  1. Hello,

    I'm in a similar situation.

I'm a conditional permanent resident since July 09. This year, in May me and my wife will start working on a cruise ship, doing 6 month contracts at a time.

My questions is, The company is an american company and taxes will be deducted from my paycheck monthly. My first contract will be in Europe and after 6 months, we will have a 6 weeks vacation, and then, another 6 month contract. The company will fly us back to the US after the end of each contract. We live in Missouri.

I was wondering if I would have any problem returning to the US at the POE once I'll be abroad about 6 months but coming back for vacation for 6 weeks and maintaining my address in US. I'll still have the taxes taking out of my paycheck, because it's an american company but the ship itself will be based in Europe.Do you guys think I would have any problem?

    thank you

  4. Congrats on the EAD, Septembergold!!

I received an RFE the other day  They're asking for a copy of our 2008 tax return (I hadn't included it in the original package - d'oh!!). We had filed for an extension with the IRS, so now we'll have to actually get them done! lol, oh well.

Question: will they still be processing my EAD after they sent the RFE? Just wondering if the RFE holds up the entire process, or just the I-485 that the RFE says it's for.

    Thanks!

I think it holds up everything until you return it. At least that's how ours worked.

COngrats on the EAD!! Now you can at least start thinking about looking for a job..hehe I hope I get mine too by the end of this week!!

  5. hey folks..

I have been experiencing weird emails from USCIS..this morning I received 4..one said that my Case is now peding at the office which it was Transfered, and then I received another email saying that My case was transfered to California Service center,.Now I receveid an email saying that My case is now at the office which was Transferd and couple minutes ago, I got an Email saying Case trasnfered to California service center...it's all messed up!! it seens that I keep getting the same messages//has anyone had this problem as well?

also, My status for I-131 is not showing up online..any guesses??

BTW,I got a touch today on EAD!!!

  6. Hi guys!!

We just got a letter today from USCIS that our case was transfered to California!! so it means, no Interview!!! Yeahh :dance:

Now I have a question, we were expecting an RFE because of the affidavit, well, our co-sponsor requested extesion to file taxes for 2008, so we just sent the W-2 for 2008 along with 2006 and 2007 tax returns...so we are expecting a RFE becuase of that, hopefully not..

now since our case was Transfered to California, do we still have a chance to get an RFE or it means that the case will be approved soon?

I mean, if we were supposed to get an RFE, shouldn't we get before they transfer it to california??

    Thanks guys!!!

  7. hey Guys..

Just got my Biometrics appt letter today.:dance:

It's schedule for May 14th at 12:00 pm and the location is super close to my house..

Things seen to be moving fast hehe

    Good luck to all!!

Woohooo!!! I got my biometric appointment today too!!! And its on May 14th as well!! We have the same dates lol!

In my case thou, I'll have to drive for 2 hours cuz the place is in Denver and I live in Colorado Springs, and I will have to go alone cuz my hubby is training in Arizona...I think its ok to go by myself right?!

yes.. on the same timeline!! hopefully we'll get ours soon...My friend sent his AOS early march and his Green card was just approved today!!

  8. Yeah..we are n ow waiting for the biometrics..

Aso, have you guys noticed that USCIS is now working fast on the cases...? My friend had sent his AOS March 3 and got his EAD approved online on april 20th and got his Adavance parole already....His case was also transfered to California ...

it seens like Obama did something to the USCIS heheh

Hope to get my EAD soon...That's more important at this moment...

We are waitinf for an RFE because our Joint sponsor (My mother in law) have asked for an extension to file taxes for 2008..so we sent the Tax for 2007,2006,2005 and a W-2 for 2008 and a letter from her explaining about the extension...We are waiting for an RFE...

is anybody here in similar situation?

  9. Hi Everyone! So nice to see some familiar faces (and new friends too of course!). We just came back from our wedding, and it was amazing! We had a civil ceremony on March 28 so that we could get our AOS out before we left, and not stress about it. Funny thing is, I mailed it from a post office in downtown Chicago, a few blocks from the lockbox address. And since we mailed it on April 14, the line was out the door (with people sending off tax returns) and it would have just been faster to walk down and drop it off!

We received our NOA's in the mail today, and are pretty sure we'll be getting an RFE for our sponsor's 2008 tax return, but, we're together, so we're not worried... which seems to be the theme so far in this thread.

Is anyone else having trouble putting their receipt numbers in the USCIS website? It's not recognizing any of ours (the AOS, EAD, or AP). Maybe it takes a few days after receiving the NOA?

Good luck to everyone- hope this part's not as stressful as the K-1!

  10. Well people, I'm in the same situation,

I'm here on a K1 visa and i have and EAD stamp on my I-94 (so it means I'm work authorized) that expires on April 26th 2009

The question is, I'll be already working when my EAD runs out but I think is out of the question to Stop working just because you are waiting on an EAD card that you KNOW will arrive soon..The thing is that if the employer ask you for an updated EAD, just tell the employer that you already applyed for one and is on the way, Show the receipt (I-797) if the employer ask and also point that on the Form I-9 it says that you have a 90 day grace period to show the document, wich usually takes 3 months, so you have your back covered by the form, simple and easy to undertand.

Also on the I-9 form it says that is considered Discrimination if the employer refuses to hire you just because your EAD is about to run out. is a Crime!

But if your EAD is already expired and you have no job, then is different cause I don't think any employer would Hire you if your EAD is already expired, even after you show them the receipt but if you are currently working when you EAD expire, then you have the RIGHT to keep working.

K1 are employment authorized and when you applyfor AOS under K1, you still have K1 status, therefore, you can continue working while you wait for your EAD Card.

I have seen many cases of Illegal immigrants working in the US, get married an then get a green card with no problems, so do you think they will bother you ,that came on K1 visa, did the right thing, submited all the necessary paperwork and are waiting for the EAD card (in this case).the economy is alreayd tough and leaving a job right now is out of the questiion for me.

This is just my opnion, do what you feel is right..
