    I have a question about ice, ive recently dropped my student status. And apparently ice has been looking for me in my previous address. First time when i came to the US, i came to a good american family, and the address was registered in my college too. I want to go to visit them for couple of days, is this possible they could come to the first address to look for me?

    So, there's no way if ice can't find me they will arrest her right? I mean we're getting divorce, so they shouldn't do this.

    It's been six months that i'm out of student status, and ive been engaged with unauthorized employment. I know that if you're married to ucs, being engaged to un. employment is forgivven, but we're getting divorce so, is this going to be possible to get reinstated?

    As I mentioned before I'm getting divorce and we've been married for 1.5 years. But if i meet a girl, a usc, if I get married second time, how big are my chances of adjusting my status with a second wife?

  3. Travel within the US when you're out of status(please help)

    Hello everyone,

    i recently lost my student status, well over 5 months, ice has come to my previous address where my usc wife live.I never filed for AOS, because she doesnt want it, we are in proceeding of getting divorce. She's panicking and told me that ice told her if they wont find me they will arrest her, is that true?so does it mean I am on proceeding? One more imporant question, is this possible to travel within the Us,i have a valid drivers license. I am really scared to go thru the airport, or should i travel by a train?

  5. I remember reading another Russian's post confirming that your country does not do no objection letters, sorry. Your options at this point are to file based on one of the other ways- maybe hardship to USC spouse if moving to Russia would pose hardship to him outside of the regular stuff one would face in moving say from Florida to New York. Hardship is the key word. The other option is to return to Russia for 17 months. Moving to Canada would not work as that is a third party country, so spending time there would not count towards fulfilling the requirement. You can consult with a lawyer- but I'm pretty sure he/she will say the same thing, unless they find a way to show you should not have been mad subject to the rule in the first place.

    Since we are from different countries, your embassy would have to inform you about what documents they need from you. As it regards the Dept. of state, start reading here: http://www.travel.state.gov/visa/temp/info/info_1288.html

    Hello, one more thing i wanted to ask u,

    my heads gonna explode with a waiver soon,

    if u were funded by the us government, can u get waived with no objection statement?

    i was funded by the us govt,

  8. Waiver is only needed if you have J-1 with a 2 HRR

    If she has a past J-1 and did not go home for the two years, she will still need a waiver. The requirement does not disappear because you got a new visa.

    Read somewhere that she might needed to get a waiver to get F-1...we dont know much about her situation.

    yea i called the uscis multiple times, the customer service sectios is so poor skilled, some of them told they have never heard about 2 hrr,

    oh well, i believe that i have to get waived.

    yea currently im on f-1, but first time when i was on j1 i did go home for 7 months, i dont think its enough,

    i dont know what to do, i dont trust lawyers, they dont have much skill about waiver either.

    I called my embassy in dc they told me that they dont do give no objection letter.

    so, what should i do?

    I need you help really bad, I have a lot of questions. I'll trully appriciate everyone's answer.

    I got married in the middle of last year. I came with j1 w/ 2 HRR applied to it in 2006, but went back home and came back to the states the same year with F1. So, I got my ssc through my college to work oncampus, but I used it for off campus. I hope it wont affect my status. Anyways, I dont know where to start the waiver. My wife's income isn't enough to cover me as a sponsor, but hopefully we'll find a sponsor.

    1. what waiver option should i use to get waived? I already tried no objection letter from my embassy, they told me they dont this kind of stuff, and I also heard that No objection letter is not the most effective ones. So I dont know what exactly to do in this case.

    2. Will my situation using ssc offcampus affect my aos status when the time will come?

  13. hey! I am here on a j-1 vsa with the 2 year home residency requirment. You NEED to get a waiver for that restriction, otherwise even if you get married you will have to go to your home country for 2 years. There are different criterias for which you can apply for the waiver. I asked my home country to issue me a no objection letter, and got a waiver thanks to that letter.

    You will have to contact your embassy and ask them what the process is for getting a no objection letter. In my case, my home country asked me for an essay explaining my situation and why I would like to stay, and some other documents, after which a few months later they send me a no objection letter and they send USCIS a copy two. After that they have to study your case and give you a desiscion. This can be a slow process so you should get started ASAP... however it is not THAT hard to get the no objection letter.

    When you cam here under the j-1 visa what kind of program where you doing? Did you pay for the program or did your goverment or the USA goverment pay fo it? If it wa pais by either governments you are not eligible to geta waiver...

    Yeah, it was paid by government, i came through high school program which was paid by government, i went home and stayed for almost five months and came with F-1. I called my embassy last week, they said they won't do it because if one does it the other ones will ask for it. What should I do? I can't go home, because I might get denied after, because im using my ssc which doesnt have an authorization. I love my wife, and I can't get separate, and I need to file those docs, what should I do? you mean, even though they will give an no objection waiver, USCIS will deny it because my program was paid by the us govt?

    Please help, I hope there will be a solution,

  14. Hey guys, two years ago, i came to the us with j-1 visa, which has two year ome residency rquirement. But I spent only several months and came to the US with F-1 visa. I got my SS card through my college and has been working off campus without authorization, but here is a situation, i got married four months ago, and i just started to gather my files and file for the petition, and just remembered that i had that visa. Has anyone heard this situation? I cant get any waiver. If i go to my home country and spend another 2 years and try tocomeback, im afraid they wont issue me a visa becuase, i think, theyll know i worked w/t authorization, so what do you think should I do?

    Please guys open ur opinions. Im really stressing out

    1) Yes, any "friend" or Relitive living in the USA can provide an I-864 as a Joint Sponsor.

    3) What VISA did you use to enter the USA on, if by K-1, the resulting EAD would expire 90 days after entry, if by K-3, the EAD may be valid for up to 2 years.

    1.Here are some important question. Since I asked you guys about filing AOS paper later, because my wife's income is too low. The owner of my restraunt is a foriegner too, but he is a USC. He can co-sponsor us documentally. Is it ok that my employer is sponsorig us? if so, what documents does he have to have?

    2. I'm really affraid of all these forms and interviews. Should I hire a lawyer? right now, I'm not confident enough to do all these stuff. The lawyer is asking 2k, it's a lot of money, because i also have a tuition costs.

    3.Is it ok if just send EAD form withough AOS form? to get an author.. ssc. Because i have an unautho.. ssc through my college and I am working with that ssc.

  17. Hi guys, here is my situation. my wife's income is not that high, and she might get a promotion by the begining of next year. Now her net income is between 1200 to 1300. I do not think it would be enough for supporting both of us. I am making the same money, but I working with my unauthorized ssn, that is why I do not think, that my affidavit would be counted. Does anyone know that if I file for AOS in next year or in two years, is it bad? do you have to file right after you get married? what would you suggest?please, I do need your help in this case, I am so confused,.
