  1. Filling out the 325a form that goes with the I-130 two copies are required I understand, one from each party. The question I have is when filing out my copy what do I put in the box for applicant name..? Myself of my wife’s (she is the one I am applying for an AOS for as we were married here in the U.S.A. while she was visiting from Panama) If there is a form for each of us this has me confused a bit..! In my mind she is the applicant but you never know with these kind of government forms..? Do I put my name in the box on the form I fill out and her's on the form she fills out..? Or does her name go in the box on both our forms? Any help appreciated.

  2. On the I-485 form choices UNDER Part 2. Application Type. (Check one)., I am applying for an adjustment to permanent resident status because: The choice I should choose I am not sure of…? There is nothing for married on a tourist visa while in the U.S.A.! Only thing close is a box labeled Other basis of eligibility. Explain. Can that be marked and accompanied by a brief explanation such as married to a U.S. Citizen currently applying for an adjustment of status…?

    Any help greatly appreciated

  3. Another follow up question, on the I-485 form

  4. Was married on the spur of the moment here not abroad as planned while my girlfriend was on a 6 month tourist visa for a long visit and we are filing our AOS paper work now. Question do we still need to include an I-130 in our AOS/I-485 packet now that she is here in the U.S.A. ? And if so it can go all together right? She has no Alien registration # can we put none on the forms for that question & A # ?

About the G-325a biographic form I understand two copies need to be sent in one for her the applicant and one for me (as petitioner I guess?)..? I just put my info in and leave the rest identical to hers..? Is that correct? The instructions for it are vague and say nothing of sending in two copies just hear that on the forums.

Much thanks for any clarity on these question

  5. Thanks for that info just was not sure if I needed both and if so if I could do it all together.

About the G-325a biographic form I understand two copies need to be sent in one for her the applicant and one for me (as petitioner?)..? Is that correct? If so what does she put for alien registration number? None since she does not have one with her current visa/tourist?

  6. Can anyone tell me if I can include the I-130 with my AOS packet or if I need to do it separate..? She is already here in the U.S.A. and I was under the understanding that we only needed to do the AOS paper work now. The I-130 has me confused because that is for a Alien relative who is not yet her/(seaking permission to come to the U.S.A).

Anyone married on a tourist visa out there that could clear this up for me. Do I do the I-130 separate, then wait for a reply or do I send them all in at once the I-130 & I-485/AOS packet…? Some people say I only need to do the I-485 and some other say do both together…?

  7. Some confusion here..! My girlfriend (from Panama) and I got married here in the U.S. on the spur of the moment while she was here on a 6 month tourist visa. The way I understand it we do not need to do the I-130 now just the adjustment of status packet now because she is already here not the alien relative/I-130 form that is required to get your fiance here for the marriage. Is this correct? Any help appreciated.

  8. Just trying to clarify a few questions regarding my wife’s AOS/ Adjustment of Status paper work packet, post marriage. One question I am not sure about..? Do I need to send in a form I-130/Petition for Alien Relative if we were married here/U.S.A. while she was legally here on a tourist visa. (Yes I know all about the fraud of that. But in my case circumstances changed for both of us, we/she did not know at the time she arrived that we would get married, nothing illegal about that.) Anyway my understanding is we just need to file the I-485, I-864, I-693, I-765, (and the I-131 if she wants to.) Just trying to make sure I am correct about that. From my understanding the I-130 would have been required should I have filed for the K-1 or K-3 visa…?

She has a valid One year visa to stay here. Also on the medical form what are the vaccination requirements? And since her vaccination records are in her home country retrieving them now is next to impossible. Hoping she does not have to get every vaccine under the sun to satisfy all the requirements..! Anyway would appreciate any feedback or advice for these circumstances.

    Thanks
