  1. Go with what a local notario says to you! US consulatar officers go with local laws. That would mean that the Natural Father would have no reason to stop the process! Too bad you did not find out the info before your wife showed up in the USA! It would have been better the whole family showing up all at one time.

    Hello, I am the American Citizen and my Colombian wife has a 12 yr old daughter, who has never been acknowledged by the Natural Father. The Father's name is not listed on the Birth Certificate. I am told by her and by various Notary's that under Colombian Law he has no rights. We have the interview for the Green Card coming up in 5 weeks. I am concerned that at the Interview it may cause a problem. Does anyone have experience with this type of matter. The Natural Father has not been heard from since the time of the Birth or paid a peso in expenses.

    it would not effect your status. As a US citizen, your husband is entitled to 'means tested benefits' which is what food stamps are part of. You will be entitled to those as well as soon as you have been a resident for 5 years or have become a US citizen yourself.

  3. You can get the immunizations before the medical exams, but the Doctors want to see your interview appt letter before the exam. It was sent to us via email, so you might get it when you are there. Their price was better than any my wife could find in Cali. They may give shots that need to be taken a 2nd time a month later. I am not sure how this 2nd rounds of shots effects the interview. My wife will need to go back to Bogota for a 2nd interview, but she has the 2nd round of shots now.

    We got the letter saying our I-129F was approved June 29, 2011

    To date the NVC has not received the approval package from the USCIS.

    NVC investigated the status for me with USCIS and on July 25, 2011 the USCIS informed NVC it would be on its way.

    My question is. I will be in Bogota, Colombia the week of August 7 - 13th. I estimate the Bogota embassy will have the approved visa package around this time. I would like to meet my fiancee in Bogota so she can complete the medical exams (she is not from Bogota so we would both be flying to meet there). All medical exams must be completed in Bogota. We are expecting a Sept or Oct interview date.

    Is it ok to complete the medical exams now?

  4. I was told to get a cosponsor, according to their rejection letter. 2010 was not sufficient, but 2011 will be sufficient based on my annual earnings.

    You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income.

    I will stress this point in Bogota!

    Did Bogota explicitly say that they turned you down because your 2010 income wasn't enough or are you just assuming that was why? I have researched for hours this subject, and I haven't ever heard of that happening.

  5. My wife's mother, brother, and sister own the other portions of the home. Still expecting that showing another letter from my employer and a currect YTD check stub may be sufficient proof of my income, if I show up in Bogota to ask for my 2011 and 2010 income from my current employer be used.

    Who owns the other 3/4's ?? It is highly unlikely that they will accept 1/4 ownership unless it can be easily liquidated, and with 1/4 ownership, it will be pretty hard to convince me of that, let alone the embassy.

  7. Bogota turned us down, since I had not met the 2010 income requirements, even though my job since 8/2010 has an annual income of over 30000 for a family of 3. We will try again, but this time include my wife's 1/4 ownership of her home before I built a GREAT patio, bedroom, and new bathroom addition. A 20,000,000 COP investment should impress Bogota! We even have a solar hot water shower!

    I am in the same boat! I was living in Costa Rica all of 2010, and my income didn't reach the 125% of poverty level. However, now that I'm back in the states and working at more than 125% of poverty level, I should be ok. From what I understand, they only demand that your CURRENT income is above the 125% threshold. You can provide past income tax forms to make a stronger case about your financial stability, but as long as you are currently meeting the reqs, you should be find.

    Fill out the I-864 independently of your other family memebers if you are meeting the 125% limit.

    My wife went to her interview at Bogota and they said we did not have enough evidence to prove we are married! We have our son born there and he has a USA Passport. She has been on my IRS Tax return for 3 years with an ITIN Number. She even had a photo of me and my son on his birthday in March 2011. Of course, she uses my ATM card to take out money for their expenses there :bonk:

    They want the DAS report for me, besides the one for her entry to and from Colombia. I've been there about 20 times and 19 were to see her! We will show more months of phone records and my wife wants to show me there when I helped supervise the construction and provided the funds for the new addition to her home!

    My 1st wife was instutionalized in a mental hospital 2 times. The first time was on our honeymoon. The 2nd time was 14 months later! She moved out and never came back!

    Divorce her after you give her a one-way ticket back to her home country!

    My Ex's parents should have told me she should never get have gotten married. They just wanted her out of the house!

    You seem to have other problems there too, so just end it all!

    I called the NVC today +1-603-334-0700. They told me that my package was received 3/26 and my NOA 2 was 03/16 from CSC, so it took 10 days for them to get it from California.

    I gave them my email address and corrected my telephone contact number.

    For me, it was worth waiting 15 minutes online to speak with an operator. Press 1 & 5 to talk with a human!

    I contacted the IRS yesterday. I called their 1-800 phone line and was tranferred to a specialist in advanced tax rules.

    To get your wife still out of the country as married filing jointly for your 2008 USA tax return follow these intructions.

    Attach a statement, signed by both spouses, to your joint return for the first tax year for which the choice applies. It should contain the following information.

    • A declaration that one spouse was a nonresident alien and the other spouse a U.S. citizen or resident alien on the last day of your tax year, and that you choose to be treated as U.S. residents for the entire tax year.

    • The name, address, and identification number of each spouse. (If one spouse died, include the name and address of the person making the choice for the deceased spouse.)

    In addition, complete Form W-7 to get an ITIN. She does not need to provide her passport, but needs a notary to copy it and stamp it.

    She also needs to sign your joint return.

    Basically, you agree all of your income is USA income, thereby allowing you,

    1) $5,450 more in a standard deduction.

    2) $3,500 more in exemptions.

    3) We also have a child, so we can claim him, since the child is with her the whole year. That gives us another $3,500 exemption.

    That lowers my taxable income another $12,450.

    You can amend your return to correct it, if you want to make the change for 2008 & 2007!

    However, you can also make the choice by filing a joint amended return on Form 1040X. Attach Form 1040, Form 1040A, or Form 1040EZ and print “Amended” across the top of the corrected return. If you make the choice with an amended return, you and your spouse must also amend any returns that you may have filed after the year for which you made the choice.

    You generally must file the amended joint return within 3 years from the date you filed your original U.S. income tax return or 2 years from the date you paid your income tax for that year, whichever is later.

    We got our I-I130F accepted in 19 days at CSC.

    They showed us a receipt date of 2/26/2009 and a priority date of 2/20/2009. There was a notice date of 03/16/2009.

    I did not send in a I-129F and we also have our son's consular birth certificate showing that he is an USA citizen. Our application was sent to CSC, instead of VSC even though I live in PA.

    Looks like they got more employees at CSC and the newer applications are going to the new personel. The backlogged files are still in the holding areas with the backlogged applications for the original workers.

    I was married to a filipina, and her cousin taught me the term PUTA, PUTA, PUTA!

    I also got burned from the "BEACH" from Barranquilla, according from my wife from Cali! Her name was Ivonne Gomez, now residing in in Bogota!

    Well, I can just say that I got burned from PPP, since she came here from the Philippines and then got pregnant by another guy and it took over 2 years to prove her child was not mine! Ultimately, I got a divorce from PPP!

    My wife is just about 6 years younger than me, but the "BEACH" from Barranquilla's father was younger than me! I would say not to lose hope on Colombiana's, but try getting one closer to your age!

    They received my file in CA 2/26/09 and they approved my petition on 3/16/09! :dance:

    This is my second time filing for a I-130F, since my previous filipina spouse taught me the term Puta, Puta, Puta by her 3 adulterous actions! My new wife is from Colombia, so fortunately I have been able to use my knowledge of the culture of the Phillipines with my wife's family in Cali! :thumbs: You should see my marinade!

    Anyway, it is hard to believe that CA is so FAST! Your friend will be pleasantly impressed by the CA speed! I can let my wife know that it was fine that I waited so long to complete my application or else it might have been sent to VT!

    My first I-130F was sent to VT and back then CA had terrible processing times! I need to say the USA GOV'T is smart diverting my application to CA! I just can only feel sad that others are still waiting having their applications now being processed by VT!

  17. We also had the interview with the fraud unit. They will try to confuse you and have you make mistakes. Take you're time and be sure of the question before you answer. My wife was in the annex lobby all day. After the interview it took two months and seventeen days before the visa arrived. I am the US citizen, and was in constant contact with the embassy. Try to remember all the questions that was on the two pages, they will ask them again. It is important that you answer the questions.

    Our age difference is twenty six years. We made it and are praying that you have good results...... :thumbs:

    She lied to the USA Embasy there in MNL and planned to divorce me once she got to the USA with her other American BF that met her in Cebu and lived in California. Yes, this happened after we were married and waiting to get reunited in the USA! Initially, the Embassy said they needed her to come back another day to show a true marriage. I sent photos via the internet to her and she printed them for the Embassy! Within 90 days of arriving in the USA she had SEX and got pregnant by another man! Within 5 months she had moved to her cousin's house 1000 miles away and lived rent free for over a year with her daughter! When her cousin went back to Dumaguete, she had SEX with her cousin's husband and lived in a hotel paid by him for a month. I learned the term Puta Ka from her cousin, even though they speak Cebuano!

    Yes, the Embassy is beginning to understand that a marriage is not always what it should be when back in the USA! Our age difference was just 15 years, but her cousin was told I could not have children as the reason she was with other men! My new wife and baby from Colombia proves her wrong!

    If you think you are not being treated nicely, then think of the years I spent trying to prove her child was not mine! Here, when your wife is unfaithful, her child is your child! She does not get arrested for adultury! She just divorces you and marries her baby's father, while you give her child support for his baby!

    This is the reason the Embassy is asking the questions you have heard from them!
