  1. The parents should be investigated for child neglect and abuse. It is conceivable that a close relative or boyfriend of the mother impregnated this child. Where is the local Child Protective Services agency? The mother is 100% to blame for this.

    he never came in the us with his mexican visa, he always came in crossing the rio grand! And everytime he was cought by a police man and they would just put it in his record that he has been in the US illigaly but never marked as a felony. Out of the 5 times he was cought, they just put it on his record and returned him to mexico. But the last one he went to jail for 6 months, and they told him that if he re enterd the country illigaly that they would mark it as a felony! he hasent come in ever since! its been about 3 years since that!

  3. Hello. Do not depart just yet. Allow your husband to file the I-130 petition. They will send notice from one of the processing centers. It may take them 4 months or even a year. Stay put. In the mean time, check with local attorneys who can advise you. Go for the free consultations and see what advice they give. Try to find one that has a lot of experience with waivers and knows specifically about filing in your home country. If you cannot afford an attorney, there are local organizations that can assist; they provide free or low-cost legal help.

    Yes, this is a daunting situation, but do not despair. Everyone makes mistakes. Just hang in there for your family and yourself. Take things step-by-step and do as much research as you can every day. The people at i2us will walk you through the process. All the best--Amor1

    Can someone please help me out here, I would greatly appreciate it.

    Here's my story:

    I came here almost 9 and a half years ago in someone else's passport from Jamaica. The problem is I have absolutely no evidence to proove this and no way of getting any. I guess I will be filing as EWI. I've been married for a year now and I have two kids that are not my husband's. Lawyers advised us that I have to go back to Jamaica for my interview after everything's been filed. Can someone help me get started with this lon process, what information to get to prepare to file the I-130. Has anyone ever filed a case like this without using a lawyer? I know we'll have to prepare a waiver packet but what's the first step,thanks.

    This is a tough situation but i hope something works out for you.

  4. Normally, I agree with most of what President Obama says and does. However, on this one, I just wish he had not taken the bait. When the reporter posed the question, I felt in my gut, any answer would detract from the health reform debate--why he was having the televised briefing in the first place. As an African American man, I'm sure that he knows what it feels like to be violated in that way by the police or others in authority. Yet, sometimes, it's best just to say, "I'll wait to get all the facts." Then move on with other matters. He does not have to weigh in on every injustice to African Americans b/c there are plenty of us who can. He is in the best position to get people to listen, but find other ways to bring minority issues/concerns to light. Only my opinion! Amor1

    Just wanted to share good news---my husband passed his medical, and now we´re just waiting for the interview. It was a long and expensive day (3:00 am - 4:30 pm). We had to travel by car (3 hrs) early in the morning and get to the 1st appointment (physical, vaccinations, general) by 7:00 am. We arrived a full hour early, and the city was sleeping (dark everywhere). Luck for us b/c the streets were tricky, and we got lost a few times :lol: . Then, we had to go to a lab for the blood and urine tests for him. Afterwards, we went to another med office for the chest x-rays. The total cost for everything was about $300. There was a 3-hr wait for the results (ate lunch, walked around a little, and dozed in the truck). Finally, we returned, and the doctor gave us the happy news--passed--and a huge packet (sealed). Now, we are just enjoying our time together and waiting for the interview dates.

    That is so wonderful. I just received the I130 approval 30 days after I submitted it and we are not going to wait for the I129 approval. We are waiting on the info from the NVC so he can have his vaccinations and medical exam.

  7. I did the same as you and did not get put in AP. Our case was completed at the NVC in Jan 2009. Also, I called the IRS and learned that I have up to three yrs to file an amendment (with the W7 & an ITTN for my husband). This summer will be the time to do this for me. No worries---you'll be fine.

    i am in a great worry. i am the usc, i filed taxes last year as single. that is becuae i heard that if the other spouse doesnt have a social security number that is what i am supposed to do. now i see many are saying about the w7 thingie. but are they going to put us on AP becuae i filed taxes as single even though i was married at that time. please any one out there who has some experience and knowledge plzzzzzzzzz share!!!

    The first time I was diplomatic and did not call what you did plaigarism, but that's what it was. I stated very plainly that anyone sending my exact letter to their state's reps/the Judicial Subcommittee could download my letter and add their names. This IS NOT about receiving credit; it's about not taking/stealing someone else's words and using them as you please w/o permission. You copied word-for-word from my letter and used those words for another/different purpose than that originally intended. You are offended by my questioning this??? And you use profane language w/acronyms b/c I called you on it??? I am so sorry that you're displaying this type of behavior, especially since this is supposed to be a community that helps and respects one another. Let's be adults about this. I'm happy, again, that you took action, but next time, do request permission b/f using someone else's words. Otherwise, like in this case, you are plaigarizing.

Just copying and not giving credit or asking permission to use for another purpose is not ethical. All of us want our elected officials to act and show some concern/compassion. Next time, please request permission. In this age of the Internet, I know that many people are doing this (copying and pasting), but it doesn't make it right. When I read your post, I thought, "My goodness! If he found this post with my letter, he could have sent a message to me, requesting its use." It would not allow me to upload, so I pasted it below. Perhaps it will help all of us who are still waiting after inhumane periods of time as well as those who are just getting started. If you want, you can copy and add your home address, receipt numbers and anything else like email address and contact numbers. However, the body of the letter should stay the same because the Judiciary Committee needs to see that many of us are affected in this similar way--waiting, waiting, and waiting for our NOA2 indefinitely. We should get a response from the Senators themselves or the Subcommittee. It's only polite and respectful for them to respond.

    Guidelines:

    Print out a copy of this letter after you add your information. **Remember to add you House of Rep Member/Senator for your state. Again, this is protocol.

    You can address your envelope to the Senate Judiciary Subcommittee on Immigration, Refugees, & Border Security or each individual member who sits on this committee as well as your State's Senator. Personally, I will be forwarding a total of 11 letters (all members, the Subcommittee, and my State's Senator). It's up to you.

    I believe including hard copies of the spreadsheets is necessary, but many will send these, so you don't have to do this. My letters will go off tomorrow, and as soon as I get responses, I'll add a new message here at visajourneys.com.

At present, the time frame for reviewing cases is nine months or longer. Despite published announcements to the contrary, many of us have been separated from our spouses and children (on whose behalf we filed I-130 and I-129F petitions) for a painful amount of time, time which cannot be recovered. After following the guidelines posted on the USCIS website and paying all applicable fees, we are waiting in suspense for an approval (the Notice of Action 2 – NOA2), and this is the source of our dilemma—an inordinate amount of waiting time and no clear explanations for delays. Hence, we ask you, Honorable Members of the US Senate, to investigate these seemingly negligent periods of inaction.

    The first step for our family members is to submit the petitions to establish the existence of a relationship. Then, once approved, our petitions and all documents submitted are forwarded to the National Visa Center for further processing. As you are aware, the next phase is the embassy approval with required medical examination and interviews. Unfortunately, many of us have not moved past the first step because there have been no updates sent to us. In particular, many of us are still waiting for NOA2 from the Vermont Service Center (VSC). Please see attached spreadsheets. While the California Service Center seems to be processing petitions at an increasingly rapid rate, VSC is months behind. Why is there such a major difference between these two processing centers? Are there more adjudicators at CSC? Moreover, some petitions that are received months after others are processed faster. When questioned about this inequity, telephone operators at the USCIS give a standard response: “It depends on the case; each case is adjudicated differently.” Then when we ask about our individual petitions on behalf of our qualifying relatives, we receive the generic, “We’re within our processing time.”

    For many of us, the entire process thus far has proven to be quite discouraging. We cannot get accurate, specific responses to our inquiries, nor do we receive the “first in, first out” treatment we were promised. Hence, we need and request your assistance. Perhaps an inquiry from your committee will garner more substantive, more accurate responses. Perhaps there is a way to change the process, so national security is not compromised, and families are not unnecessarily separated from their loved ones indefinitely. Attached, please find a copy of NOA 1 for our petitions (I-130 and I-129F). Below, see our receipt numbers given by USCIS. It is with great respect for your charge on this committee that I, along with many others, request your inquiry into this matter. Hopefully, all of us will receive the NOA2 and continue positively on the path of reunification with our family members.     It would be better if everyone did this but, I/we cannot control that. As long as I have ink in my pen I will be sending letters. Nothing ever gets changed by sitting back and complaining. If you want change then take up your pen and write, fax, email everyone you can think of. Again, change will not occur without effort....

    Please, for everyone's sake - take some time and make the effort. Even if it does not help you, maybe the person two months from now may benefit....

    I am viewing the visajourney.com website, which tracks actual dates for K-3 visas, and am I see that the California Service Center is approving K-3 visa requests from December 2008. The Vermont Service Center is approving K-3 visa requests from August 2008. Why such a glaring discrepancy? Why aren't priorities shifted to balance this out? Why aren't we all on a level playing field?

    Why is the California Service Center approving K-3 visa requests within a two month period and the Vermont Service Center is approving K-3 visas requests in a seven to nine month period? If my application was at the California Service Center instead of the Vermont Service Center, my wife would be on her way to getting her K-3 visa and one huge step closer to being with her family in the USA.

    Why are K-1 visas being approved for foreign finance(e)'s at a faster rate than K-3 visas for foreign spouses? It is absurd that finance(e)'s are approved faster than foreign spouses.

    Why are foreign worker's visas approved at a faster rate than foreign spouses? With unemployment already over seven percent, and climbing towards ten or eleven percent, why aren't the priorities shifted from approving foreign workers to approving spouses. Who is responsible for determining the processing priorities?

    Why, after three months, isn't my I-129F viewable on line? When I call USCIS I have been told that "it takes a couple of weeks" to "you do not need to worry about it". THREE MONTHS - Ridiculous!!

    This entire system is broken! Why are foreign spouses being punished? More importantly, why are law-abiding US citizens being punished?

    Why is there no oversight? Why aren't questions being asked and explanation demanded? Why isn't the management team at USCIS held accountable for these glaring discrepancies. Why isn't the L.I.F.E. Act being enforced?

    These are all questions that been asked of our legislators. They get, and then forward, non-answers or no answers to our questions. While we, the applicants for visas, must sit back and take whatever it is they want to send us. No one listens; no one cares; no one is our advocate…

    You are kidding me!! You absolutely must be kidding.

    We are trying the get this system corrected and working properly. And you, all you are concerned with is your pettiness - "Pay attention to me. I did it! I should get the credit!"

    I was steered to this as an example to use. Question: Anyone that used YOUR letter that you posted did they give you credit? If not, did you bother them with this utter nonsense?

    Give credit?? How, at the end of the letter to the president say "PS - the first paragraph of this letter was written by XXXXX and the remaining paragraphs were written by XXXXX with assists from XXX, XXXX, and XXXX"

  10. I know the title of this movie is offensive to many people in India, but it is one of the best movies I've seen in years. The acting, location, cinematography, music--all of it--really makes this film phenomenal. :thumbs: It made us laugh and cry and cheer. We talked about the issues examined and whole experience itself for hours afterwards. Personally, I couldn't get some of the images out of my head.

    If it's in a theatre near you, see it. For those who have doubts about love overcoming ANYTHING, Slum Dog might change your mind & heart.

  11. I had been hearing so much about Slum Dog Millionaire in the media, so we went on Sat. SEE THIS MOVIE! It's one of the best I've ever watched. :dance: The audience gave it standing ovation twice. The cinematography, acting, and story line are so moving, from beginning to end. I laughed and cried a lot. You won't regret spending money to see this one.

  12. Sorry to hear about his ban. There are laws in place regarding EWI, and you did not know them b/f he went to the interview. That's the very unfortunate part. Don't give up hope, however. Please check out the immigrate2us.com website---lots of excellent info with regard to the waiver process and the 3-yr, 10-yr, and lifetime bans. There are experienced lawyers on that site that can be contacted as well. They charge a lot, from what I've read. If you do your own homework and read as much as possible, i think you'll have a better idea about how to proceed. It's difficult for all of us to be separated, and I'm sure more difficult for you after hearing this news. Try to hang tough and become informed. No one is perfect, including all of us who post here, and we should offer you support, not judgement. Wishing you all the best & praying for your family & you---Amor1

    My husband had his interview at the US Embassy in Juarez Mexico and it was denied and said he could not come back 10 yrs. At the interview they asked him who his co-sponsor is, where he lives, what my name is, where I was born, his address, which he answered all correctly. Then they asked him the first time he entered the US and how many times he entered, which he truthfully answered. He entered illegally 10 yrs ago and entered 3 different times then she said she was sorry but his visa was denied and could not come back for 10 yrs. Is there anything else I can do. I've been told I can apply for a work permit. Is this true? Should I talk to a lawyer? Please anyone help with suggestions. I am so upset with my government. I don't see how they can keep a family apart. We did everything by the books, We paid all that money, for what? My husband has never been in any kind of trouble. It was just a big slap in the face. Any suggestions of comments are welcome.

I kept asking is it March for sure, and the rep said that she was pretty certain it would be. I think it depends on the # of approved petitions/embassy.     We got a case complete 2day.....I am not sure if we will be considered when NVC schedles Interviews for March in the second week of Feb

  14. Great news today--case complete @ NVC :dance: ! I called and got the news. Then I asked about an interview app & medical and was told by the rep, "Everything here is computerized--2nd week of month for scheduling for next month." I guess she could hear my despondency b/c she added, "There's another way to get an earlier appointment; call the embassy directly & have them request your file. Also, let them know the status (complete), and they'll give you an earlier date if they have one; expedite is not necessary." The rep gave me the direct number to the embassy and the visa office here, too, in the US (202) 663-1225.

    I won't know until tomorrow if this will work b/c it's late, but it's worth a try. I'll give you guys the update tomorrow. Hoping all is well---Amor1

  16. I am quite offended by your reckless attempt at humor. Michelle Obama is beautiful and classy. I'm glad she's our new First Lady. It seems her husband thinks she's the most beautiful woman in the world, and that's all that matters, right? Your opinion is just that--an opinion.

    Our first ladies have not been raging beauties since Jacki O, and that was only because of the wrinkled fossil she ended up with. Now, beauty has nothing to really do with anything, and often the really attractive women get pegged as shallow.

    However, Michelle seems to be half a head taller than her husband. Maybe it's the heels. Still, she walks like an NBA player. Perhaps a man in drag? Another Janet Reno body type?

    Is it too early to comment? After all, if the new President fails, then America is in trouble, not just those that voted for him. Maybe I am just having a jaded moment, looking for late night comedy possibilities.

    I know that this is a forum, and we have a right to say whatever we want. But I don't get your humor here. In fact, your comments are offensive. Personally, I find our new First Lady Michelle Obama to be quite beautiful, and so are their daughters--Malia and Sasha. Not only this, but she is brilliant, articulate, graceful, and strong. Most important, our new president--President Barack Obama seems to be genuinely in love with his wife who happens to be a BEAUTIFUL, real-looking, healthy-looking, fit-looking African American, educated woman who is unfraid to speak her mind. Also, she is quite fashionable. Do you read the mags & newspapers? And she is considered an outstanding mom, perhaps her most endearing quality and accomplishment.

    Today is a day of inspiration for our nation, and people everywhere throughout the world are looking to President Obama to bring a sense of intelligence and stability and wisdom to the Office of the Presidency here in the US. Remember our standing in the world has been hurt so badly by the poor decisions of our last president. Let's not overlook the obvious fact that our country is changing for the better into a place where racism, prejudice, and cowardice have lost their reserved seat of permanence, thankfully. This is a new era of promise, intellectualism, integrity, and hard work. As Americans, we can be proud of how we voted--many fo us. We can be proud, whether we are Democrats or Republicans, of the fact that an African American man can aspire to, work hard campaigning for, and be voted into the highest office in the land.

    My greatgrandparents, grandparents, and father did not live to see this day, but my mom did, and she was so moved---just like milllions and millions of us are---by the fact that "opportunity for all" and "freedom for all" are alive and possible, indeed.

    Finally, to all women in the world, I think Michelle Obama represents beauty in its purest, most nonsuperficial form. Who needs to weigh 100lbs to look attractive? Beauty is not defined by the society at-large as "thin, white-skinned, and blonde," nor is it defined by one's level of wealth or materialism. But then again, you have your opinions, and I have mine, so perhaps your idea of beauty is so strictly defined that anything else is "manish" or "chunky" to you. I bet there are many men on vj who would beg to differ with you and your standards of female beauty, and I hope they write their thought down for you to read.

    We will not erase your deep-seeded beliefs, nor will we try. But surely, you motivated me to state mine. Congratulations, America. This is our land of the freedom and liberty for all.   19. At first, I had the same problem. Then I requested a receipt via email and cover page via email on a Saturday. Within a few hours, I received both as attachments via email, downloaded, and printed. I hope it works for you, too.---Amor1

    I submitted an online fee payment and it showed up today as PAID, however the website would not allow me to print the document cover sheet or email it. The server seems to be messed up. Have any of you incurred this problem, and how long do you think it will be to fix this? I would email NVC, but I know the reply would take days and I hope the problem is fixed sooner than that.

  20. Yes. I wrote a letter to the US Senate Oversight Committee and shared it here with fellow vjers. It was mailed to 9 members and our state's reps (House of Rep members). The responses came mostly via email, but the NOA2 for our I130 & I129F came 2 weeks after the letters went out, so I strongly believed this helped. There was a long delay bwtn the NOA1 & NOA2. Check out my Oct posts, & you'll find it there. It can't hurt you to ask for their help. They get a faster response than we do. Wishing you all the best---Amor1

    I think the best think to do is look at the full half of the glass. U r out of USCIS, where the real waiting was. waiting is stressfull, makes u go through different emotions, from having faith one day to being completely hopless the next one and so on. once u get at NVC, r family is very close to the day of being reunited. if u know u and yr husband are doing this in good will, u have been together through all this process, u must have faith everything will go just fine. keep going forward with faith, and dont think of the bumps in the road, those r only lil shakers on the way (as a RFE or some days without news from NVC could be, but hopefuly not). u r close to the finish line, heads up, it will very soon be over. my advice to u would be do not panic, dont get nervous, because only in that case u can do mistakes that would cost u few more weeks of waiting. best thing to do is get yrself together, pay attention to every line in the forms, the most unpleasant part of the process is already in the past. if u had the determination and courage to start this process from the beginning, could pick the best choice for getting together in terms of what visa to apply for, had the patience to wait for the NOA2, then NVC shouldnt scare u. all of us knew is going to be a long nerves and time consuming process when we filed our I130. with patience and faith, it will be over and ull be reunited as a family soon. and when u r not sure about somth, just ask yr friends here. is why we r all here. to get support and encouragement from others in same boat with us. and sail together towards the shore. best of luck to u, and dont worry, u will all be together before first spring sunny days.
