  1. Yes we were married this summer. We did not plan to at first but just wanted to. She has been to the US a few times before. Her plan was to go back to Thailand and finish teaching this fall, then spend time with her mother before our Buddhist wedding. Now she just wants to be with me sooner. That is why we did not file for AOS this summer.

    Well hopefully she gets three month when she comes here from our Buddhist wedding. When she comes to the US on the visitor visa, should she tell Immigration that she is here to visit her husband? Will that be a red flag? There is no danger we will overstay a visa or anything else to endanger her ability to immigrate here.

  2. Ok, so she couldn't come here to file AOS. How about the interview location? Does that still need to be in Thailand? How about changing her mailing address so we can make sure she gets the packet if she happens to be in the US at the time of mailing? I think we could change her address to her mother's so we would know when it arrived.

    If she came here and had 3 months, how long would she have to wait until she could come back, assuming the CR1 takes longer than we hope to process? If she came here on visitor's visa again in December would that be a flag to immigration if she just left here in August?

    My wife and I have changed plans, and hope to have Buddhist ceremony in Thailand earlier than we thought. We filed CR1 in July and received NOA1 already. If she came here in December and petitioned for AOS, what problems could we have? She has a ten year visa so hopefully entry would not be a problem. Would the AOS change her interview location? She would not need to leave the country until all immigration paperwork is done if we could get the interview here in the states instead.

    Thanks in advance for all of your help. All of this can be very confusing.

  4. you should be fine i did get married in the states and return home to my home country then my husband start my filing. Everything went smoothly from start to finish. It makes no sense now to do K3, Cr1 is not that long anymore.

    Well she needs to go back home to finish a semester of college as an instructor. We also have to have the Buddhist wedding in Thailand. So if I am understanding this correctly, we should file the I-130 and wait for the CR1 visa? Should we wait to file the I-130 until she leaves the US? Does the fact that she is currently here jeapordize our changes with the I-130? Where will her interview be, if we married in the US?

  5. Hi, I am new to here and just got married Monday. She is from Thailand and is here on visitor visa, (she has a 10 year visa). She is going back to Thailand in a month to stay until we get her K3. Did we make a mistake getting married? She did not come here on this trip to immigrate, we did not plan to marry but just wanted to. Should we wait until she leaves the US before filing the 130? Did we slow down the process? Any information or suggestions would be appreciated.

    Btw, she will probably come here again in Dec for a few weeks, but then go back and plan our Buddhist wedding in Thailand.

    I am new here, and really appreciate this website a lot. My question is concerning my Thai fiance. She wishes to come here in December for a few months at least. She has a 10 year US visa. We wish to marry next year. Is there any concern about her living with me while we are applying for a fiance visa? When should we apply for the fiance visa, before she comes here or wait until she is here? If we happened to get married in the US while she is here, would that affect our ability to get a wife visa? I know we are lucky that she has the ability to come and visit me, but it also makes all of our options confusing. Bottom line is that we do not want to do anything that would hurt our chances for her to move here.

    Thanks for any advice you could give me, and for the great site.

    1) no affect on the fiance(e) visa

    2) no affect on the spousal visa... the USCIS does not care about where the marriage occured.... just that one legally occured.

    So would you suggest that we just jointly complete the Fiance visa app when she is here? A couple of months will not matter, but it looks like the spousal visa takes much longer. I think it would be easier to just fill the forms out jointly together. Sorry if these are repetitive, or stupid questions, this is all new to me. I am very relieved that her being here on a tourist visa will not affect her ability to get a Fiance visa. :)
