  1. I was in a family reunion and the topic turned to me as my Mom told everyone that I am engaged and she asked if anyone can attend the wedding in the US. And then the topic went to the greencard process and it seems like everyone has horror stories to tell. Like what happened to the daughter of their cousin's co-worker's father-in-law (you know what I mean- hearsay). They said that immigration officers would visit the applicant's house just to make sure they are living together and that they are really into a bonafide relationship. They will come without notice to check your bedroom, bathroom, cabinets, drawers, kitchen etc. I don't have any problems with it but it really sounded horrible. I have a 3 year old son and we will be alone in the house while my husband works during the day. What if those immigration people are not really who they are? They could be robbers, rapist or killers pretending to be immigration officers.

    I have never read any post or story about this here in VJ so I just told them its not true. But maybe Im wrong?

    Its going to be fun! Your wife is tough for having twins! I had a hard time during my pregnancy, I had to deliver by ceasarian operation and to think my son was only 6.1 lbs! You wait till they are able to run. When you are alone with your twins, who do you chase 1st when they run in opposite directions? HAHAHA!!!

    Were both never been married, but i came to the US for K-1 visa but i was not able to marry my first fiance because his violent, until such time i met this person and i fell in love with him and he does too, its because i really need to exit at the US he decided to marry me before i leave in the US, so that he can petition for me and evertyhing goes smoothly until my interview date came, the CO told me to have another interview after that, and i been through several interview and it takes almost 2 months till i received the letter saying that im not ilegible to have the visa the " reason is we present insufficient proof or documents that cant proved that our marriage was bonafie" and there is note at the bottom saying that, instead for immigration purposes only....but there's nothing stated that im barred or something and also the CO who gave me the final decision told me to appeal at the US because there going to return the petition in the US to revoke... :unsure:

    Now the real story comes out. You came to the USA on a K1 visa. During the 90 days you decided not to marry the petitioner. Instead you married another US Citizen and married him. You left on time and went through the K3 process.

    It is understandable to conclude the marriage was for immigration benefit only, since within a 90 day period, you broke up a supposedly bona fide relationship, started and new one and married. I understand there were good reasons for not marrying the original petitioner but surely you understand how this looks to an immigration officer. Did your now husband ever visit you in the PI during the process? How many times? What kind of evidence do you actually have to show your relationship is bona fide, not just that your marriage was legal?

    Actually i told everything to the CO during several interviews, and he said that the previous petition was over and done, there concern was my present marriage, later i understand that maybe because of our documents presented was not sufficient to proved and its like where unprepared, at the same time the CO question about his income tax previously, why i remain my maiden name, theres a lot of questions, maybe because we dont have any idea about the process and where both never been married, he just started his teaching job last aug 2008 so he was not able to visit me yet, the CO told me im here in the Phil and not staying in the US is good, she just told me to appeal, but i dont know if possible that we can refile after the petition revoke? at least at this time ived learn a lot from VJ and we can prepare more sufficient evidence about our marriage, thanks for the message...

    Frankly, I don't think an appeal would get a different result but I could certainly be wrong. You need to start living like married people, including him visiting you in the PI, changing your name as is customary in your country and filing a joint tax return. A short rebound relationship with no visits after the marriage just isn't likely to convince most reasonable people that your marriage relationship is for more than immigration purposes.

    So pushbrk, is it better to just re-file? How long does an appeal take?

  5. I was trying to look for the thread about this case somewhat similar to yours. She was asked to come back for second interview. The story goes like this...

    She entered US using K1 visa. But when she was there, she did not see her fiancee (the one who petitioned her), did not marry the fiancee and ended up maximizing her 90-day stay. She stayed with the Aunt. Then she met someone else. But the difference was they did not get married. She went back to Philippines and her new boyfriend filed K1 petition for her. She said she had a hard time during her interview. The consul accused her of using K1 visa to go to US so she can work there. In short, it was for immigration purpose. She was asked to come back for another interview. I wonder where she is now...no news or update from her.

  7. They have to tell you in writing why they denied you. What made them think that its for immigration purpose? They can nt just deny you just because they "think" the relationship is not true. There should At any rate, you would go through the anti fraud unit and they have to consult in Washington. Doing an appeal takes months or sometimes years. I sometimes wonder if its much better to re file?

    Hi, im sorry to hear that my dear, i think we have the same case, i got my interview last july 9, and i got several interviews at the embassy i almost drain my tears!!! after a long time of waiting for the document verifiation and investigation suddenly i got the final decision last Sept 29, and it was denied emagine that?!!!! it takes almost 2 months and i got nothing, right im going crazy i dont know what to do the CO told me to appeal in the US, so his trying to do something but i dont know what will happen, im just Hoping and praying that everything will be fine, dont lost hope okey......

    Stevee, if you dont mind, can you let us know why you were denied?

    Are you in K1, K3, Cr1? Whats your case and why did u have several interviews?

  13. Attorney no.1 (female lawyer- Immigration and Annulment lawyer)- Wait and see because the US Embassy is strict with the validity of marriage. In their eyes, its not valid.

    NSO can't generate the copy anyway so what certificate are they going to annotate?

    In my case, the NSO was able to generate copies of my two marriage contracts with the same person and I now have two marriage contracts with annotations.

    There is a way to get a copy of the other marriage contract. Request a copy of your MC as if it were your first time to request it and use the date of your second marriage as the basis. NSO should be able to generate it. That's how I did it.

    Attorney no.2 (male lawyer- Annulment lawyer)- since the second marriage is with the same person, it will be a redundancy and a waste of money, time and effort to have it

    declared it null and void. The remedy is to file Rule 108 for the cancellation or correction of entries to the civil registry. My lawyer can file this petition to require NSO to expunge from their records the certificate of this second marriage to the same

    person.

    The remedy proposed by Attorney 2 may be worth exploring. Rule 108 states:

    SEC. 2. Entries subject to cancellation or correction.—Upon good and valid grounds, the following entries in the civil register may be cancelled or corrected: (a) births; (b ) marriages; (c ) deaths; (d) legal separations; (e) judgments of annulments of marriage; (f ) judgments declaring marriages void from the beginning; (g) legitimations; (h) adoptions; (i) acknowledgments of natural children; (j) naturalization; (k) election, loss or recovery of citizen­ship; (1) civil interdiction; (m) judicial determination of filiation; (n) voluntary emancipation of a minor; and (o) changes of name.

    Take note, however, the words, upon good and valid grounds. The court will certainly ask on what ground you are basing the petition on. You reply that you have an annulment decree, but the court will see that your annulment decree does not include your second marriage. This is when your lawyer can probably come in and argue about res judicata and depending how the court sees it, the judge may rule favorably in your favor.

    You may want to try Rule 108 and let us know what happens so we may also learn from your experience.

    PinayWife, ayaw talaga! I have so many certificates of my first marriage here because I attempted to get this second certificate so many times. As in, like nothing...like its my first time to get a marriage certificate for that second marriage. Ive asked favors from friends to get it for me...even asked my driver and maids. My lawyer even went there to ask for that certificate. Yun pa tin talga ang binibigay, the first marriage certificate. I had to ask someone to go to Surigao to get the certificate from the local civil registrar there. And then that person went to NSO Butuan, they said there's no record there. He even requested for CENOMAR again, this time only one marriage na lang. And then he requested CENOMAR of my ex also...one marriage again. AAAAAARRRRRGGGGGHHHHHH!!! Too much work for me na!

    I wonder how you got your second marriage certificate. Did you submit a CENOMAR before? Feeling ko hindi, cuz if you did you would find out about your secret marriage being registered right?

    Another thing, StephNRia told me to go to e-census.com.ph. Its the website of NSO and also for ordering certificates online. There was an answer there in the FAQ section. Here it is:

    11. I was married in both civil and church rites. The civil marriage occurred before the church wedding. Will I be able to get a copy of my marriage certificate based on the church rites?

    The first occurrence of the marriage is the one recognized as valid. Thus, even if you applied for the marriage certificate based on the church rites, the National Statistics Office (NSO), in adherence to the aforementioned policy, will be issuing the marriage record that occurred first – the civil marriage.

    Also I already mentioned Res Judicata to my lawyer and she she said she will also mention that.
