorney thought it would be best to request Permanent Residency on form I-130...was this the best option?? how long is processing usually taking?? I got married in December 2007, and have been separated from my wife for last 6-7 months awaiting processing...any suggestions??

    Im sorry...but Im really not so sure what the process is being and not being a citizen...what happens when? and what are the steps/procedures/? is there paperwork I might need that I can get together before it is requeste?? Thanks for your help...its really appreciated!!!!!!
