  1. This is a long one so here it goes.

    I do not meet the income requirements to sponsor my wife, so my mother is going to sponsor her. My mother has just recently separated from her husband. She has proof that she makes the required income, but all her past tax forms include her soon to be ex-husband. For the past three years she did not meet the requirements by herself, but with her husband she was over the required poverty line . My mother lives by herself while I live with my wife.

    question 1-On the form I-864 part six number 25 should the total income listed be straight from the IRS tax report or should it only state what she made by herself those three years?

    question 2-Is she required to make the minimum required income for those three past tax years by herself even if she can show that her expected income is greater?

    question 3-Are we required to have her ex-husband fill out an I-864A even though she has a restraining order on him?

  3. 1-My wife came here on H2B visa so she received a temporary tax number. several forms ask different questions about any tax number she had, so should we fill in her expired number?

    2-She also applied for a student visa at the end of 2006. she was approved but did not pay for or accept it. Should we include this visa in our paperwork even though she did not accept it?

    3-She has stayed in another country than her own for over a year. We have heard that we must have a copy of her criminal record from this country even if there is nothing on it. Is this true?
