  1. I just wanted to write a quick 'Thank You' to everyone on here for their wonderful and kind assistance.

    After 2 years of struggling to be together, on Monday our case was finally approved in Amsterdam. It was a bit of an anti-climatic end considering all the ups and downs of the USCIS & NVC. The final moment was very quick, pleasant and pain-free :)

    My husband will finally join my daughters and I on 18 April and our real journey as a family will begin.

    Despite the best immigration lawyers his employer could retain, their experience and knowledge and guidance were a disgrace compared to the wonderful and fantastic advice we received from people here on this site. Having started the journey with lawyers, and finished it without them, I can honestly tell you that the advice & guides from this site are 1000% more helpful than any lawyer, even for the 'not so usual' cases...

    So to everyone still on their journey - please keep your faith and use the wonderful help and advice that is available here - it will make the process (slightly) more bearable and the reward of having done it together even more sweet.

  2. Okay - well after our history of delays and rfe's I didn't want to take any chances....

    luckily the fed ex doesn't pick up the mail from the office until 3pm, so I was able to cut and paste a quick cover letter.

    Thank you A&M, yes I did include the coversheet with the bar code, just not the letter listing what documents were included. Not to worry, now there is the bar code sheet AND a coversheet with a list of documents in the envelope.

    fingers/toes/hairs crossed that we have some good news in about 2-3 weeks when they are scheduling.

    Unfortunately, I didn't do a cover letter for either the DS-230 or I-864, but I did put them all together in order, seperated by paper-clips, I hope that's good enough.

    My husband's employer have their own immigration lawyers, and they have been nothing but a burden and constant delay. I finally had enough last week, after the 'professionals' didn't realize that the fees had to come from a US bank, and they are in Canada. They should send themselves the NVC website link they so kindly sent us. So they were going to arrange for a money order which would take 3-4 weeks to clear at NVC.

    I had enough, I paid the fees, we put all the information together this weekend, and sent it out this morning. But I didn't have any of paperwork that the lawyers received, but I followed LingChe's shortcut, so I hope it will all be okay.

    Lesson learned - never ever believe someone can do a better job than you when it comes to something that really matters.

    Please could someone assist/clarify?

    According to Ling Che NVC shortcut guide we need 4 passport photos of beneficiary (in the DS-3032 part) but nowhere else further on does it say when to mail them or with which forms.

    We've already paid the fees, and I'm putting together the two packets, the I-864 & the DS-230.

    Please could anyone advise?

    I'm confused, how did you email your DS-3032 without receiving your IIN and the package in the mail?

    I called yesterday, and they received our file on Wednesday... I have my case number but she said our package hasn't been generate yet. Do I need to keep calling and asking when it's been generated in order to email the DS-3032?

    Thank you for your well wishes, I'm sure that your approval is just around the corner. When I saw that our case has been resumed it was about 1 week and I kept checking everyday thinking, what on earth is taking them so long. But late friday night, after I gave up and went to bed, we were approved.

    To be honest, I don't remember what the RFE said exactly - I was so surprised and so intent on sending it back, I just read it and followed the directions. They requested 2 passport photos of me, plus we forgot to put 'N/A' on the line for my husband's middle name - that's it. I did it all within the hour and caught the last post that evening.

    I'm sure you will be okay, now it's just a matter of time, but you know you are so close.

    Fingers crossed and hopefully you will be back soon to share the wonderful news.

    As you can see in my signature, I too received an RFE last week - and they also asked for a new set of passport photos of me, but it did not mention anywhere that I needed to write my name on the back at all, in pencil or pen... great - will I receive another RFE to sign it?

    There is truly no rhyme or reason to this process.

  9. I am Gracey's husband:

    I just got off the phone with the ITS and yes, we CAN file married/joint AND claim our daughter as a dependent.

    A non-resident alien(defining resident as actual presence inside the Us or not) can file for a joint return if married to a USC, even though they have ever step foot inside the US. All world-wdie income will be taxed.

    What is needed:

    1) the current year's 1040

    2)W7 - application for ITIN

    3)notarized copy of passport

    4)a statement signed by both spouses proclaiming desire to be treated as a US resident(for tax purposes)

    Read Publication 519. Can be found with an internet search.

    Why woudl anyone want to do this???

    Use us for example:

    1)Filing Single(even though I am not)..my return is about $1700

    2)Filing Head of Household...my return is about $3800

    3)Filing Married Joint with one dependent....about $6200

    HUGE difference!!

    So, for those who never considered this, please read and pass along. My CPA was not aware of these last year and we lost out on a couple thousand dollars(thoug I think i can file an amendment to that, but not for certain).

    For an absolute answer have your States side spouse call the IRS directly and ask specific question,,,,they are helpful and will give a definetive answer.

    You cannot file/apply for an ITIN for your spouse since she is eligible for a SSN when she arrives in the US. An ITIN is only for individuals who come to the US for work or other and are not eligible for SSN, but still have a US income tax filing requirement. And only Mexico & Japan have special tax treaty agreements that the spouse in the US can file for an ITIN on behalf of the dependents in the home country, if they are not in the US.

    I don't know your financial situation, but I work in international tax, and my advice would be that since your wife is arriving in April, file for an automatic extension until October 15, once she is here she will get her SSN in about 1 week, in the meantime, prepare your return as if she is already here and just plug her SSN into your income tax return. Then you can file MFJ, claim all the allowances and exemptions, and not have to deal with the hassle of the ITIN being rejected.

  10. Hello everyone,

    Please could anyone help - we've received an RFE earlier this week, and on the USCIS website, it stated that on Jan. 10 a RFE was sent ... okay - we got, it and sent it back, I checked this morning and it looks like the file has been touched again, and the date of the RFE was updated to say that on Jan. 13 an RFE was sent - does that mean we have another RFE on the way??

    Do they send them out every time they come across something? or review the file and send a RFE for all the outstanding items. It's currently at the CSC stage, we haven't even made it to NVC yet....

    Does anyone know if you can have RFE #1 and 2 days later RFE #2 is sent? or is the the same one... just updated??

    You write or fill in 'applied for' where her SSN or ITIN would go. You need to attach the W-7 application together with your tax return.

    I'm an international tax specialist, and deal with these daily.

    so if my husband will file his tax with my w-7, will they process it now so he can get the was it transcript? so he can send it to NVC.. or they will process my ITIN first before they process his tax return?

    Sorry, I'm not sure I understand your question. From your timeline, it states that you applied for a SSN last week, it should only take a few days to receive the number and once you become eligible for a SSN, you cannot file for an ITIN - it will be denied.

  12. Just wanted to update that this afternoon, I received the RFE in the mail, and it seems that we did not write 'N/A' on 1 line where you had to list spouse's other names (if any) - and for 2 passport photos of me.

    I honestly cannot remember whether we sent my passport photos - I'm pretty sure we did, but I'm just happy it was something so straightforward and simply, it was on it's way back to California within the hour.

    Fingers crossed now...
