  1. Thanks for the replies. You guys are so helpful and kind! So, my dads mother petitioned my father almost 20 years ago but she passed long time ago. 3-4 years ago, my dad received an nvc number and he responded but couldn't provide further papers because the petitioner was gone. And then they received a letter that if they don't respond their petition will

Be abandoned. There's a question here if "have you applied for an immigration

Before" on I-485. Should I say yes on that one and "abandoned" for disposition?

  2. What do you mean cannot locate it? They typed their information into the website and it doesn't find anything? In that case, maybe the officer misspelled their name or passport number or something. You can contact CBP to fix it.

Do not apply for extension of status. They can only apply for extension of status if they are planning to leave, which they are not. They will be required to attach a statement about the plans they have made to leave, which would be a lie.

Just file whenever they have all the materials ready, whether that be before or after their status expires. After they file, they are authorized to stay in the US.

They came here on a visitors visa. And they were only given 6 months to stay. So if we submit the I-130 and I-485 and the process don't get done before the 6 months, there's no need to file for extension of stay?m

  3. Isn't the I-94 a piece of paper they were given at the plane just right before they landed? That's what I thought. We're not sure where those are.

  4. YES. It says to attach a relative petition that will give an immediately available visa number IF approved.

That's exactly what you are doing. Attaching an I-130. Believe me, I know what I am talking about, I adjusted from VWP as a spouse of a USC. Very similar process. Same checkbox in Part 2 "Application type".

That's awesome! Thanks :-) I hope you don't mind if I will ask your help as I go through in filling up this forms :-)

  5. No. Application type is A. "An immigrant petition giving me an immediately available immigrant visa number that has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)"

The relative visa petition filed with the application that will give you an immediately available visa number, if approved is the concurrently filed I-130.

Use their address in the US.

I plan to submit I 130 together with I-485. Should I just leave NA on those sections on I-485?

  6. They have the option of sending their I-693s with their AOS packets or bringing their I-693s to their AOS interview.

Thank you for your responses. If you don't mind me asking a few more questions :-) Now, they have to fill up the form I-485? In Part 2 "Application Type" there's nowhere there that says "I am a parent of a US Citizen" to check, so that means they'll just have to write it down on "h - other basis of eligibility"? And for their address, will they be using their address in the Philippines or here in the US?

  7. Thank you, Heat :-)

    1. Yes.

    2. It's not specifically requested but it would be a very good idea, yes.

    3. Photocopy. You still need to be carrying around the original, even after it hits it's expiry date. You will get a letter that extends it. Do not send them your green card in the mail.

    4. Read back through this forum for at least several months worth of posts, and read evey single post where people post their cover letters and evidence lists. That will give you a good idea what you need to send.

Here's my cover letter and list:

  8. Hello everyone,

Whooo! It's been a long time since I've been in this forum. This forum has helped me alot with my papers. Now I am ready to apply file for the removal of conditional status or file the form I-751. My two years will be done this August. I have a few questions and I hope that I can get answers here. Thank you I appreciate if very much.

    1. Do I need to submit evidences of marrige together with the filled out I-751 application?

    2. We have our second baby now do I need to submit a copy of her birth certificate with the application as well?

    3. What about my green card? Do I need to give mail it with the packet or a photocopy would work?

    4. Is there anything else I need to know?

    Thank you so much!

  9. I dont even know if this is the right place in the forum to post this topic. Pardon me if I am at the wrong place. But my question is, how am I going to change the middle name in my GC? In my Social Security Card, I'm using my maiden name while in my greencard, they put my middle name when I was still single. They said I can change it by applying a change of name. What form do I need to use and how much does this cost? Thanks a bunch!!!

  10. Thanks everyone for your comments. However, my question has already been answered by JimVaYhoung (not sure about the spelling but from the first comment) from the very beginning. Meanwhile, I don't agree that a 6 month stay for my parents here in the US would be an issue. It hasn't been an issue for them and for other people that I've known. But, anyways, thanks for all your answers. God bless everyone for a speedy process. I know the hassle and buzzle of going through all these paper works. God bless and God speed.

  11. I have a 2 years or the conditional green card. (actually, waiting for it to be on the mailbox). but my question is, is it possible for me to petition my parents who are in the Philippines to come to the US? They have 10 years visitors visa already. But they can only stay in the US for a maximum on 6 months and then go back to the PI's and then come back again for 6 months for 10 years. This sounds so expensive. Please I need your help or information regarding this matter. Thanks.

  12. i posted few days ago about interview experience. it went great. only the problem is the box that says; No class A or Class B needs to be checked by the doctor and then resign the form. And thats it. Now I called the clinic where I had my medical and was informed that the doctor always doesn't not work there and he already retired. Can anyone please tell me what to do? Thanks....

  13. Our appt was at 7:30 and we went it few mins before 7:30. First, the interviewer of course let us swore first. Really, it was easy and the interviewer was really nice. He only asked for copy of lease and our tithe receipt. That's all what he got from us. He didn't even look at our pictures. I offered but he said no he doesn't need it. But but but.... the only thing not good is the medical form. The doctor forgot to check one thing there and so we have to go back to the doctor and let him check and sign the form. And then send it back to the immigration within 30 days. After that, then all will be good. The strange thing though is, he already gave me the Welcome to the USA handbook and another Welcome to the USA letter and gave the paper for removing condition status. WOw! Does this happen alot or the welcome book and letter comes with the GC? He said though that there is no more problem with the papers. He just need that medical form signed because it is the law. Whew! We are so happy. ALthough, still on RFE, I assume that we are already approved because we already have the welcome to USA handbook. What you guys think?

  14. Wishing you all the best for your interview on Thursday, hope it all goes well for you :)

Our Lawyer told us to take our son with us to the interview, he said if that doesn't prove us in a bonafide marriage, nothing will hahaha. So yes take you baby with you. Oh and our Lawyer also said, if the little one is fussing the interview should be a little quicker ;)

hehehe... thanks bethandbilly. that gives such a relief...
